CHAPTER 4

ZONING DISTRICTS AND MAP

10-4-1: DISTRICTS ESTABLISHED:

The Village of Herscher, for the purpose of this Title, is hereby divided into the following zoning districts:
   E-1   Estate Residential District.
   R-1   Single-Family Residential District.
   R-2   Two-Family Attached Residential District.
   R-3   Multi-Family Residential District.
   C-1   Downtown Commercial District.
   C-2   Commercial District.
   I-1   Light Industrial District.
   A-1   Agricultural District.

10-4-2: ZONING MAP:

   A.   Authorization: The location and boundaries of the districts established by this Title are indicated upon the map entitled, "Official Zoning Map, Village of Herscher, Illinois", which, together with all explanatory matter thereon, is hereby adopted by reference and declared to be part of this Title.
   B.   Location Of Map: The Official Zoning Map shall be located in the office of the Village Clerk and shall be the final authority as to the current zoning status of land and buildings, subject to such authorized amendments which be in effect.
   C.   Interpretation Of District Boundaries: Where uncertainty exists as to the boundaries of districts as shown on the Official Zoning Map, the following rules shall apply:
      1.   Boundaries indicated as approximately following the centerline of streets, highways or alleys shall be construed to follow such centerlines.
      2.   Boundaries indicated as approximately following platted lot lines shall be construed as following such lot lines.
      3.   Boundary, lines which follow or approximately follow plotted lot lines of other property lines as identified by the "Tax Identification Number" of the parcel assigned by the County of Kankakee shall be construed as following such lines.
      4.   Boundaries indicated as following railroad lines shall be construed to be midway between the main tracks.
      5.   Boundaries indicated as following shore lines shall be construed to follow such shore lines, and in the event of change in the shore line, shall be construed as moving with the actual shore line boundaries indicated as approximately following the centerline of streams, or other bodies of water shall be construed to follow such centerlines.
      6.   Boundaries indicated as parallel to or extensions of features indicated in subsection C1 through C3 above shall be so construed. Distances not specifically indicated on the Official Zoning Map shall be determined by dimensions shown on the Map, or in the absence of dimensions, by the scale of the Map.
      7.   Where a zoning district boundary line divides a lot in single ownership on the effective date of this Title, the regulations of this Title for either portion of such lot may, at the owner’s discretion, apply to the entire area of the lot or twenty five (25) feet beyond the zoning district boundary lines, whichever is the lesser distance.
      8.   All streets, alleys, public ways and railroad rights-of-way, if not otherwise specifically designated, shall be deemed to be in the same zone as the property immediately abutting upon such alleys, streets, public ways and railroad rights-of-way, unless otherwise specifically designated, shall be deemed to be the district boundary.
      9.   Streets or alleys which are shown on the Map and which have heretofore been vacated, or which are vacated hereafter, shall be in the same district as the land abutting both sides of the street or alley. If the land abutting each side of the street or alley was located in different districts before the street or alley was vacated, the centerline of the vacated street or alley shall be the district boundary.
      10.   Where physical or cultural features existing on the ground are at variance with those shown on the Official Zoning Map, or in other circumstances not covered by subsection C1 through C9 above, the Planning Commission's decision may be presented to the Village Board in the same matter as an amendment to the Zoning Ordinance as outlined in Chapter 12 of this Title.
   D.   Changes: If, by amendment to this Title, any change is made in any district boundary, is shall be shown on the Official Zoning Map. The date of the latest updating of the Official Zoning Map shall be shown on the face of the Map.
   E.   Availability: Zoning Maps, certified by the Village Clerk as showing the districts created, approved and as amended, shall be available for public reference and/or sale in the office of the Village Clerk.

10-4-3: ENTIRE AREA ZONED:

It is the intent that the entire area of zoning jurisdiction, including all land and water areas, streets, alleys, railroads and other rights-of- way, be included in the districts established by this Title. If any area is not shown on the Official Zoning Map as being included in any district, it shall be deemed to be in the R-1 Residential District.
Any additions to the Village, resulting from annexation, shall be zoned according to the annexation agreement. If the annexation agreement does not mention for which zoning district the property will be classified, the property shall automatically be classified in the E-1 Residential District.
