ARTICLE XI

R-B Residential Business District

§ 135-100 Purpose.

The R-B Residential Business District is intended to provide the opportunity for low-intensity commercial development consistent with the general character of a residential neighborhood. These businesses also should be compatible with adjoining neighborhoods.

§ 135-101 Applicable regulations.

The following regulations and applicable regulations contained in other articles shall apply in the R-B Residential Business District.

§ 135-102 Principal permitted uses.

Principal permitted uses or structures shall be:

Any use or structure permitted and regulated as a principal permitted use in a B-L, R-O, or R-10,000 District, except as may be hereinafter modified.

§ 135-103 Conditional uses requiring Board authorization.

Conditional permitted uses or structures shall be:
A. 
Any use or structure permitted and regulated as a conditional use in a B-L District, except as hereinafter modified.

§ 135-104 Accessory uses.

Accessory uses shall be as follows:
A. 
Uses and structures customarily accessory and incidental to any permitted principal use or authorized conditional use.

§ 135-105 Required conditions.

A. 
Any addition or alterations to the exterior of an existing or former residence shall not alter the residential appearance of the building. Any building, renovation or addition shall be consistent with the architecture, construction and materials of neighboring structures. Within the Main Street Revitalization Area, the architecture, construction and materials shall be consistent with the design guidelines in the Main Street Revitalization Plan.
B. 
Any new building or structure shall be residential in design and character and shall not exceed 3,000 square feet (first floor) and 6,000 square feet (total).
C. 
Any addition to an existing building shall not exceed 50% of the existing floor space, but in no instance exceed the size as restricted in § 135-105B.
D. 
All business, services or processing shall be conducted wholly within a completely enclosed building, except for off-street automobile parking and loading areas and public utility uses.
E. 
Processes and equipment employed and goods processed or sold shall be limited to those which are not objectionable by reason of odor, dust, smoke, cinders, gas, fumes, noise, vibration, refuse matter or water-carried waste.
F. 
Off-street parking shall be restricted to the rear or side yard of the lot, unless otherwise permitted by the Commission.
G. 
Drive-through facilities or services shall not be permitted.
H. 
Business signage shall be limited to 10 square feet per face. Freestanding signs shall not be mounted higher than six feet from ground level. When lighted, all signs shall use indirect light in such a manner as not to illuminate neighboring properties. All signage must be consistent with the design guidelines in the Main Street Revitalization Plan.

§ 135-106 Height regulations.

New principal structures shall not exceed 45 feet in height and no new accessory structure shall exceed 1 1/2 stories or 25 feet in height, except as provided in § 135-258.

§ 135-107 Lot area, lot width and yard requirements.

Setbacks shall be established to be congruent with adjacent properties and consistent with the Main Street Revitalization Plan within the Main Street Revitalization Area. In the absence of developed adjacent properties, the zone shall use the setbacks of the R-7500 District. In all instances, the Commission shall have the authority to determine appropriate setbacks in the site plan approval process.

§ 135-108 Site plan requirement.

A building permit or zoning certificate for any business shall not be issued by the Town without an approved site plan that conforms to the standards in the Town Code.
