Districts, Maps, Boundaries

§ 135-4 Districts established.

For the purpose of this chapter, the Town of Hampstead is hereby divided into districts as follows:
H Historic Zoning District
R-120,000 Residence District
R-40,000 Residence District
R-20,000 Residence District
R-10,000 Residence District
R-7,500 Residence District
R-O Residential Office District
R-B Residential Business District
B-L Local Business District
B-G General Business District
I-R Restricted Industrial District
G-C Groundwater Conservation District
P-C Public Conservation District

§ 135-5 Zoning Map.

A. 
The districts shall be of the number, size and shape as shown on the Zoning Map of the Town of Hampstead, and said map, with the necessary symbols, legends and explanatory matter thereon, is hereby made and declared to be a part of this chapter. As evidence of the authenticity of said map, it shall be signed by the Mayor and Council of the Town of Hampstead upon the adoption of these regulations.
B. 
The Zoning Map, based on the Comprehensive Plan, Hampstead and Vicinity, by Crockett Associates, as adopted by the Mayor and Council of Hampstead on September 7, 1972, as amended, is hereby made a part of this chapter as the Zoning Map of Hampstead.[1]

§ 135-6 Interpretation of district boundaries.

Where uncertainty exists as to the boundaries of districts as shown on the Official Zoning Map, the following rules shall apply:
A. 
Boundaries indicated as approximately following the center lines of streets, highways or alleys shall be construed to follow such center lines.
B. 
Boundaries indicated as approximately following property lines or platted lot lines shall be construed as following such lines.
C. 
Boundaries indicated as approximately following Town limits shall be construed as following Town limits.
D. 
Boundaries indicated as following railroad lines shall be construed to be midway between the main tracks.
E. 
Boundaries which are drawn parallel to road lines and which do not coincide with property lines or lot lines, and where not designated to dimensions, shall be deemed to be 200 feet back from the nearest road center line.
F. 
Boundaries are in unsubdivided property or where a district boundary divides a lot the boundaries shall be determined by the use of the map scale as shown thereon.
G. 
Where a district boundary line, as shown on the Zoning Map, divides a lot which was a single ownership and of record at the time of enactment of this chapter, the use authorized thereon and the other district requirements applying to the least restricted portion of such lot under this chapter shall be considered as extending to the entire lot, provided that the more restricted portion of such lot is entirely within 50 feet of said dividing district boundary line. The use so extended shall be deemed to be conforming.

§ 135-7 Public buildings, structures and uses.

A. 
Notwithstanding anything in this chapter to the contrary, the use of land, buildings, structures, or premises by the Town of Hampstead, including the location, erection, reconstruction, extension, enlargement, conversion or alteration of buildings, structures, parking areas, appurtenances, utilities or any other public improvements, may be located in any zoning district as principal permitted uses. Such governmental use of land or development shall be subject to the approval of the Planning and Zoning Commission where required by Article 66B[1]; however, the requirements of any zoning district such as lot sizes, setbacks or height restrictions shall not apply.

B. 
Any property owned by the Town of Hampstead, Carroll County or the State of Maryland may be designated on the Town of Hampstead's Zoning Map as "Public Conservation" and may be used for any public purpose in accordance with § 135-7A where such uses may include but are not limited to public buildings, public schools, public parks, conservation areas, recreational areas, stormwater management facilities and utilities.
C. 
The zoning district of any property acquired by the Town of Hampstead, Carroll County or the State of Maryland may be changed to Public Conservation upon the recommendation of the Planning and Zoning Commission and the approval of the Town Council.
D. 
Any property zoned Public Conservation sold, donated or otherwise conveyed to any nongovernmental entity may be rezoned to another zoning district as recommended by the Planning and Zoning Commission and approved by the Town Council.

§ 135-8 Administrative regulations.

A. 
The Mayor and Town Council may, upon the recommendation of the Planning and Zoning Commission, adopt administrative regulations to govern certain aspects of planning, zoning and land use. A list of adopted regulations shall be maintained in this chapter.
B. 
The following regulations have been adopted by the Mayor and Town Council:
(1) 
Accessory uses (residential).
(2) 
Temporary uses.
(3) 
Standard pavement section for residential streets.
(4) 
Standard pavement section for commercial/industrial streets.
C. 
All adopted regulations shall be maintained in the Town Hall and published on the Town's website.
D. 
Adoption, amendment or repeal of administrative regulations shall require the recommendation of the Planning and Zoning Commission and the majority vote of the Town Council.
