ARTICLE 10

- AMENDMENTS

18-1001.- Zoning maps and zoning regulations.

This chapter may be amended whenever the public necessity and convenience and the general welfare require such amendment by the following procedure:

(1)

Proceedings for amendment of this chapter shall be initiated by one (1) of the following:

(A)

A petition of all of the fee owners of the actual property, the zoning of which is proposed to be changed.

(B)

The planning and zoning commission.

(C)

The city council.

(D)

The city planning department.

(2)

All applications for changes in the boundaries of any zoning district initiated by the owners of property shall be accompanied by the following:

(A)

A legal description of the area proposed to be rezoned; the names and addresses of all owners of property lying within such area and a description of the property owned by each.

(B)

A site plan showing buildings and uses upon the lands proposed to be changed.

(C)

A list of the names and addresses of the owners of all properties within eight hundred (800) feet, including street rights-of-way of the boundaries of the property proposed to be rezoned.

(D)

The present zoning district classification of the area and the proposed zoning district classification.

(E)

A fee shall be paid in accordance with section 18-1103.

(3)

Before any amendment is adopted, the planning and zoning commission shall hold at least one (1) public hearing thereon after a notice of the hearing has been published in the official newspaper at least ten (10) days before the hearing. Following the hearing the planning and zoning commission shall make a report of its findings and recommendations on the proposed amendment and shall file a copy with the city council within thirty (30) days after the hearing. If no recommendation is transmitted by the planning and zoning commission within thirty (30) days after the hearing, the city council may take action without awaiting such recommendation.

(4)

Upon the filing of such report, the city council shall hold such public hearings upon the amendments as it deems advisable; however, at least one (1) public hearing thereon shall be conducted and at least fifteen (15) days' notice of the time and the place of such hearing shall be published in the official newspaper of the city. After the conclusion of the hearing or hearings, the city council may adopt the amendment or any part thereof in such form as it deems advisable. The votes necessary to adopt such an amendment shall be:

(A)

No amendment to the text of this chapter, except as provided in subsection (4)(B) below, shall become effective except by the favorable vote of the majority of the members of the council present.

(B)

No amendment to the zoning map to rezone any property or to alter or modify the uses permitted in any zoning district shall become effective except by the favorable vote of three-fourths (¾) of all of the members of the city council or, if less than three-fourths (¾) of all members of the city council are in attendance, by the unanimous vote of all those present.

18-1002. - Subdivision regulations.

(1)

The planning and zoning commission may, from time to time, adopt and amend rules and instructions for the administration of these subdivision regulations.

(2)

These subdivision regulations may be changed or amended by the city governing body upon a recommendation by the planning and zoning commission after a public hearing. Notice shall be published in a newspaper of general circulation in the City of Grand Forks at least ten (10) days before the date of such hearing. Such amendment shall be by ordinance adopted by a majority vote of all council members present.

(3)

These subdivision regulations, and any amendments thereto, shall be published and shall be recorded with the register of deeds as provided by law.

18-1003. - Comprehensive plan.

The comprehensive plan may be amended from time to time in North Dakota in accordance with the laws of the State of North Dakota (N.D.C.C.) (40-48) providing for adoption and amendments of the comprehensive plan of the city.

18-1004. - Street and highway master plan.

The map showing the reservations and future acquisitions for streets shall be amended as provided by Chapter 40-48 of the North Dakota Century Code.
