ARTICLE XVIII
Administration and Enforcement
§ 224-90 Building permits.

No building or structure and no road or site improvement shall be erected or altered without a building permit issued upon application to the Building Inspector issued in conformance with § 95-4 et seq. of the Code of the Village of Irvington.
§ 224-91 Certificates of occupancy.

A.
The following shall be unlawful until a certificate of occupancy shall have been applied for and issued by the Building Inspector in conformance with § 95-7 of the Code of the Village of Irvington:

No certificate of occupancy shall be issued for any use of a building or land allowed by special permit of the Planning Board as specified in § 224-100 of this chapter unless and until such special permit has been duly issued by said Board. Every certificate of occupancy for which a special permit has been issued or in connection with which a variance has been granted shall contain a detailed statement of such special permit or variance and of any conditions to which the same is subject.

If the proposed use is in conformity with the provisions of this chapter and of all other applicable laws and ordinances and if all conditions imposed upon the applicant or his or her predecessors in interest by the Planning Board have been satisfied, a certificate of occupancy for the use of vacant land or for a change of use of a nonconforming use shall be issued by the Building Inspector within 10 days after receipt of a written application therefor.
D.
The Planning Board may require that copies of any or all applications for certificates of occupancy be submitted to it prior to the issuance of such certificate. The time within which the Building Inspector shall act upon such applications shall be 40 days notwithstanding the provisions of Subsection C.
E.
Upon written request by the owner, and upon payment of a fee as set from time to time by the Board of Trustees,[1] the Building Inspector shall, after inspection, issue a certificate of occupancy for any building or use therefor or of land existing at the time of the adoption of this chapter or of any applicable amendment thereof, certifying such use, including the number of employees, and whether or not the same and the building conform to the provisions of this chapter.

A record of all certificates of occupancy shall be kept in the office of the Village Clerk, and copies shall be furnished on request to any agency of the Village or to any persons having a proprietary or tenancy interest in the building or land affected.

For the purposes of defraying administrative costs involved in the review of applications and appeals and costs of legal notices required by law, all applications shall be accompanied by a fee to cover all Village-related costs, payable to the Village of Irvington.

§ 224-95 Enforcement; penalties for offenses.

Enforcement of this chapter shall be as provided in Chapter 95, Building Construction, of the Code of the Village of Irvington.
