- Mixed-Use and Business Districts
5.1.1. Intent
To provide for locations within the county which are generally along major limited access highways, adjacent to residentially zoned or residentially developed areas, and situated as to benefit from proximity, accessibility or visibility from highway corridors. Development is reserved for light business, institutional uses, and public uses and facilities. District regulations are designed to protect the district and surrounding residential areas, to present an appearance of orderly development, and to establish standards for intensity of use and character of development compatible with the purpose of the district.

To provide for locations within the county to be developed and reserved for master planned developments that incorporate a mix of residential uses, nonresidential uses, and open space. District regulations are designed to encourage the orderly development of larger sites with a mix of uses, allow for innovative and creative site planning and design at a pedestrian scale, facilitate pedestrian interconnectivity between uses, and minimize the impact of the district on surrounding areas.
5.4.2. Uses
A.
As defined in Article 7 (Use Provisions), Sec. 7.2 (Allowed Use Table).
B.
No more than 50 percent of the total dwelling units on a site may be townhouses.

5.4.5. Development Standards
The following development standards apply to all properties within the M-U district. If the standards of the M-U district conflict with those in other sections of this UDC, the standards of this section apply.
A.
Nonresidential Requirement
1.
At least 20 percent of the total acreage of each development must be nonresidential uses.
B.
Internal Streets
1.
All developments must incorporate new streets to serve the on-site uses and organize the development in an orderly pattern.
2.
All streets, whether public or private, must be built to the public street standards of this UDC.
3.
Streets should be designed to allow for future connectivity with adjacent parcels if none exists. Future connectivity must be provided in the form of a stub-out street or other means as determined by the Director.
a.
The stub-out street right-of-way, pavement, and curbing must extend to the boundary of the abutting parcel where the connection to the anticipated street is expected.
4.
If a street connection or stub-out street exists on an adjacent parcel the new streets must connect to the established street.
5.
Streets may not be gated, except for private streets serving residential uses, subject to approval by the Director.
6.
Cul-de-sacs or dead-end streets are not permitted, except as detailed for future connectivity above. This provision may be modified by the Director due to the presence of topographic or natural features.
C.
Block Standards
1.
Sites of 10 or more acres in size must incorporate internal streets as provided in Sec. 5.4.5.B. to form an interconnected network with a maximum block perimeter of 3,200 feet, except as otherwise provided below.
2.
Blocks exclusively containing the following are exempt from 1 immediately above:
a.
Any civic use.
b.
An open space at least one acre in size.
3.
Block perimeter is measured along the street centerlines.
4.
Blocks required by this Sec. 5.4.5.C. must be bounded by public streets or private streets built to public street standards.
D.
Parking
1.
Vehicular parking is not permitted between the building and the street and must be located to the side or rear of any nonresidential use.
2.
Vehicular parking is not permitted in the front yard of any residential use.
E.
Driveways and Curb cuts
1.
In addition to the standards for driveway construction found in Title 12 of the Hall County Code of Ordinances, the following standards apply to driveways within the M-U district. In the case where these standards conflict with those found in Title 12, the more restrictive standard applies.
a.
Driveway curb cuts may not be located on any arterial or collector street when access may be provided from a local street.
b.
Driveway curb cuts must intersect streets at right angles.
F.
Inter-parcel Access
1.
Developments should provide vehicular access to adjacent parcels by means of street connections, shared driveways, cross-access easements, or other inter-parcel connections.
2.
When an adjacent nonresidential property is in a natural or undeveloped state, a future inter-parcel connection should be provided with a driveway or road stub-out and appropriate easements.
3.
This provision does not apply to attached and detached single-family dwellings.
G.
Pedestrian Access
1.
All uses or buildings must incorporate walkways or pathways to provide pedestrian access from one use or building to another use or building. At a minimum, this includes a safe and convenient pedestrian route from the building entrance to the nearest sidewalk.
2.
All parking lots or parking structures must incorporate walkways or pathways to provide safe and convenient pedestrian access to building entrances.
3.
Public sidewalks must be constructed to connect to existing sidewalks on adjacent parcels. When no such sidewalk exists on adjacent parcels it must be constructed to the property line and reserved for future connection.
H.
Residential and Nonresidential Connectivity
There must be direct and convenient sidewalks or pathways providing pedestrian access between residential and nonresidential areas.
I.
Building Design Standards
1.
Buildings must have their primary facade fronting and facing a public street. If located along a private street, buildings must have their primary frontage along such street.
2.
All nonresidential buildings within a development must incorporate materials and elements to present a unified design.
3.
Building mechanical and accessory features must be located to the side, rear, or roof of the principal structure and in the location of least visibility from the public or private right-of-way.
a.
When the above standard is not reasonable due to reasons of topography or other similar existing site conditions, screening of such features with landscaping or fencing is required as indicated in Sec. 8.2.

5.4.7. Other Standards

District regulations are designed to allow for uses which are not significantly objectionable to surrounding properties and to encourage the formation of a compatible environment for uses generally classified as light industrial in nature.
