ARTICLE XII

SPECIAL USE REGULATIONS

Sec. 12.250.- In general.

The Town Commission of the Town of Hillsboro Beach may, by special permit, and subject to such protective restrictions as are deemed necessary, authorize the location, extension or structural alteration of any of the following buildings or uses, or an increase in their height, in any district from which these are prohibited by this article.

(A)

Public requisites. Any public building erected or leased and used, and any publicly owned and used land by any department of a municipal, county, state or federal government.

(B)

Public schools.

(C)

Beach resources. The excavation, moving, transferring, extraction or addition from or to the beach of any sand, gravel, shells, top soil, rocks or other natural resources shall be in accordance with House Bill 634 which is identified as Chapter 70-231, General Laws of Florida and shall require a permit from both the Town of Hillsboro Beach and the Department of Natural Resources of the State of Florida.

Sec. 12-251. - Issuance of special permits.

Before issuance of any special permit for any of the above buildings or uses, the following conditions shall be complied with:

(A)

Public hearings. A public hearing in relation thereto shall be held before the Town Commission, notice and publication of which hearing shall conform to the procedure prescribed in Article XVIII, § 12-345 entitled Procedures, which outlines the necessary steps for hearings on changes and amendments; and

(B)

Report to Town Commission.

(1)

The Board of Zoning Appeals of the Town of Hillsboro Beach shall study and report to the Town Commission regarding the effect of the proposed building and/or use upon the character of the town and neighborhood, traffic conditions, public utility facilities and other matters pertaining to the public health, public safety or general welfare.

(2)

No action shall be taken upon any application for a proposed building or use above referred to until and unless the report of the Board of Zoning Appeals has been filed, but the report shall be made within 30 days after the date of the public hearing.
