SECTION 15

- Development plan review.

(A)

Development plan review is a review by the administrative officer, the technical review committee, or the planning board of the design or site plan for a permitted use. Its purpose is to encourage compliance with design and performance standards under specific and objective guidelines. Development plan review may be used to approve developments including, but not limited to:

1.

A change in use at the property where no extensive construction of improvements is sought.

2.

An adaptive reuse project located in a commercial zone where no extensive exterior construction of improvements is sought.

3.

An adaptive reuse project located in a residential zone that results in fewer than nine (9) residential units.

4.

Development in a designated urban or growth center.

5.

Institutional development design review for educational or hospital facilities.

6.

Development in a historic district.

7.

The installation of a Photovoltaic Solar Energy System (PSES) in compliance with section 5.5 of this ordinance.

(B)

An applicant for development plan review may request approval of a modification, a variance, or special use permit. A request for a modification shall be submitted to the zoning enforcement officer pursuant to section 13 of this ordinance. The planning board shall review an application for development plan review that requests a variance or a special-use permit under unified development review.
