ARTICLE XIII
Swimming Pools

§ 224-56 Title.
This article shall be known as the "Swimming Pool Law of the Village of Irvington."
§ 224-57 Definitions.
For purposes of this article, the following terms shall have the following meanings:
Any swimming pool partly or completely above ground level and having a capacity equal to or greater than 75 cubic feet.
A strong protective covering capable of supporting a minimum dead weight of 200 pounds when fastened or locked in place over a swimming pool.
Any man-made receptacle, structure, excavation or depression, including all appurtenant equipment, made for the purpose of retaining water to a depth at any point of more than 18 inches and which has a capacity equal to or greater than 75 cubic feet.

Any man-made receptacle, structure, excavation or depression with a capacity of less than 75 cubic feet and a maximum water depth of 18 inches.

§ 224-58 Permit required; fee.
It shall be unlawful to construct, erect, install, modify, alter, demolish or change any swimming pool in the Village or to permit any of the foregoing acts without first obtaining a building permit from the Building Inspector and then only as an accessory structure to a dwelling in a residential district for the private use of the owners or occupants of such dwelling and their families and guests.
No building permit shall be issued by the Building Inspector until there shall be first submitted to the Building Inspector plans and drawings for thee swimming pool to be covered by said permit. The Building Inspector shall be satisfied that all of the provisions of this article applicable to the proposed construction, erection, installation, modification, alteration, demolition or change of such swimming pool shall be complied with after a review and approval of the plans and drawings and a personal inspection of the premises in connection with which the building permit is to be issued.
All plans and drawings for the construction, erection, installation, modification, alteration, demolition or change of any swimming pool shall be required to show all lot lines of the property upon which the swimming pool is to be located and all vertical elevations with respect to the swimming pool and its appurtenances and shall include, in detail, additional information pertinent to the swimming pool, fence construction, water supply systems, drainage systems, water disposal systems and all appurtenances.
No swimming pool for which a building permit has been issued shall be used until the Building Inspector shall issue a pool maintenance permit. Issuance of a pool maintenance permit shall signify compliance with the provisions of this article.
The fee for a building permit which is required under this section shall be as set from time to time by the Board of Trustees, which fee will not be refundable and shall be paid upon a filing of an application for a building permit.[1]

§ 224-59 Location and size.
For lots in the Village with a width greater than 60 feet, the edge of all swimming pools shall be kept a distance of not less than 20 feet from all property lines, and no part of such pool shall be nearer to any street line than the rear wall of the main building which is located nearest to the street.
For lots in the Village with widths of 60 feet and less, all swimming pools shall be kept the distances from all property lines indicated in the table below, and such pools shall not exceed the maximum pool dimension, that is, length, width or diameter, as indicated in the table below, and no part of such swimming pool shall be nearer to any street line than the rear wall of the main building which is located nearest to the street.

§ 224-60 Safety measures and screening.

If a swimming pool is located nearer than 150 feet to any property line, the swimming pool shall be screened from the view of abutting properties by means of a solid fence or hedge. If a solid fence is used for screening, it shall not exceed 6 1/2 feet in height.
A fence or other barrier will be erected so as to completely enclose any swimming pool or the yard in which such pool is located. The fence or barrier shall not be less than five feet but in no case greater than 6 1/2 feet in height, and all entrances to the pool through such fence or other barrier shall have a self-closing and self-locking gate.
All swimming pool owners shall install a pool cover which must fully cover the pool when not in use and during the period of November 1 through March 31.
§ 224-61 Water disposal and drainage.
All swimming pools shall have a drainage system or systems adequate to dispose of the water therein without having the same drained upon adjoining property. No water shall be permitted to drain or run off onto an adjoining property or any street or road in the Village not equipped with a storm sewer.
§ 224-62 Health standards.
The requirements of the State and County Departments of Health shall be controlling.
§ 224-63 Lights and electrical wiring.
Lights used to illuminate any swimming pool shall be so arranged and shaded as to reflect light away from adjoining premises. Exposed electrical wires shall not be nearer than five feet to the edge of any swimming pool and not less than 10 feet above ground level at the edge of any such swimming pool. All electrical wiring shall conform to applicable Underwriters' Laboratories, Inc., or like standards.
§ 224-64 Wading pools.
Every outdoor wading pool shall be enclosed by a fence or barrier as provided for in § 224-60 of this article unless such outdoor wading pool is emptied when not in use or when unattended or is covered with a pool cover when not in use or when unattended.
