ARTICLE III

INTERPRETATION AND SEPARABILITY

3.01 - Interpretation.

In their application, the provisions of this comprehensive amendment shall be held to be the minimum requirements for the promotion and protection of the public health, safety, morals and general welfare, and the provisions shall be interpreted in accordance with the following:

A

Where the conditions imposed by any provision of this comprehensive amendment are either more restrictive or less restrictive than comparable standards imposed by any other provision of this comprehensive amendment or by any other law, ordinance, resolution, rule or regulation of any kind, the regulations which are more restrictive or which impose higher standards or requirements shall govern.

This comprehensive amendment is not intended to abrogate any ordinance, permit, easement, covenant or other private agreement, provided that where the regulations of this comprehensive amendment are more restrictive or impose higher standards or requirements than such ordinance, permit, easement, covenant or other private agreement, the requirements of this comprehensive amendment shall govern.

No structure or use not lawfully existing at the time of the adoption of this comprehensive amendment shall become or be made lawful solely by reason of the adoption of this comprehensive amendment, and that if any unlawful structure or use is in conflict with the requirements of this comprehensive amendment, such structure or use remains unlawful hereunder.

3.02. - Separability.

It is hereby declared to be the intention of the president and the board of trustees that the several provisions of this comprehensive amendment are severable in accordance with the following:

If any court of competent jurisdiction shall adjudge any provision of this comprehensive amendment to be invalid, such judgment shall not affect any other provision of this comprehensive amendment not specifically included in such judgment.

B

If any court of competent jurisdiction shall adjudge invalid the application of any provision of this comprehensive amendment to a particular structure or use, such judgment shall not affect the application of the provision to any other structure or use not specifically included in the judgment.
