CHAPTER 180

OFF-STREET PARKING, LOADING AND CIRCULATION

180.01 SINGLE-UNIT TO TOWNHOUSE RESIDENTIAL DRIVEWAY DESIGN

The provisions of this Section apply to driveways for single-unit, two-unit, three or four unit, or townhouse dwellings on private property.

  1. 3.
    Space for parking of vehicles shall be provided in accordance with Table 180.1.
  2. 4.
    At the discretion of the Zoning Administrator, an administrative waiver of up to five (5) percent of minimum parking requirements can be approved in response to unique site or use specific characteristics.
  3. 5.
    Driveways and any associated off-street parking areas shall not be located closer than one (1) foot from an adjoining residential lot line, unless such driveway is used jointly by adjoining residential lot owners.
  4. 6.
    Driveway approaches shall not be wider than 24 feet at the curb.
  5. 7.
    Paved driveways and any associated off-street parking areas within the front yard of a single-unit, two-unit, or three- or four- unit shall:
    1. A.
      Occupy no more than 50 percent of the area between the building setback line and public right-of-way.
    2. B.
      Provide a maximum of one (1) parking space in addition to that provided in the traveled portion of the driveway.
    3. C.
      Be graded and drained to dispose of surface water to pervious areas on the lot, to the street, or public designated storm water drainage facilities.
  6. 8.
    Off-street parking areas for townhouse dwellings shall follow the requirements of Section 181.07 Parking Lot Design.
  7. 9.
    Driveways and any associated off-street parking areas shall be surfaced with asphaltic concrete, portland cement concrete, pavers, permeable pavement, or similar material with minimum thickness of five (5) inches. Material utilized in the subgrade shall be well drained and not susceptible to frost boils.

180.02 PARKING SPACES REQUIRED

  • 1.
    Space for parking of vehicles shall be provided in accordance with Table 180.1. The uses have been grouped into the categories of residential; public, social, healthcare; commercial; industrial; agricultural; entertainment or recreation; and transportation or utilities. The categories in Table 180.1 correspond with the headings in the use tables in Chapters 168, 169, 170, and 171.
  • 2.
    Accessible parking facilities for persons with disabilities must be provided in accordance with all applicable state regulations, and as required by the Zoning Administrator. Accessible parking spaces and loading zones shall be identified by a sign and pavement markings indicating parking for the disabled only.

    1. 3.
      For multiple use buildings and/or sites which are not multi-tenant retail shopping centers, parking spaces shall be provided in accordance with the parking requirements of each use.
    2. 4.

      Within MU districts the City Council may waive required off-street parking spaces in favor of delineated on-street parking. On-street parking spaces may replace off-street parking spaces at a 1:1 ratio. Only spaces located immediately in front of the property may be counted.
    4. 6.
      Shared Parking

      Two (2) or more uses may provide required off-street parking spaces in a common parking facility less than the sum of the spaces required for each use individually, provided such uses are not operated during the same hours. The following conditions must be met for any shared parking use:

      1. A.
        The proposed shared parking space is within 500 feet of the use(s) it will serve.
      2. B.
        The applicant will show that there is no substantial conflict in the principal operating hours of the two (2) uses or buildings for which shared use of off-street parking facilities is proposed.
      3. C.
        The applicant may provide a reduced number of parking spaces as determined by the shared parking factor graphic below. For example, a development including residential and office uses may require 15 spaces for the residential use and 25 spaces for the office use for a total of 40 spaces. Dividing 40 by the shared parking factor reduces the total required spaces to 29.

      1. D.
        A properly drawn legal instrument approved by the City Council, executed by the parties concerned, for shared use of off-street parking facilities shall be filed with the City Clerk. Said instrument may be a three (3) party agreement, including the City and all private parties involved. Such instrument shall first be approved by the City Attorney.
    1. 7.
      Off-street parking shall be on the same lot as the principal use except when an off-lot parking has been approved by the City Council. In cases where off-street parking facilities are permitted on land other than the same lot as the principal use, such facilities shall be in the same possession as the lot occupied by the use to which the parking facilities are necessary or a written agreement/easement between property owners is recorded with Polk County.
    2. 8.
      Change of Use.
      1. A.
        Any lot with a change of use upon its premise shall provide an adequate number of parking spaces required by the new use in accordance with the standards set forth within this Chapter.
      2. B.
        For buildings which are designed to accommodate a use permitted in the zoning district which can create a greater demand for parking than the initial use of the property, additional parking spaces may be required by the Zoning Administrator to accommodate additional parking if a change of use occurs.
    3. 9.
      Uses Not Listed Herein.
      1. A.
        When the parking requirement of a building or use is not specifically mentioned herein, the parking space requirements for a use which is listed in Table 180.1 and to which said use is similar, shall apply as determined by the Zoning Administrator.
      2. B.
        If no similar use is listed, the Zoning Administrator shall determine the parking space requirements based upon other available references or qualified sources of information to adequately determine parking demand.

    180.03 LOADING SPACES REQUIRED

  • 1.
    At least one (1) off-street loading space shall be provided on the same lot as any non-residential building or alteration exceeding 10,000 square feet which requires the receipt or distribution of material or merchandise by vehicle.
  • 2.
    For multiple tenant commercial centers, one (1) additional loading space shall be provided for each 20,000 square feet or major fraction thereof of gross floor area in excess of 10,000 square feet, provided the total number of loading spaces is not required to be more than the total number of occupying tenants.
  • 3.
    Each loading space shall be at least:
    1. A.
      10 feet in width and 20 feet in length for loading spaces not requiring loading dock access.
    2. B.
      12 feet in width and 50 feet in length for loading dock access for trucks.
  • 4.
    A loading area may occupy part of a required yard provided the loading area and access roadways are at least five (5) feet from any lot line. A loading area may not be located in an open space required by CHAPTER 181 Landscaping and Open Space or a buffer required by CHAPTER 182 Buffering and Screening Standards.
  • 5.
    Off-street loading areas shall be designed to meet the access and surfacing requirements as identified in this Chapter.

    180.04 ELECTRIC VEHICLE CHARGING STATION (EVCS) REQUIREMENTS

  • 1.
    Level 1, 2, and 3 electric vehicle charging stations (EVCS) are allowed in all zoning districts.
  • 2.
    In order to proactively accommodate the anticipated future growth in market demand for electric vehicles, all new parking lots and parking lots expanded by 25 or more stalls for uses shown in Table 180.2 shall:
    1. A.
      Provide the electrical capacity necessary to accommodate the future hardwire installation of Level 2 EVCSs for the minimum percentage of spaces as shown.

        The City Council may waive all or a portion of the requirement if utilities are not reasonably available to the new or expanded parking area or if there is not a facility to house the required electrical components.
      2. C.
        This shall include conduit being installed throughout the parking area and subpanels sized appropriately to accommodate needed breakers.
    1. 3.
      In addition to the requirement to provide for future EVCS, all new parking lots or parking lot expansions with 100 or more spaces shall provide at least one Level 2 EVCSs.
    2. 4.
      No EVCS or infrastructure shall be placed within the public right-of-way unless explicitly approved by the Public Works Director.
    3. 5.
      Parking lots shall be designed so that EVCS are not located along public streets.
    4. 6.
      Parking spaces with designated EVCS may be counted toward satisfying minimum off-street parking space requirements.
    5. 7.
      EVCS shall be designed to meet the following requirements:
      1. A.
        Battery charging outlets and connector devices shall be mounted to comply with state code and must comply with all applicable Americans with Disabilities (ADA) requirements.
      2. B.
        Equipment shall be protected by wheel stops or bollards.
      3. C.
        Each EVCS shall be posted with signage indicating the space is only for electric vehicle charging purposes.
      4. D.
        Site lighting to illuminate the EVCS shall meet the standards of CHAPTER 186 EXTERIOR LIGHTING.

    180.05 BICYCLE PARKING REQUIREMENTS

  • 1.
    Bicycle parking shall be provided as follows:
    1. A.
      All dwellings with 3 units or larger in R-2, R-3 and R-4 districts.
    2. B.
      All uses in MU, C, E, and I districts.  
  • 2.
    Each new development shall provide one (1) or more bicycle racks, bicycle lock boxes, and/or indoor bicycle storage areas to provide space for at least two (2) bicycles.
  • 3.
    Exterior bicycle parking facilities must:
    1. A.
      Be located close to the front entrance if intended to serve short-term guest bicycle parking.
    2. B.
      Be installed on asphalt, concrete, pavers, or similar materials.
    3. C.
      Be either inverted U or post and ring design.
    4. D.
      Lighting meeting the requirements of CHAPTER 186 EXTERIOR LIGHTING shall be installed to illuminate the bicycle parking facilities.
    5. E.
      Meet minimum setbacks and separation as shown in Figure 180.2.

    180.06 PARKING AND LOADING ACCESS

  • 1.
    The proposed development shall have such entrances and exits upon public streets properly spaced and designed as are necessary for safety and the general welfare and shall have such interior drives as are necessary for free movement of emergency vehicles; and shall have such pedestrian walkways as are necessary for safety and general the welfare.
  • 2.
    The permitted number of ingress/egress driveway approaches to public streets for an off-street parking lot or loading area shall be dependent upon the projected future average daily traffic (ADT) for the public street.
  • 3.
    The location of ingress/egress driveway approaches shall:
    1. A.
      Be located to limit vehicular conflicts.
    2. B.
      Preserve proper traffic safety and, as possible, not impair movement of vehicular traffic on public streets.
    3. C.
      Where possible, be located in alignment with driveway approaches gaining access to the same public street from property on the opposite side of the street.
  • 4.
    The following access guidelines shall be observed in all districts. All distances are to be measured from edge to edge of entrance or edge of street paving. Intersection is defined as a public street intersecting with another public or private street. Entrance is defined as any private driveway intersecting with a public street.
    1. A.
      For a functional street classification of major and minor arterials and major collectors in commercial/retail areas, the same classification as the main road (higher classification) will be used to determine the spacing requirements of the first entrance and/or intersection on cross street.

        In areas where existing lots and driveway entrances do not currently satisfy the guidelines presented, other protective measures, such as joint entrances shall be utilized.

      The backing or backward movement of vehicles from a driveway, off-street parking, or loading area onto an arterial or major collector street designated in the Comprehensive Plan shall be strictly prohibited for all uses.
    2. 6.
      Off-street parking or loading facilities shall be designed so as to permit entrance and exit by forward movement of the vehicle for all uses, except single-unit, two-unit, three or four unit, or townhouse dwellings shall be permitted backward movement from a driveway.
    3. 7.
      Driveway approach returns shall not extend beyond the side lot line as extended, unless such driveway is of joint usage by the adjoining lots.

          A five (5) foot wide clear zone shall be maintained and the pedestrian path shall be protected by curb or wheel stops.

          The minimum stall depth for a parking space may be reduced equal to the amount of overhang, up to two (2) feet.
    1. 9.
      Setback Requirements
      1. A.
        Parking on driveways shall not be permitted within the public street right-of-way or across sidewalks or trails.
      2. B.
        No part of any parking space shall be:
        1. 1.
          Closer than five (5) feet to any established public street right-of-way or public street easement, except that in the MU districts no part of any parking space shall be located closer than 15 feet to any established public street right-of-way or public street easement.
        2. 2.
          Closer than five (5) feet to an established alley line or to an adjoining lot line, unless the parking space adjoining a lot line is part of a common parking lot of joint usage between adjoining lots or within the driveway of a single family residence.
      3. C.
        Greater setbacks for off-street parking lots from public street right-of-ways may be required by the City for parking lots fronting planned major arterial streets and collector streets which do not meet the minimum requirements for right-of-way width as set forth in the Comprehensive Plan and Section 196.04 STREET DESIGN of this Code.
    2. 10.
      Driveway approaches shall not be wider than 37 feet at the curb for multi-family, nonresidential uses, and multiple building complexes.
    3. 11.
      Fire lanes shall be provided and marked as is required by the fire code.
    4. 12.
      All off-street parking areas and associated driveways, access roadways and frontage roads shall be:
      1. A.
        Graded and drained so as to dispose of all surface water accumulation within the area.
      2. B.
        Constructed with permanent, integrally attached 6-inch high curbing or curbing of alternate height acceptable to the City (prefabricated portable curb stops shall not be considered an acceptable alternate). This requirement may be waived or altered by the City Council if it is determined that surface drainage can be adequately handled by other means.
    5. 13.
      Surfacing Requirements

      All off-street parking and loading areas and access roadways shall have a durable and dustless surface paved with asphaltic concrete, portland cement concrete, pavers, or permeable pavement in accordance with the specifications as herein set forth.

      1. A.
        The part of the parking area utilized for driveways, access roadways, and frontage roads shall be specifically designed to accommodate the type and load bearing capacity of traffic anticipated.
      2. B.
        Material utilized in the subgrade shall be well drained and not susceptible to frost boils.

    180.08 INTERNAL WALKWAYS

  • 1.
    A continuous internal pedestrian walkway shall be provided from any perimeter public sidewalk to the each of the following connections. More than one (1) walkway may be needed based upon specific site conditions:
    1. A.
      Entrances to each building on the site
    2. B.
      Public sidewalks, walkways, paths, or trails on adjacent properties that extend to the boundaries shared with the subject development;
    3. C.
      Public sidewalks along the perimeter streets adjacent to the development;
    4. D.
      Adjacent public park, trail or other public or civic use; and
    5. E.
      Adjacent public transit station areas, transit stops, park and ride facilities, or other transit facilities.
    6. F.
      Bicycle paths and lanes required by this Code shall be provided and designed in accordance with the City’s currently adopted standards and specifications.
  • 2.
    Bicycle and pedestrian facilities located within private communities shall be maintained by the private community through a homeowner’s association or other method as approved by the City.

    180.09 OFF-STREET PARKING OF VEHICLE EQUIPPED FOR STREET AND HIGHWAY TRAVEL

  • 1.
    Automobiles, vans, trucks, trailers, tractors, construction equipment, and any other mobile vehicles except as identified in subsection 2 below shall:
    1. A.
      Be equipped and licensed for street and highway travel.
    2. B.
      Be parked on a durable and dustless off-street parking area paved with asphaltic concrete, portland cement concrete, pavers, or permeable pavement as required herein.
    3. C.
      Not be parked or stored within the landscaped open space area of the front yard between the building and public street right-of-way.
  • 2.
    In the RE, R-1, and R-2 districts, a recreational vehicle, camper, boat or trailer:
    1. A.
      May be stored on an unpaved area within the rear or side yard.
    2. B.
      May be parked in the front yard as long as the provisions of Subsection 180.09.1 above are met.

    180.10 WAIVER OF REQUIREMENTS

  • 1.
    The City Council reserves the right to waive or modify to a lesser requirement any provision or requirement of off-street parking and loading areas contained in this Chapter, provided:
    1. A.
      A report on such change is received from the Planning and Zoning Commission; and
    2. B.
      Said waiver or modification does not adversely affect the intent of these regulations to adequately safeguard the general public and surrounding property.
  • 2.
    Exceptions will only be considered for those uses where special circumstances warrant a change and whereby the modification or waiver is determined to be in the best interest of the general public.

    The City Council may waive the construction of all the parking spaces required in this Chapter, provided that the property owner can demonstrate that all the parking can be provided, if the Council determines that such parking should need to be constructed in the future. This can be accomplished through the Site Plan Review procedures in CHAPTER 190 LAND USE PROCEDURES.
