CHAPTER 12

ADMINISTRATION; PERMITS AND CERTIFICATES

9-12-1: ADMINISTRATIVE OFFICIAL; AUTHORITY:

An administrative official 1 designated by the City Manager shall administer and enforce this Title. He may be provided with the assistance of such other persons as the City Manager may direct. If the administrative official shall find that any of the provisions of this Title are being violated, he shall notify in writing the person responsible for such violations, indicating the nature of the violation and ordering the action necessary to correct it. He shall order discontinuance of illegal use of land, buildings or structures; removal of illegal buildings or structures or of additions, alterations or structural changes thereto; discontinuance of any illegal work being done; or shall take any other action authorized by this Title to ensure compliance with or to prevent violation of its provisions. 9-12-2: BUILDING PERMITS REQUIRED:

No building or other structure shall be erected, moved, added to or structurally altered without a permit therefor, issued by the administrative official. No building permit shall be issued except in conformity with the provisions of this Title and the subdivision regulations, except as may be approved by the Board of Adjustment. (1983 Code § 11-1-27B)

9-12-3: APPLICATION FOR BUILDING PERMIT:

All applications for building permits shall be accompanied by site plans as detailed elsewhere in this Title. Site plans for single- and two-family dwellings shall be submitted in conformance to administrative requirements. In addition to the site plan, if the building permit is for construction of new principal buildings, then the application shall also be accompanied by a certified survey of the lot verifying, establishing and marking the lot corners on which the structure will be constructed. As an alternate procedure to obtaining a certified survey of the lot, a property owner may outline the lot lines by locating the property pins on said property and then attach a string to each property pin. In addition, the owner and/or contractor would also be required to show the property lines on the building permit application. (Ord. 99-01, 1-4-1999)

9-12-4: CERTIFICATES OF ZONING COMPLIANCE:

   A.   Certificate Required: It shall be unlawful to use or occupy or permit the use or occupancy of any building or premises, or both, or part thereof hereafter created, erected, changed or converted or wholly or partly altered or enlarged in its use or structure until a certificate of zoning compliance shall have been issued therefor by the administrative official stating that the proposed use of the building or land conforms to the requirements of this Title.
   B.   Nonconforming Use Or Structure: No nonconforming structure or use shall be maintained, renewed, changed or extended until a certificate of zoning compliance shall have been issued by the administrative official. The certificate of zoning compliance shall state specifically the nonconforming uses or structures shall have one year to apply for certificates of zoning compliance. Failure to make such application within one year shall be presumptive evidence that the property was in conforming use at the time of enactment of amendment of this Title. (1983 Code § 11-1-27D)

9-12-5: APPLICATION FOR CERTIFICATE; CONDITIONS FOR ISSUANCE:

   A.   Application: Certificates of zoning compliance shall be applied for coincidentally with the application for a building permit, and shall be issued within ten (10) days after the lawful erection or alteration of the building is completed in conformity with the provisions of this Title.
   B.   Issuance: A temporary certificate of zoning compliance may be issued by the administrative official for a period not exceeding six (6) months during alterations or partial occupancy of the building pending its completion; provided, that such temporary certificate may require such conditions and safeguards as will protect the safety of the occupants and the public.
   C.   Records: The administrative official shall maintain a record of all certificates of zoning compliance, and copies shall be furnished upon request to any person.
   D.   Failure To Obtain: Failure to obtain a certificate of zoning compliance shall be a violation of this Title and punishable under this Chapter.
   E.   Sidewalk Required: No certificate of zoning compliance shall be issued for the construction of any building or structure in the City, unless a sidewalk has been constructed as provided for in the building permit for said building or structure. (1983 Code § 11-1-27E)

9-12-6: EXPIRATION OF BUILDING PERMIT:

   A.   Notice Of Cancellation: If the work described in any building permit has not begun within ninety (90) days from the date of issuance thereof, said permit shall expire; it shall be cancelled by the administrative official, and written notice thereof, shall be given to the persons affected.
   B.   Expiration Of Permit: If the work described in any building permit has not been substantially completed within two (2) years of the date of issuance thereof, said permit shall expire and be cancelled by the administrative official, and written notice thereof shall be given to the persons affected, together with notice that further work as described in the cancelled permit shall not proceed unless and until a new building permit has been obtained. 9-12-7: AUTHORIZED CONSTRUCTION AND USE:

Building permits or certificates of zoning compliance shall be issued on the basis of plans and applications, approved by the administrative official authorizing only the use, arrangement and construction set forth in such approved plans and specifications, and no other use, arrangements or construction. Use, arrangement or construction at variance with that authorized shall be deemed violation of this Title, and punishable as provided by Section 9-14-4 of this Title. (1983 Code § 11-1-27G)

9-12-8: TERMINATION OF WORK:

If work described in any building permit is terminated for more than six (6) months and a concerted effort is not exhibited to complete the described work the owner shall return the site building to the condition prior to issuance of a building permit. Failure of the owner to comply with the preceding shall be grounds for the City or its designates to bring the site or building into compliance with this Chapter. (1983 Code § 11-1-27H)
