CHAPTER 1252

DENSITY REGULATIONS

§ 1252.01 MINIMUM LOT AREA AND WIDTH.

   (a)   The following minimum lot area and width, measured at the building line, must be provided in the districts indicated.

   (b)   City water and sewers must be provided in all cases where these services are available.
   (c)   All lots of record before November 2004 with septic tanks shall have a minimum frontage of 200 feet and a minimum depth of 200 feet, which is to say a minimum area of 40,000 square feet.
   (d)   All lots of record created after November 2004 with septic systems shall have minimum frontage of 200 feet and total a minimum area of two acres, which is to say 87,120 square feet.

§ 1252.02 EXCEPTIONS.

   A lot shall comply with the lot area and width requirements established in § 1252.01 except as set forth below:
   (a)   Where a lot of record at the time of the effective date of this Zoning Code (Ordinance 1301, passed July 6, 1976) has less area or width than is required in the district in which it is located, and the owner of such lot does not own any other parcel or tract adjacent thereto, such lot may be used for a one-family dwelling or for any nondwelling use permitted in the district in which it is located.
   (b)   Existing buildings that are in violation of lot area requirements may be remodeled or repaired, but not reconstructed or structurally altered, unless made to conform to such requirements.
   (c)   Lot area per family requirements shall not apply to dormitories, fraternities, sororities, nursing homes or other similar group quarters where no cooking facilities are provided in individual rooms or apartments.
   (d)   Four lots with Permanent Parcel Number 26-034-00-007-00, having a frontage of 50 feet along West Satin Street and area of .396 acres; Permanent Parcel Number 26-034-00-008-00, having a frontage of 34 feet along West Satin Street and area of .13 acres; Permanent Parcel Number 26-034-00-026-00, having a frontage of 14.8 feet along West Satin Street, a frontage of 73.97 feet along West Jefferson Street, and an area of 1.14 acres; and Permanent Parcel Number 26-034-00-025-02, having a frontage of 52.00 feet along West Jefferson Street and an area of .33 acres are hereby authorized to be combined and split into four new lots. One lot will have frontage of 50 feet on West Satin Street by .189 acres, a second lot will have frontage of 48.06 feet on West Satin Street by 1.057 acres, a third lot will have frontage of 63.97 feet on West Jefferson Street by .367 acres, and the fourth lot will have frontage of 62.00 feet by .387 acres.
