COMMERCIAL DISTRICTS

11-10A-1: PURPOSE:

The C-1 district is intended to provide convenient access to goods and services close to residential areas in a manner that is environmentally compatible with such areas. To accomplish this intent, the district provides close to home locations for a limited range of frequently patronized establishments providing convenience goods and services that predominantly serve only the neighborhood. It is intended that such uses will create minimal land use incompatibility with surrounding residential areas. (Ord. 99-02, 1-7-1999)

11-10A-2: PERMITTED USES:

Accessory uses, buildings, and structures to all permitted uses in the district.
Bakeries and donut shops with limited food preparation on the premises.
Beauty shops and barbershops, and hairstyling salons.
Candy, ice cream, popcorn, nut and yogurt stores.
Card and gift shops.
Clothing, hat, and shoe repair stores and tailor shops.
Computer and data processing services.
Consumer electronics and music stores.
Convenience food stores.
Courier services, except air.
Dry cleaners and laundries (processing to be done off site) and laundromats.
Financial institutions, including banks, savings and loan associations, and commercial loan offices, with or without a drive-in or drive-through, which are located in-line within a shopping center.
Florist shops.
Food delivery establishments.
Grooming services for pets.
Hobby and craft shops.
Home decorating establishments.
Insurance offices.
Liquor stores (package goods only).
Locksmith.
Mailbox service, private.
Newspaper and magazine shops.
Office, stationery, school, art and graphic supply stores.
Outdoor dining café, provided that:
   1.   Outdoor dining cafes shall be considered an ancillary use to a restaurant use.
   2.   An outdoor café permit shall be required and shall be subject to annual approval.
   3.   An annual permit and renewal fee of one hundred ($100.00) dollars shall be required.
   4.   All tables, chairs and other appurtenances shall be easily removed during winter months if required by the village.
   5.   Outdoor furnishings shall be able to withstand wind pressure and shall be harmonious with the architectural character of the building.
   6.   The outdoor dining area complies with all applicable accessibility, building, life safety, and health code requirements.
   7.   Additional parking spaces shall not be required for the outdoor dining area.
   8.   The hours of operation of the outdoor dining area shall be between the hours of ten o’clock (10:00) A.M. and ten o’clock (10:00) P.M.
   9.   The sale, serving, and consumption of alcoholic beverages within a restaurant’s outdoor dining area shall be subject to the liquor licensing of the village. In addition, any business that serves alcohol within its outdoor dining area must also include the following improvements:
      a.   The outdoor dining area shall be enclosed by a decorative, semi-open metal fence that has a maximum height of four (4') feet, and includes an emergency gate for egress in a location acceptable to the village.
      b.   Access to and from the outdoor dining area must be through the restaurant.
   10.   The outdoor dining area shall be maintained in a clean and orderly manner.
   11.   Outdoor trash receptacles shall be provided within the outdoor dining area.
Personal services, but not including adult uses.
Pet shops, including grooming.
Real estate offices.
Restaurants but not including the serving of alcoholic beverages and/or drive-through facilities.
Retail sale of clothing and shoes.
Tax preparation offices.
Tobacco shops (see section 4-14-9 of this code for distance requirements).

11-10A-3: CONDITIONAL USES:

Upon recommendation by the Planning and Zoning commission, after public hearing on petition pertaining thereto, in accordance with the requirements set forth for such hearing in chapter 3, article C of this title, the corporate authorities of the village may, by conditional use permit, allow the following uses in the C-1 district:
   Accessory uses, buildings, and structures to all conditional uses in the district, including off street parking and loading and signs as provided in chapters 5 and 6 of this title.
   Automated teller machines.
   Child daycare center.
   Drive-in and drive-through establishments.
   Educational institutions.
   Financial institutions, including banks, savings and loan associations, and commercial loan offices, with or without a drive-in or drive-through, which are located in a freestanding building.
   Game rooms.
   Hospitals.
   Integrated shopping centers.
   Planned unit developments.
   Psychic readers.
   Public utility and services.
   Recreational institutions.
   Religious institutions.
   Restaurants, serving alcoholic beverages.

The C-2 district is intended to provide locations for a broad selection of convenience and comparison shoppers' goods and services in centralized and highly accessible locations that serve the entire village and surrounding areas. (Ord. 99-02, 1-7-1999)

11-10B-2: PERMITTED USES:

Accessory uses, buildings, and structures to all permitted uses in the district.
Animal hospitals.
Antique shops.
Art shops or galleries, not including auction rooms.
Automobile parts and accessory stores.
Bakeries and donut shops with limited food preparation on the premises.
Beauty shops and barbershops, and hairstyling salons.
Bicycle sales, rental and repair shops.
Blueprinting and photostatting establishments.
Bookstores or book-stationery stores (except adult bookstores).
Business machine sales, rental and service, including computer stores.

   Financial institutions, including banks, savings and loan associations, and commercial loan offices, with or without a drive-in or drive-through, which are located in a freestanding building.
   Flea markets.
   Game rooms.
   Indoor amusement establishments, including bowling alleys, pool halls, dance halls, commercial swimming pools, and skating rinks.
   Integrated shopping center.
   Kiosk.
   Massage Therapy
   Medical cannabis dispensing organization.
   Minimarts in conjunction with automobile service stations.
   Moneylenders.

   Self-storage facilities, provided that:
      A.   The minimum building size shall be sixty five thousand (65,000) square feet;
      B.   No more than twenty five percent (25%) of the building frontage may be used for the self-storage facility;
      C.   A maximum of eighty percent (80%) of the gross building square footage may be used for the self-storage facility;
      D.   There shall be no outside storage associated with the self-storage facility, which includes but is not limited to customer's recreational vehicles, boats, automobiles, and other motorized vehicles;
      E.   There shall be no direct access from the exterior of the building to individually leased units;
      F.   Motor vehicles are not permitted in the building; and
      G.   Outdoor parking of truck and trailer rental is permitted provided all parking minimums are met. Truck and trailer rentals shall be located in the rear yard only and interior side yards provided full screening from adjacent properties and adjacent thoroughfares.
