CHAPTER 1264

SHORT-TERM RENTALS

§ 1264.01 COMPLIANCE REQUIRED.

   No person or entity shall operate a short-term rental or shall occupy or let to another for occupancy any short-term rental, except in compliance with the applicable provisions of this chapter.

§ 1264.02 PERMIT REQUIRED; DISPLAY; TERM.

   No person or entity shall operate a short-term rental unless that person or entity holds a valid short-term rental permit issued by the Zoning Inspector in the name of the owner of the real property upon which the short-term rental is to be operated. This permit shall be displayed in a conspicuous place within the short-term rental at all times. Each short-term rental permit shall expire at the end of one year following its date of issuance, unless it is suspended or revoked prior to the expiration of the one year pursuant to §§ 1264.08 and/or 1264.09, whichever is applicable.

§ 1264.03 PERMIT APPLICATION; ISSUANCE.

   The owner of the premises upon which the short-term rental is to be operated shall apply to the Zoning Inspector for such short-term rental permit, which shall be issued by the Zoning Inspector upon compliance by the owner with the applicable provisions of this chapter and any applicable provisions of the Zoning Code following an inspection by the Zoning Inspector wherein the Zoning Inspector has indicated the premises meets the requirements for a short-term rental and after a fire safety inspection has been performed which indicates that the premises meets all applicable fire safety requirements.

§ 1264.04 FEES.

   An application for a short-term rental permit pursuant to § 1264.03 shall be accompanied by a $100 nonrefundable fee for each property for which the owner is requesting a short-term rental permit.

§ 1264.05 PERMIT NONTRANSFERABLE; PROCEDURE FOR CHANGE OF CONTROL.

   A short-term rental permit is not transferable. When a person or entity who holds a short-term rental permit transfers their interest in or control of a short-term rental, the person or entity shall notify the Zoning Inspector in writing within 24 hours. The notice shall include the name and address of the person or entity succeeding to the ownership or control of the premises upon which the short-term rental permit had previously been issued.

§ 1264.06 PERMIT DENIAL; NOTICE.

   When the Zoning Inspector denies an application for a short-term rental permit, he/she shall notify the applicant in writing. A notice of denial shall include the date of denial, the time within which a request for a hearing may be made pursuant to §§ 1244.01 and 1264.07, and a brief statement of the facts upon which the denial was based.

§ 1264.07 HEARING ON DENIAL.

   Any person or entity whose application for a permit to operate a short-term rental has been denied may request and shall be granted a hearing before the Board of Zoning Appeals under the procedure provided by § 1244.01.

§ 1264.08 PERMIT SUSPENSION; NOTICE.

   Whenever upon inspection of any premises that has been granted a short-term rental permit the Zoning Inspector finds that conditions or practices exist which are in violation of any provision of this chapter and/or the Zoning Code, the Zoning Inspector shall give notice in writing to the operator of the short-term rental that unless such conditions or practices are corrected within a reasonable period of time to be determined by the Zoning Inspector, the operator's short-term rental permit will be suspended. At the end of such period the Zoning Inspector shall reinspect the short-term rental premises and if he/she finds that such conditions or practices have not been corrected, he/she shall give notice in writing that the short-term rental permit has been suspended.

§ 1264.09 SUSPENSION HEARING; PERMIT REVOCATION.

   Any person or entity whose permit to operate a short-term rental has been suspended, or who has received a written notice that their permit is to be suspended unless an existing violation is corrected, may request and shall be granted a hearing before the Board of Zoning Appeals under the procedure provided by § 1244.01. If no request for a hearing before the Board of Zoning Appeals is filed within ten days after the date the permit was suspended, the permit shall be automatically revoked. Upon receipt of notice of revocation, the operator shall immediately cease operation of the premises as a short-term rental.

§ 1264.10 BATHROOM FACILITIES.

   At least one flush water closet, lavatory basin, and bathtub or shower, properly connected to a water and sewer system approved by the Zoning Inspector and in good working condition, shall be provided for each ten persons or fraction thereof staying within a short-term rental, including members of the operator's family wherever they share the use of the facilities. All such facilities shall be so located within the furnished living space as to be reasonably accessible from a common hall or passageway to all persons sharing these facilities. Every lavatory basin and bathtub or shower shall be supplied with hot water at all times. No such facilities shall be located in a basement except by written approval of the Zoning Inspector.

§ 1264.11 LINEN CHANGE AND MAINTENANCE.

   The operator of every short-term rental shall change supplied bed linen and towels therein at least once each week, and prior to the letting of any room to any occupant. The operator shall be responsible for the maintenance of all supplied bedding in a clean and sanitary manner.

§ 1264.12 SLEEPING ROOM AREA REQUIREMENTS.

   Every room occupied for sleeping purposes by one person shall contain at least 70 square feet of floor space, and every room occupied for sleeping purposes by more than one person shall contain at least 50 square feet for each additional occupant.

§ 1264.13 EGRESS REQUIREMENTS.

   Every rooming unit shall have at least one safe, unobstructed means of egress leading to safe, open space at ground level and to a public street or alley without having to pass through any other rooming unit.

§ 1264.14 SANITARY MAINTENANCE REQUIRED.

   The operator of every short-term rental shall be responsible for the sanitary maintenance of all walls, floors and ceilings and for the maintenance of a sanitary condition in every other part of the short-term rental and of the premises of the short-term rental.

§ 1264.15 PENALTY.

   Whoever violates any provision of Chapter 1264 shall receive a mandatory fine of $150 for a first offense, and if the violation is a second offense or more, then the mandatory fine shall be $500 for each offense.
