Sec. 21-295.- Intent.

Applicants for development approval may seek approval of proposed projects as a planned unit development (PUD). Planned unit developments are generally developments under unified control, planned and developed as a whole in a single development phase or programmed series of development phases. Such PUDs are of relatively large scale and high quality requiring land use, density and/or site design flexibility.

Sec. 21-296. - Review process.

(a)

All planned unit developments shall be classified as level three development and shall undergo rigorous site development and architectural design review by the development review board and the city council. It is the intent of this article that the applicant for development approval will show evidence of increased public amenities or public benefit and/or evidence of mitigative measures in site design, in return for the land use, density and/or site design flexibility afforded under the planned unit development approval process.

(b)

The overriding consideration of the development review board and the city council in approval of a planned unit development shall be the project's compatibility with adjacent and surrounding uses, sensitivity to natural resource protection, provision of site specific amenities, parkland and recreational facilities/areas and other amenities, and overall community benefit. The applicant must demonstrate how the project meets the above criteria, and how the project is consistent with the intent of the land development regulations.

Sec. 21-297. - Planned unit development types.

Planned unit developments may be classified either as residential, commercial or mixed use PUD. A residential PUD is a development exclusively devoted to residential uses. These uses may occur as single-family and/or multifamily uses. A commercial PUD is a development exclusively devoted to a variety of commercial activities, including public and medical uses. A mixed use PUD is a development that incorporates both residential and commercial (including public and/or medical) uses. Districts in which PUD's may be approved are listed below:

Sec. 21-298. - Minimum area requirements.

Minimum area requirements for residential and/or commercial PUDs shall be two and one-half acres. Minimum area requirements for a mixed use PUD shall be five acres.
