CHAPTER 2

DISTRICTS; MAP

9-2-1: ESTABLISHMENT OF DISTRICTS:

For the purpose of this title, the following classes of districts are hereby established within the City as shown on the official zoning map which, together with all explanatory matter thereon, is hereby adopted by reference and declared to be a part of this title:
A-1
Agricultural District
R-1
Single-Family Residential District
R-2
One- and Two-Family Residential District
R-3
Multi-Family Residential District
R-4
Mobile Home Park Residential District
C-1
Residential-Commercial District
C-2
General Commercial District
C-3
Planned Commercial Development District
C-4
Central Business District
M-1
Service Commercial/Limited Industrial District
M-2
Heavy Industrial District
PUD
Planned Unit Development District

9-2-2: BOUNDARIES AND OFFICIAL MAP:

   A.   Districts Indicated On Map: The boundaries of these districts are indicated upon the official zoning map of the City, which map is made a part of this title by reference hereto. The official zoning map and all the notations, references and other matters shown thereon shall be as much a part of this title as if the notations, references and other matters set forth by said map were all fully described herein.
   B.   Map Filed In Clerk's Office: The official zoning map shall be on file in the Office of the City Clerk and shall bear the signature of the Mayor attested by the City Clerk, under the certification that this is the official zoning map referred to in this section.
   C.   Boundary Changes: If in accordance with the provisions of this title changes are made in the district boundaries or other matter portrayed on the official zoning map, the ordinance number and date of said change shall be recorded by the City Clerk on the official map.
   D.   Adoption Of New Map: The City Council may from time to time adopt a new official zoning map which shall supersede the prior official zoning map in the event that the official zoning map becomes damaged or destroyed, or for purposes of clarity due to a number of boundary changes, or to correct drafting errors or omissions; provided, however, that any such adoption shall not have the effect of amending the original Zoning Ordinance or any subsequent amendment thereof.
   E.   Interpretation Of Boundaries: Where uncertainty exists as to the boundaries of districts as shown on the official zoning map, the following rules shall apply:
      1.   Boundaries indicated as approximately following the centerlines of streets, highways, alleys, or other public rights-of-way shall be construed to follow such centerlines;
      2.   Boundaries indicated as approximately following platted lot lines shall be construed as following such lot lines;
      3.   Boundaries indicated as approximately following corporate limits shall be construed as following corporate limits;
      4.   Boundaries indicated as approximately following section lines, quarter section lines, or quarter-quarter section lines shall be construed as following such lines;
      5.   Boundaries indicated as following railroad lines shall be construed to be midway between the main tracks;
      6.   Boundaries indicated as approximately following the centerlines of streams, creeks or other waterways shall be construed to follow such centerlines;
      7.   Boundaries not capable of being determined in the previous paragraphs shall be dimensioned on the official zoning map or if not dimensioned shall be determined by the scale shown on the map. (1983 Code § 11-1-5)

9-2-3: FUTURE ANNEXATION OF TERRITORY:

All territory which may hereafter be annexed to the city shall be considered as lying in the A-1 agricultural district until such classification shall have been changed by amendment in accordance with provisions of this title. (1983 Code § 11-1-6)

9-2-4: APPLICATION OF DISTRICT REGULATIONS:

The regulations set by this title within each district shall be minimum regulations and shall apply uniformly to each class or kind of structure or lands and particularly, except as hereinafter provided:
   A.   Compliance With District Regulations: No building, structure or land shall hereafter be used or occupied and no building or structure or part thereof shall hereafter be erected, constructed, reconstructed or structurally altered unless in conformity with all of the regulations herein specified for the district in which it is located.
   B.   Building And Open Space Requirements: No building or other structure shall hereafter be erected or altered:
      1.   To exceed the height;
      2.   To accommodate or house a greater number of families;
      3.   To occupy a greater percentage of lot area;
      4.   To have narrower or smaller rear yards, front yards, side yards or other open spaces than herein required; or in any other manner contrary to the provisions of this title.
   C.   Yards And Off Street Parking Spaces: No part of a yard or other open space, or off street parking or loading space required about or in connection with any building for the purpose of complying with this title shall be included as part of a yard, open space or off street parking or loading space similarly required for any other building, except as otherwise provided herein.
   D.   Lot And Yard Dimensions: No yard or lot existing at the time of passage of the ordinance codified in this title shall be reduced in dimension or area below the minimum requirements set forth herein. Yards or lots created after the effective date hereof shall meet at least the minimum requirements established by this title. (1983 Code § 11-1-7)
