ARTICLE XXX

Historic Overlay District

§ 224-196 Purpose.

The purpose of the Historic Overlay District is to protect and enhance the historic and architectural character of the Village of Irvington, including the Irvington Historic District, which in January 2014 was listed on the National Register of Historic Places.

§ 224-197 Definitions.

For purposes of this article, the following words shall have the following meanings:
CONTRIBUTING BUILDING
A building included on the list in Appendix A[1] to the Zoning Code.
DEMOLISH
To pull down, raze, destroy, remove or relocate all or a substantial portion of a building.
SUBSTANTIAL PORTION
Any portion of an exterior wall, porch or portico facing a public way; or 50% or more of the footprint of a building as measured in plan; or 50% or more of the exterior walls of a building.

§ 224-198 Principal and accessory uses; area requirements.

A. 
Subject to the provisions of § 224-199 below, the use regulations for any lot or parcel in the Historic Overlay District shall be the same as otherwise permitted in the zoning district in which the lot or parcel is located.
B. 
Subject to the provisions of § 224-199 below, the bulk requirements (coverage, lot size, yards, height) for any lot or parcel in the Historic Overlay District shall be the same as otherwise required in the zoning district in which the lot or parcel is located.

§ 224-199 Approval by Board of Architectural Review.

A. 
In addition to any other requirements of the Zoning Code, no contributing building in the Historic Overlay District may be demolished without the approval of the Board of Architectural Review. This requirement shall not apply to interior demolitions that do not affect the exterior appearance of the building.
B. 
The requirements and procedures for such demolition approval, the criteria for approval, and the appeals process are set forth in Village Code § 9-11.
C. 
Approval of the Board of Architectural Review shall not be required in emergency situations governed by Village Code § 148-12E (Unsafe structures; Emergency situations).

§ 224-200 Penalties for offenses.

In addition to any other penalties for violations of this chapter, the owner of any contributing building who demolishes or permits the building to be demolished without approval of the Board of Architectural Review shall be required to restore the property and its site to its appearance prior to the demolition. Restoration would require site development plan approval, ARB approval, and any other approval and permit required by this chapter.
