ARTICLE VII

- YARD AREAS AND FENCES

Sec. 54-205. - Required yards; size.

Except as otherwise provided in this article, yards shall be provided for buildings as follows:

Sec. 54-206. - Additional standards and specifications.

In addition to the size regulations set forth in section 54-205, the following standards and specifications shall apply unless otherwise provided in this chapter:

(1)

On lots fronting on two non-intersecting streets, a front yard must be provided on both streets.

(2)

On corner lots in the R district, there shall be a yard along the side street side of such tract of at least 15 feet, except that, in the case of separate tracts which are less than 75 feet in width, only 20 percent of the width of the lot need be provided for such side yard, so long as the buildable width of a corner lot shall not be less than 30 feet.

(3)

On corner lots in C and M districts, there shall be a yard along the side street side of such tract which is equal in width to the depth required for the front yard of such adjacent lot. In those instances where the area adjacent to the rear yard of a corner lot in an R district had not been developed or the preliminary plat for such area has not been approved, such corner lot shall provide a side yard along the side street of at least 15 feet.

(4)

On corner lots in the C and M districts that rear upon an R district, a ten-foot yard must be provided along the side street side.

(5)

Where a block frontage is divided among districts with different front yard requirements, the deepest front yard as required by this chapter shall apply to the entire frontage.

(6)

Where a lot is in a C or M district and is next to an R district, the side or rear yard required in that R district must be provided along the boundary line.

(7)

In the C and M districts, there may be more than one commercial or industrial building on a lot, provided that the required yards be maintained around the group of buildings.

(8)

Dwelling uses, except hotels, located in the C and M districts must provide the yards required in the R-2 district.

Sec. 54-207. - Requirements for lots with multiple structures.

There may be two or more related multifamily, hotel, motel, or institutional buildings on a lot, provided that:

(1)

The required yards be maintained around the group of buildings; and

(2)

Buildings that are parallel, or that are within 45 degrees of being parallel, are separated by a horizontal distance that is at least equal to one-half the height of the highest building, or 15 feet, whichever is greater.

Sec. 54-208. - Repair, etc., of nonconforming structures.

Those parts of existing buildings that violate yard regulations may be repaired and remodeled, but not reconstructed or structurally altered, unless specifically approved by the planning and zoning commission.

Sec. 54-209. - Additional requirements for churches, public buildings and institutions.

Churches, public buildings and institutions when located in an R-1 or R-2 district shall provide front and rear yards of 50 feet and side yards of 25 feet.

Sec. 54-210. - Use of front yard areas restricted.

Required front yards shall be used only for landscaping, walkways, and driveways necessary for access to the parking areas. In the R-2, C and M districts, signs and light standards may be located in required front yards. No other structures are permitted.

Sec. 54-211. - Exception for side and rear yards on separate tracts.

On separate tracts, the side yard may be reduced to ten percent of the tract width and the rear yard may be reduced by 20 percent of the tract depth.

Sec. 54-212. - Exceptions for open porches, canopies and terraces.

Open, unenclosed porches (not glassed-in) and canopies may extend ten feet into a front yard. Terraces that do not extend above the level of the ground (first) floor may project into a required yard, provided these projections are distant at least two feet from the adjacent lot line.

Sec. 54-213. - Establishment of front yard areas on certain nonconforming lots.

When, on the effective date of the ordinance from which this chapter is derived, 40 percent or more of a block frontage was occupied by two or more buildings, then the front yard is established in the following manner:

(1)

If the building furthest from the street provides a front yard not more than ten feet deeper than the building closest to the street, then the front yard for the frontage is and remains an average of the then existing front yards.

(2)

If subsection (1) of this section does not apply, and the lot is within 100 feet of a building on each side, then the front yard is a line from the closest front corners of these two adjacent buildings.

(3)

If neither subsection (1) nor (2) of this section applies, and the lot is within 100 feet of an existing building on one side only, then the front yard is the same as that of the existing adjacent building.

Sec. 54-214. - Permitted projections.

Open fire escapes, fireproof outside stairways and balconies opening upon fire towers, and the projections of chimneys and flues into a rear yard for a distance of not more than 3½ feet, when so placed as to not obstruct light and ventilation, may be permitted by the building official.

Sec. 54-215. - Location of fences.

No fence more than 30 percent solid or more than three feet high may be located within 30 feet of a street intersection, and, except as otherwise provided in this chapter, fences less than six feet high may be located on any part of a lot.
