CHAPTER 1242

DISTRICTS AND BOUNDARIES GENERALLY

§ 1242.01 CREATION OF DISTRICTS.

   The village is hereby divided into ten types of districts, as follows:
   (a)   R-1 - Single-Family Residential
   (b)   R-2 - Low-Density Residential
   (c)   R-3 - Multifamily - Residential
   (d)   B-1 - Business or Commercial
   (e)   B-2 - Business or Commercial
   (f)   LI - Light Industrial
   (g)   I - Industrial
   (h)   OTB – Old Town Business/Commercial
   (i)   P – Public Parks
   (j)   HP – Historic Preservation

§ 1242.02 DISTRICT MAP; VACATED AND ANNEXED PROPERTY.

   (a)   The boundaries of the districts are shown upon and made a part of the map designated as the District Map. The District Map and all notations, references and other information shown thereon are a part of this Zoning Code and have the same force and effect as if the District Map and all the notations, references and other information shown thereon were fully set forth or described herein. The original Map, properly attested to be current, is on file with the Zoning Inspector of the Village.

   (b)   Whenever any street, alley or other public way is vacated by official action of Council, the zoning district adjoining each side of such street, alley or other public way shall be automatically extended to the center of such vacation, and all the area included in the vacation shall then be subject to all appropriate regulations of the extended districts.
   (c)   Territory annexed to the village after the effective date of this Zoning Code (Ordinance 1301, passed July 6, 1976) shall continue to be governed by the zoning regulations which governed the territory immediately prior to the annexation, as enacted by a board of county commissioners under R.C. §§ 303.01 to 303.25 or enacted by a board of township trustees under R.C. §§ 519.02 to 519.25, as the case may be.
   (d)   As soon as practical after the annexation of territory to the village, proceedings shall be instituted by the Planning Commission to include the annexed territory in one or more of the zoning districts defined in this Zoning Code.

§ 1242.03 BOUNDARIES.

   Where uncertainty exists with respect to the boundaries of the various districts, as shown on the District Map accompanying and made a part of this Zoning Code, the following rules apply:
   (a)   The district boundaries are either streets or alley, unless otherwise shown, and where the districts designated on the District Map are bounded approximately by street or alley lines, the street or alley shall be construed to be the boundary of the district.
   (b)   Where the district boundaries are not otherwise indicated and where the property has been or may hereafter be divided into blocks and lots, the district boundaries shall be construed to be the lot lines, and where the districts designated on the District Map are bounded approximately by lot lines, the lot lines shall be construed to be the boundary of the districts, unless the boundaries are otherwise indicated on the Map.
   (c)   In unsubdivided property, the district boundary lines on the District Map shall be determined by use of the scale appearing on the Map.

§ 1242.04 GENERAL DISTRICT REGULATIONS.

   Except as hereinafter provided:
   (a)   No building shall be erected, converted, enlarged, reconstructed or structurally altered, nor shall any building or land be used, except for a purpose permitted in the district in which the building or land is located.
   (b)   No building shall be erected, converted, enlarged, reconstructed or structurally altered, except in conformity with the area regulations of the district in which the building is located.

   (c)   The density and yard regulations of this Zoning Code are for any building hereafter erected or structurally altered. No land required for a yard or other open space about an existing building or any building hereafter erected or structurally altered shall be considered a yard or lot area for more than one building.

   (d)   Every building hereafter erected or structurally altered shall be located on a lot and in no case shall there be more than one main building on a lot, except as otherwise provided in this Zoning Code.
   (e)   No building shall be erected or structurally altered to the extent specifically provided hereinafter, except in conformity with the off-street parking and loading regulations of this Zoning Code.
   (f)   Cooperatives, condominiums and all other forms of property ownership do not affect the provisions of this Zoning Code and all requirements shall be observed as though the property were under single ownership.
   (g)   The storage of uninhabited travel trailers shall be permitted in any zoning district, provided such storage is behind the established building line of the property on which the travel trailer is stored.

   (h)   All new construction in B-1, B-2, and OTB districts will include installation of new sidewalks along the front yard line, one foot inside the right-of-way. All new construction in R-1, R-2, and R-3 districts, which is not subject to past or current subdivision regulations, located along platted but unopened streets in the village, will include installation of new sidewalks along the front yard line, one foot inside the right-of-way. All new construction in R-1, R-2, and R-3 districts, which is not subject to past or current subdivision regulations, located on the side of an opened street within the village that currently has existing sidewalks, will include installation of new sidewalks along the front yard line, in alignment with the existing sidewalks on said street. New sidewalks will be constructed in accordance with provisions set forth:
      A.   Sidewalk thickness shall be not less than four inches in R-1, R-2, and R-3 Districts and not less than six inches in B-1 or B-2 Districts.
      B.   All driveway block thickness shall not be less than six inches in any district.
      C.   Concrete mix used in all sidewalk construction shall be a six sack mix.
      D.   Walk edges and crack control cuts shall be tooled. Crack control cuts should be spaced at intervals not to exceed five feet.
      E.   The sidewalk surface should have a standard slope (one inch from inside of the walk toward the street.
      F.   All sidewalk construction shall be a minimum of 48 inches wide with ten gauge wire mesh.
      G.   Finished concrete sidewalks will be coated with a water-resistant sealer.
   (i)   No zoning permits may be issued in R-3, B-1, B-2, OTB, L-I and I Districts without first adhering to the site plan review procedures and standards set forth in Chapter 1256.
