CHAPTER 9

OFF-STREET PARKING AND LOADING

9-9-1: OFF-STREET LOADING SPACES REQUIRED:

In any C or M District, in connection with every building or part thereof hereafter erected having a gross floor area of ten thousand (10,000) square feet or more, which is to be occupied by manufacturing, storage, warehouse, goods, display, retail store, wholesale store, market, hotel, hospital, mortuary, laundry, dry cleaning or other uses similarly requiring the receipt by vehicles of material or merchandise, there shall be provided and maintained on the same lot with such building, at least one off-street loading space plus one additional such loading space for each twenty thousand (20,000) square feet, or major fraction thereof, of gross floor area so used in excess of ten thousand (10,000) square feet.
   A.   Each loading space shall be not less than twelve feet (12') in width, forty feet (40') in length.
   B.   Such space may occupy all or any part of any required yard or court space except as otherwise restricted by this Chapter. (1983 Code § 11-1-22A)

9-9-2: OFF-STREET PARKING AREA REQUIRED:

In all districts, in connection with every industrial, commercial, business, trades, institutional, recreational or dwelling use, and similar uses, space for parking and storage of vehicles shall be provided in accordance with the following schedule:
   A.   Residential Land Uses:
 
Bed and breakfast inns
2 spaces for dwelling and one space for each room used for guests.
Apartment dwellings
2 parking spaces per dwelling unit. 11/2 parking spaces per dwelling unit if developed as an elderly housing project. Herein an elderly housing project is for those residents over 55 years of age.
Mobile and modular homes
2 parking spaces per dwelling unit.
Boarding houses
2 parking spaces per dwelling unit.
Detached dwellings
2 parking spaces.
Duplex and attached dwellings
2 parking spaces per dwelling unit.
 
   B.   Commercial And Institutional Land Uses:
Adult entertainment
1 space per 150 square feet per gross floor area.
Auto and truck sales and rental
1 space per 500 square feet of gross floor area.
Auto parts store
31/3 spaces per 1,000 square feet per gross floor area.
Auto repair garages
31/3 spaces per 1,000 square feet of gross floor area.
Banks, savings and loans and
other lending institutions
4 spaces per 1,000 square feet of gross floor area.
Bowling alleys
5 spaces per alley.
Car washes, except self-service
Reservoir (lineup) parking equal to 5 times the capacity of the car wash.
Car washes, self-service
Lineup area equal to accommodate 4 cars per work stall.
Childcare centers, day nurseries
2 spaces plus 1 for every employee on maximum shift; a paved unobstructed pick-up space with adequate stocking for daily pickup of children.
Churches and other places of worship
1 space per 4 seats in the sanctuary.
Clubs and lodges
1 space per each 4 seats.
Farm and home business
31/3 spaces per 1,000 square feet of gross floor area.
Funeral homes
1 spaces per 5 seats.
Furniture stores, major
appliances, floor covering stores
1 space per 500 square feet of gross floor area.
Gas station (service station)
1 space per employee on maximum shift plus 1 space; plus 31/3 spaces per 1,000 square feet of gross area of space used in auto repair; plus 1 space for each vehicle used in the business.
Grocery stores and super
market stores, department
stores under 5,000 square feet
6 spaces per 1,000 square feet of gross floor area.

4 spaces per 1,000 square feet of gross floor area.
Restaurant fast food
1 space for every 2 seats plus 2 spaces for every 3 employees on largest shift.
Restaurants, taverns, and night-
clubs for on-site consumption
1 space for every 3 seats plus 2 spaces for every 3 employees on largest shift. (1983 Code § 11-1-22B)
Retail stores, shops, etc.,

31/3 spaces per 1,000 square feet of gross floor area.

2 spaces for each 3 employees on the largest shift.
Printing and publishing plants

2 spaces for every 3 employees on largest shift, plus 1 space for each vehicle used in operation of the business, stored on site.
Truck or other terminals
2 spaces for every 3 employees on largest shift, plus 1 space for each vehicle used in operation of the business, stored on site.
Veterinary clinics and hospitals
4 spaces for every doctor, plus 1 space for every employee.
Wholesale establishment and
warehouse including mini warehouses
1 space for each 2 employees on the largest shift plus 1 space for each 2,500 square feet of gross floor area.
 
   D.   Other Land Uses:
 
Camping
1 dust-free space (10 x 30) for every camp site.
Community centers, gymna-
siums, pools, etc.
3 spaces per 1,000 square feet of gross floor area.
Golf courses
50 spaces per 9 holes.
Golf driving range
2 spaces per every tee.
Hand ball/regular ball courts
3 spaces per court.
Parks, playgrounds, picnic grounds
Space equivalent to 1% of the total area, parking spaces along drives may be counted.
Tennis courts
3 spaces per court.
 
E.   Exceptions to Parking Area Requirements in the C-3 and C-4 Districts:
 
On-Site Parking Relaxations Involving Existing Buildings
The parking requirement may be reduced or waved entirely by the Zoning Administrator for proposed changes of use in existing buildings where, in the Zoning Administrator’s opinion, the proposed change of use will be beneficial to the vitality of the Central Business District and surrounding environs. In doing so, the Zoning Administrator may take into consideration the ability of the site to accommodate parking, as well as the availability of on-street parking and other public parking areas in the general vicinity.
On-Site Parking Relaxations Involving New Developments
The parking requirement for new developments may be reduced to an amount that can be reasonably accommodated on site pursuant to the approval of a site plan per Chapter 11 – Site Plan Review Procedure – when determined that the proposed development will be beneficial to the vitality of the Central Business District and surrounding environs. In doing so, the ability of the site to accommodate parking, as well as the availability of on-street parking and other public parking areas should be taken into consideration.
Possible Off-Site Parking Requirement for Apartments and Apartment Units in Mixed Use Developments
The Zoning Administrator may approve off-site parking requirements for apartment units where in the Zoning Administrator’s opinion such parking is needed to service the units but cannot realistically be provided on-site, in the street, or in other parking areas. In such instances, the Zoning Administrator shall require as a condition of approval assurances that the off-site parking will remain available to the tenants on a long-term basis.
 
In case of any building, structure or premises, the use of which is not specifically mentioned herein, requirements for a use which is so mentioned and to which said use is similar shall apply. (1983 Code § 11-1-22B; amd. Ord. 23-02, 3-6-2023; Ord. 24-09, 4-15-2024; Ord. 25-09, 4-11-2025)

9-9-3: RULES FOR COMPUTING OFF-STREET PARKING:

In computing the number of off-street parking spaces required, the following rules govern:
   A.   "Floor area" means the gross floor area of the specific use.
   B.   Where fractional spaces result, the parking spaces required are the nearest whole number.
   C.   The parking space requirement for a use, not specifically mentioned herein, is the same as required for a use of similar nature as determined by the Zoning Administration.
   D.   Whenever a building erected or established after the effective date of this Title is enlarged in floor area, number of employees, number of dwelling units, seating capacity or otherwise to create a need for an increase of ten percent (10%) or more in the number of existing parking spaces, such spaces shall be provided on the basis of enlargement or charge.
   E.   Whenever a building existing prior to the effective date of this Title is enlarged to the extent of fifty percent (50%) or more in the floor area or in the area used, said building or use shall then and thereafter comply with the parking requirements set forth herein.
   F.   In the case of mixed uses, the parking spaces required shall equal the sum of the requirements of the various uses computed separately.
   G.   Parking Space Dimensions: The size of a parking space for one vehicle shall consist of a rectangular area having dimensions of not less than nine feet by nineteen feet (9' x 19') plus adequate area for ingress and egress.
   H.   Dimensions; Compact Parking Spaces: A standard-size parking stall shall be at least nine feet wide and nineteen feet long (9' x 19') including a minimum of one hundred seventy one (171) square feet. Twenty five percent (25%) of the parking space requirement may consist of compact parking spaces in parking areas which have more than ten (10) parking stalls. The parking stalls for compact cars shall be at least eight feet wide and eighteen feet long (8' x 18') including a minimum of one hundred forty four (144) square feet. The compact parking stalls shall be marked for compact cars only.
   I.   Minimum Off Street Parking Dimensions: The regulations of this section shall govern the dimensions of off street parking spaces, including those provided in developments approved in planned districts or by special procedure prior to the enactment hereof, anything in such planned district or special procedure approval to the contrary notwithstanding.
Except as otherwise provided for in this section, the requirements for off street parking in this title shall be implemented in accord with minimum dimensions in the following table:

   Note:
      1.      Additional width may be required where the aisle serves as the principal means of access to on site buildings or structures.
   J.   Handicapped Parking: Handicapped parking shall be provided in accordance with Americans with Disabilities Act. (1983 Code § 11-1-23)
   K.   Parking Stall Requirements; Overhang Allowed: Where there is front end overhang over an open space area of at least two feet (2'), the minimum stall length for a parking space may be reduced two feet (2'). When the front of a parking stall abuts a sidewalk, the minimum width of the sidewalk shall be six feet (6') for sidewalks in residential districts, and seven feet (7') in commercial districts. 9-9-4: GENERAL REQUIREMENTS REGARDING PARKING:

Every parcel of land hereafter used as a public or private parking area, including a commercial parking lot, shall be developed and maintained in accordance with the following requirements:
   A.   No part of any parking space shall be closer than five feet (5') to any established street right of way or alley line.
   B.   No part of any noncommercial or multi-family dwelling driveway or parking space shall be located closer than three feet (3') to any side or rear property line.
   C.   Any off street parking area shall be surfaced with asphaltic or concrete pavement at least four inches (4") thick, except for the following:
      1.   Vehicle display lots where ten (10) or less units are displayed. Vehicle display lots which are not required to be surfaced with asphaltic or concrete pavement shall be surfaced with six inches (6") of gravel.
      2.   Parking areas in the rear yard for recreational vehicles, travel trailers, boats, snowmobiles, and other such recreational vehicles may occur on grass.
      3.   Temporary parking including, but not limited to, such circumstances as for weekend visitors; persons attending a party or other similar event at one's residence; special parking for recreational, sporting events, concerts, conventions or other large gatherings of temporary nature; not to exceed two (2) weeks of parking; and washing and waxing and minor maintenance of one's car not to exceed one week. The intent is to allow temporary parking, not permanent parking, unless paved.
      4.   Temporary parking and maneuvering areas for semitrailers when used as part of a trucking terminal company. All other areas shall be paved.
   D.   Any lighting used to illuminate any off street parking area including any commercial parking lots, shall be so arranged as to reflect the light away from adjoining premises in any R district and any public right of way.
   E.   Off street parking areas may be established in any R district that immediately joins a C or M district, or is directly across an alley from a C or M district, provided such parking shall be accessory to and for use of one or more business or industrial establishments located in the adjoining C or M district; provided, however, that such transitional use shall not extend more than one hundred feet (100') from the boundary of the less restricted zone.
   F.   A ten foot (10') setback shall be preserved between parking areas and drives within commercial and industrial districts and adjoining residential districts. Said setback area shall contain screening consisting of plantings, wood fencing or masonry fencing, or a combination thereof, six feet (6') high to a minimum opacity of eighty percent (80%). Topographic features may be incorporated to obtain the six foot (6') height. A chainlink fence with either wood, metal or plastic inserts does not meet the requirements of this section. When landscaping is included, the six foot (6') height must be obtained in three (3) growing seasons.
   G.   When visible from a public street or land zoned for residential use, the interior of such parking areas shall be developed as follows:
      1.   Not less than five percent (5%) shall be landscaped and continuously maintained.
      2.   Planting along the perimeter of a parking area, whether required for screening or general beautification will not be considered as part of the five percent (5%) interior landscaping. (1983 Code § 11-1-24)
   H.   All new or replaced driveways shall be surfaced with an asphaltic or portland cement concrete pavement at least four inches (4") in depth. In addition, whenever the owners construct a new garage or replace an existing garage, said owners shall be required to surface their driveway with an asphaltic or portland cement concrete pavement at least four inches (4") in depth.    I.   No parking area shall be designed in such a manner that exiting a parking area would require backing onto a street except for single- and two-family residential developments as provided for in subsection P of this section, parking in the right of way by revocable permit. (1983 Code § 11-1-24; amd. Ord. 14-07, 8-18-2014)
   J.   If the number of parking spaces required or provided for a use or a combination of uses on a lot is greater than eight (8) spaces, none of those spaces may be located in such a manner that would allow backing into an alley.
   K.   If parking for multi-family, commercial, and industrial uses as described above is accessed directly off an alley, the alley must be paved; if not paved, the developer shall pave that portion of the alley abutting said property; if property is located in mid block, the developer must pave the alley to the intersecting street. (1983 Code § 11-1-24)
   L.   Paved driveways and any associated off-street parking areas within the front yard of any single-family or two- family residence shall not occupy greater than fifty percent (50%) of the area between the building front yard setback line and public street right-of-way line and shall not provide greater than one parking space in addition to that provided in the traveled portion of the driveway. The driveways and parking areas shall be surfaced as required by subsection C of this section. Other parking in the front yard of a single-family or two-family residence is prohibited.    M.   Parking or allowing someone else to park in the front yard between a home and a street, except parking in a driveway, is prohibited. In those instances where a home is located on a corner lot, the home shall be considered to have two (2) front yards, one facing each street, and parking or allowing someone else to park shall be prohibited in both of those front yards.    N.   All parking requirements shall be maintained in good condition including landscaping and screening materials after their installation. (1983 Code § 11-1-24)
   O.   A first violation of subsection C or M of this section shall be punishable by a fine as set forth by the City Council for other parking violations. Any subsequent violations may be treated as a Municipal infraction and subject to the fines and penalties as set forth for those violations. In any proceeding charging violation of these subsections, a prima facie presumption that the registered owner was the person who parked or placed such vehicle at the point where, and for the time during which such violation occurred, shall be raised by proof that the particular vehicle described in the information was parked in violation of this chapter and the defendant named in the information was the registered owner at the time in question.    P.   Private parking improvements may be permitted for allowed nonresidential uses within the Residential Zone Districts R-1, R-2 and R-3 as follows:
      1.   Private parking improvements may be constructed within the right-of-way subject to terms of a revocable right-of-way permit for private parking improvements in the public right- of-way to be issued by the City Manager after review by Planning and Zoning Commission and City Council in accordance with chapter 10 of this title. Considerations in issuing the permit include provision of adequate unobstructed pedestrian improvements, safety of the traveling public, adequate drainage provisions, existing or future street classification, existing or planned street width, existing or projected traffic volumes, adequate maneuvering room, and other site specific factors. Additional screening, landscaping or other requirements may be imposed by the City in consideration of issuing a revocable right-of-way permit for private parking improvements in the public right-of-way.
      2.   Private uses of the right-of-way shall not unreasonably interfere with public uses of the right-of-way including public and franchise utility improvements.
      3.   The intended use of the parking is as occasional use or overflow parking for allowed nonresidential uses specifically excluding residential accessory uses such as home occupations.
      4.   The use of the parking is public subject to the terms of local on street parking restrictions.
      5.   Nothing in this subsection P shall exempt the nonresidential use from providing the minimum required off street parking per this chapter. All parking shall conform to all dimensional, surfacing, layout and other provisions of this Code.
      6.   Parking which backs into the public street may be considered. Ninety degree (90°) parking may be allowed. Angled parking may be required based on City Engineer's recommendation. (Ord. 14-07, 8-18-2014)
