(a)

This chapter is adopted pursuant to the authority granted by V.T.C.A., Local Government Code chs. 54 and 214 for purposes of:

(1)

Protecting the health, safety, and welfare of the citizens of the city by establishing minimum standards applicable to residential and specific nonresidential structures with respect to utilities, facilities, and other physical components essential to make structures safe, sanitary, and fit for human use and habitation, and permitting demolition of structures as a last resort when compliance with standards cannot reasonably be achieved;

(2)

Creating and establishing a building and standards commission which shall have jurisdiction and authority to administer and enforce this chapter.

(b)

This chapter is remedial in nature and essential to the public interest, and it is intended that this chapter be liberally construed to affect its purpose.

(a)

Scope. This chapter shall apply to all buildings and structures or portions thereof intended or used for human habitation and occupation, unless otherwise specified, which existed on June 21, 2010, or are constructed thereafter.

(b)

Application to existing buildings and structures.

(1)

Additions, alterations, or repairs. Additions, alterations or repairs required by this chapter will be done in accordance with, and meet, the requirements of the current building, plumbing, mechanical, or electrical code, as amended, whichever is applicable, unless a variance is granted as provided herein;

(2)

Relocation. Buildings or structures moved into, or existing within, the city shall comply with the requirements of the current building, plumbing, mechanical or electrical code for new buildings and structures, as amended, whichever is applicable, unless a variance is granted as provided herein.

(c)

Conflict with zoning regulations. Nothing in this chapter shall be construed to cancel, modify, or set aside any provision of the city's comprehensive zoning regulations.
