40 - FENCES

Prior to the construction of a new fence, or the repair or rebuilding of an existing fence, a permit must be obtained. To obtain a permit, the property owner must submit a plat of survey of the property along with a description of the proposed fence, the placement of fence on the property and the name and address of the person or company erecting the fence.
A.
Open Fences. An open fence, not more than six feet in height, is permitted in the backyard, along the sides of the yard and across the back property line. No front yard fences will be permitted except as otherwise allowed. Such fence shall not be less than five feet from the nearest property line.
B.
Solid Fences. A solid fence, not more than six feet in height, is permitted in the backyard, along the sides of the yard and across the back property line. No front yard fences will be permitted except as otherwise allowed. Such fence shall not be less than five feet from the nearest property line.
C.
A fence of any opacity, not more than six feet in height, is also permitted along no-access strips; and on lots backing to thoroughfares or alleys.
D.
Maintenance. Fences, where permitted, must be kept in good condition at all times, and repaired or replaced when necessary according to the direction of the building commissioner upon receipt of a fence permit for same.

Applications may be obtained at the village hall. Fees for this hearing to be determined from time to time by the village board.

A nonconforming property may be defined as a substandard sized lot where the residence has existed on the property for over twenty-five (25) years.
C.
All front yard fences existing on nonconforming lots on the date this title is adopted, shall be allowed to remain. In the event the fences need repair or rebuilding, the property owner may do so by obtaining a fence permit at the village hall. For total replacement of a front yard fence, a hearing must be held before the zoning board of appeals.
No fence shall be allowed that would block ingress or egress of driveways, alley lines or public thoroughfares.
All new fence posts shall be placed three inches off of the lot line with a depth of not less than forty-two (42) inches.
It is unlawful for any person to build or construct, or cause to be built or constructed, any barbed wire fence or fences of which any part is barbed wire, along any street, alley or public walk or drive, or through or along any public park or around any residential, business or manufacturing district.
