CHAPTER 8

A-1 AGRICULTURAL DISTRICT

10-8-1: PURPOSE:

   A.   The Zoning District A-1 is hereby established to further the use of lands optimally suited for agriculture use because of location, topography, soil characteristics, wetness, vegetation, or other natural or man-induced factors.
   B.   To provide lands for agricultural uses which are the optimum use due to topography, soils, natural characteristics, man-made features, and/or location and existing uses.
   C.   To provide the opportunity to keep horses or other large animals and the right to practice agriculture, floriculture, horticulture, silvaculture, cultivation of field or garden crops, and similar related activities.

10-8-2: POLICY:

To achieve the purpose of the A-1 Agriculture District, it shall be the policy of the Village to:
   A.   Foster uses where adequate police and fire protection are available.
   B.   Require a minimum, continuous area for the A-1 Agriculture District to be twenty (20) acres in area.
   C.   Require a minimum two and one-half (2½) acre lot for permitted compatible uses.
   D.   Zone as A-1 lands adaptable for sustained long-term agricultural uses because of location, topography, geology, soil types, other natural features of the land or surrounding land use.

10-8-3: USES PERMITTED:

No land shall be used or occupied, and no building, structure, or premises shall be erected, altered, enlarged, occupied, or used, except as otherwise provided in the Title for other than one or more of the following specified uses:
   A.   Agricultural Uses:
      1.   Gardening and general farming, either commercial or private.
      2.   Greenhouses.
      3.   Nurseries.
   B.   Two (2) farm homesteads for each twenty (20) acres of land area.
   C.   Public utility buildings and structures and essential services, as defined herein.

10-8-4: SPECIAL USES PERMITTED:

The following uses shall be permitted only if specifically authorized by the Board as allowed in Chapter 12 of this Title.
   A.   Similar and compatible uses to those allowed as "permitted uses" in this District.
   B.   Clubhouses, country clubs, private or public golf courses, tennis clubs, swimming pools, and similar recreational uses.
   C.   Cemeteries.
   D.   Horses, but not more than one per acre, and housed in a barn at least one hundred (100) feet from any property line. Horses may not be grazing in a required minimum front or side yard, and over-grazing is prohibited.
   E.   Riding academy or school, provided stables and horse care facilities are provided as approved by the Village.
   F.   Kennels.
   G.   Commercial (for profit) storage of recreation vehicles (rv's, including campers) and boats.

10-8-5: TEMPORARY USES PERMITTED:

Upon application to and issuance by the Zoning Official of a permit, the following uses may be operated as temporary uses:
   A.   Temporary building, trailer or yard for construction materials and/or equipment, both incidental and necessary to construction in the Zoning District. Each permit shall specify the location of the building or yard and the area of permitted operation. Each such permit shall be valid for a period of not more than six (6) calendar months and shall not be renewed for more than four (4) successive periods at the same location.

10-8-6: ACCESSORY USES PERMITTED:

Accessory uses, buildings or other structures and devices customarily incidental to and commonly associated with a permitted use or special use may be permitted, provided they are operated and maintained under the same ownership, on the same parcel, and do not include structures or features inconsistent with the permitted use or special use.
   A.   Garages, carports, or other parking spaces for the exclusive use of the residents or occupants of the premises.
   B.   Barns, stables, greenhouses, and other similar structures for the exclusive use of the occupants of the premises, which are incidental to the use of the property.
   C.   Home occupations.

10-8-7: PROHIBITED USES:

All uses not expressly authorized in Section 10-8-3 through 10-8-6, inclusive.

10-8-8: SITE AND STRUCTURE REQUIREMENTS:

   A.   Minimum Lot Area: A separate ground area of not less than twenty (20) acres shall be designated, provided, and continuously maintained for agricultural uses or land containing a permitted or special use. For each farm homestead, a two and one-half (2 1/2 ) acre lot is required, provided no more than two (2) farm homesteads may be permitted for any twenty (20) acre area of land.
   B.   Minimum Lot Frontage: A minimum lot frontage of two hundred (200) feet shall be provided for each parcel used for a permitted or special use.
   C.   Yards:
      1.   Front Yard: All structures shall be set back at least fifty (50) feet from the front lot line.
      2.   Side Yard: All principal structures shall be set back at least twenty (20) feet from the side lot line.
      3.   Rear Yard: All structures shall be set in from the rear lot line a distance of not less than forty (40) feet or greater if otherwise stated herein.
   D.   Maximum Height: No principal structure or portion thereof shall exceed a height of thirty five (35) feet, and no accessory structure shall exceed twenty (20) in height.
   E.   Floor Area Ratio: Not to exceed 0T3-30%.
   F.   Each single family detached dwelling, and any other structure occupied in whole or in part for residential purposes, shall contain at least one thousand seven hundred (1,700) square feet of livable floor area, exclusive of garages and any story below grade. All residential units shall be required to have an attached garage having space for storage of a minimum of two (2) passenger automobiles.

10-8-9: SPECIAL PROVISIONS:

   A.   Sign Requirements: In accordance with the applicable regulations set forth in Chapter 11 of this Title.
