ARTICLE VIII

R-10,000 Residence District

§ 135-70 Purpose.

The purpose of the R-10,000 Residence District is to provide for smaller lot sizes (10,000 square foot minimum) for single- and two-family dwellings, based on the use of public water and sewerage facilities. This district also enables the use of multifamily structures, but only in a planned unit development.

§ 135-71 Applicable regulations.

The following regulations and applicable regulations contained in other articles shall apply in the R-10,000 Residence District.

§ 135-72 Principal permitted uses.

Principal permitted uses shall be as follows:
A. 
Single-family dwellings.
B. 
Family day-care home, as defined by state law, caring for eight or fewer children, provided that state requirements are complied with.
C. 
Multifamily dwelling units, but only in a planned unit development.
D. 
Planned unit development, subject to the provisions of Article XXVII.

§ 135-73 Conditional uses requiring Board authorization.

Conditional uses requiring Board authorization shall be as follows:
A. 
Two-family dwellings, except that no dwelling unit in a planned unit development shall be modified to a two-family dwelling.
B. 
Clubs, fraternities, lodges or similar nonprofit organizations, provided that any buildings or structures are located subject to the distance requirements specified in § 135-20.
C. 
Community centers and swimming pools associated therewith.
D. 
Family day-care home, as defined by state law, caring for more than eight children, provided that state requirements are complied with.

§ 135-74 Accessory uses.

Accessory uses shall be as follows:
A. 
Accessory buildings or uses customarily incidental to any principal permitted use or authorized conditional use.
B. 
Keeping of roomers or tourists by a resident family.

§ 135-75 Height regulations.

No principal structure shall exceed 3 stories or 45 feet in height, and no accessory structure shall exceed 1 1/2 stories or 25 feet in height, except as provided in § 135-258.

§ 135-76 Lot area, lot width and yard requirements.
