M-3 MANUFACTURING DISTRICT

8B.01 - Preamble.

Regulations for the M-3 manufacturing districts are designed to provide for establishment of additional special uses other than those that are otherwise provided for in the M and M-2 manufacturing district. The M-3 district is further designed to address instances where the combination of manufacturing and land reclamation development are appropriate and compatible.

8B.02 - Permitted uses.

The permitted uses in the M-3 District shall include the following:

a.

All the uses permitted in the M-1 manufacturing district shall be permitted uses in the M-3 manufacturing district.

b.

Asphalt Recycling, Storage and Sales: The process whereby previously manufactured asphalt is received, stored, segregated, processed, crushed and remixed, without the application or use of heat, for sale to end markets.

c.

Concrete Recycling, Storage and Sales: The process whereby previously manufactured concrete is received, stored, segregated, processed, crushed and remixed for sale to end markets.

d.

Feedstock Recycling, Storage and Sales: The storage of source segregated gravel, glass, brick, or block in accordance with Village performance standards for use in any permitted operation.

e.

Reclamation or Fill Operation: The operations necessary to receive and place soil for reclamation or construction purposes not associated with an uncontaminated soil or CCDD operation which meets "Inhalation/Ingestion Standards for Tier I Soil Remediation Objectives for Residential Properties", Appendix B Table A within 35 Illinois Administrative Code Part 742. These operations include the inspection, segregation, preparation and placement of such materials in accordance with the laws, rules and regulations of the State of Illinois. These operations may be combined with other permitted or approved special uses, subject to the applicable performance standards for each.

8B.03 - Special uses.

Allowable special uses in the M-3 manufacturing district shall include the following:

a.

All special uses that are allowable in the M manufacturing district.

b.

All permitted and special uses in the B-1, B-2 and B-3 zoning district classifications.

c.

A planned unit development pursuant to Article IX of the Village's Zoning Ordinance.

8B.04 - Special use criteria.

Any special use permissible in the M-3 manufacturing district shall require that each of the following criteria be established:

a.

The establishment, maintenance or operation of the special use will not be detrimental to or endanger the public health, safety, morals, comfort or general welfare.

b.

The special use will not be injurious to the use and enjoyment of the property in the immediate vicinity for the purposes already permitted, nor substantially diminish or impair property values within the neighborhood.

c.

The establishment of the special use will not impede the normal and orderly development and improvement of the surrounding property for uses permitted in the district.

d.

Adequate utilities, access road and drainage for the necessary facilities have been or will be provided.

e.

Adequate measures have been or will be taken to provide ingress and egress so as to minimize traffic congestion on the public streets.

f.

This special use shall, in all due respects, conform to the applicable regulations of the district in which it is located, except for such regulations as may be modified by the village's board of trustees pursuant to the recommendations of the zoning board of appeals.

8B.05 - Performance standards.

The performance standards established for the M manufacturing district shall be met for the M-3 district. The performance standards may be waived in whole or in part by the Village's Board of Trustees.

8B.06 - Bulk and development standards in the M-3 manufacturing district.

The bulk and development standards applicable in the M manufacturing district set forth in section 8.05 of the village's zoning code shall be the bulk and development standards for the M-3 manufacturing district. Except, the bulk and development standards of the M manufacturing district shall be revised for the M-3 manufacturing district to provide that the setback shall be at least 100 feet from the front lot line on any dedicated road and no less than 150 feet from the centerline of any non-dedicated road. Notwithstanding anything contained herein, the provisions of section 8.05 of the zoning code entitled Bulk and Development Standards in the Manufacturing District shall not apply to quarry operations, Asphalt Recycling, Storage and Sales; Concrete Recycling, Storage and Sales; Feedstock Recycling, Storage and Sales; Maintenance and Storage Facilities; and Reclamation or Fill Operations.
