Sec. 23-2

Definitions.

The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

Accessory dwelling unit means a single-family dwelling unit that is attached to a single-family home or a private garage. The minimum floor area of an accessory dwelling unit shall be 440 square feet, and the maximum floor area of an accessory dwelling unit shall be 1,800 square feet.

Accessory use means a use which is subordinate to, clearly incidental to, customarily in connection with, and ordinarily located on the same premises as the permitted use. Home occupations which meet the criteria set out in section 23-16(a) shall be considered an accessory use to a residence in all districts.

Animal resistant container means a fully enclosed container that may be constructed of pliable materials reinforced to deter access by wildlife. The container must employ a sturdy lid that has a latching mechanism that prevents access to its contents by wildlife. Animal resistant containers must meet the standards of testing by the Living With Wildlife Foundation and a passing rating by the Interagency Grizzly Bear Committee as bear resistant for 60 minutes.

Boardinghouse means a residence at which the resident provides rooms and meals to unrelated persons for compensation.

Building line means a line parallel to a property line beyond which no exposed portion of a building extends. Unroofed terraces or patios, cornices, sills, canopies, balconies, eaves, steps and other ornamental fixtures, and chimneys which extend four feet or less from the building; open fire escapes which extend six feet or less from the building; walls, rails or fences up to six feet high; and temporary awnings need not be considered in determining the building line.

Day care center means any facility, including a residence, which provides daily care and supervision of children other than children of any family living there.

Duplex means a residence with two dwelling units.

Dwelling unit means an area in a building containing cooking, living and sanitary facilities designed for use and used by a single family for residential purposes, including related accessory structures.

Factory built housing means any structure, or component thereof, designed primarily for residential occupancy, either permanent or temporary, including a mobile home or travel home, which is wholly or in substantial part made, fabricated, formed, or assembled in manufacturing facilities for installation, or assembly and installation, on the building site.

Family means one or more individuals occupying a single dwelling unit and living as a single housekeeping unit with a maximum of eight adults.

Gas station means any building or lot having facilities for the sale of gasoline and other fuels for use by motor vehicles, and which may include incidental facilities for service and minor repair of motor vehicles.

Government buildings and facilities means any building or facility owned and operated by the United States of America, the state, the town, or any agency or political subdivision thereof.

Home occupation means any commercial activity, whether for profit or nonprofit, conducted within a dwelling unit.

Homeowners' association means any entity, whether a corporation, partnership, unincorporated association, or other entity, existing for the purpose of maintaining commonly-owned facilities or enforcing private protective covenants, whose members or shareholders are the property owners involved.

Mobile home means a single-family dwelling built on a permanent chassis designed for long-term residential occupancy and containing complete electrical, plumbing and sanitary facilities and designed to be installed in a permanent or semi-permanent manner with or without a permanent foundation, which is capable of being drawn over public highways as a unit, or in sections by special permit, or a manufactured home as defined in C.R.S. § 38-29-102(6) if the manufactured home is situated in a mobile home park.

Mobile home park means a parcel of land used for the continuous accommodation of five or more occupied mobile homes and operated for the pecuniary benefit of the owner of the parcel of land, his agents, lessees, or assignees. The term "mobile home park" does not include mobile home subdivisions or property zoned for manufactured home subdivisions.

Multiple-family residence means any residence with three or more dwelling units in a single building.

Nonconforming use means a use which does not comply with the use regulations, dimensional requirements or other regulations of this chapter.

Public utility service facilities means transmission and distribution facilities for natural gas, electricity, water, sewer, drainage, telephone, and cable television as necessary to provide service to customers located in the various districts of the town, such as pipes, lines, mains, wires, transformers, valves, and other related appurtenances, but not including buildings, offices, and production or generation facilities.

Setback means the perpendicular distance between a property line and the building line.

Travel home means any movable or relocatable dwelling unit with a living area of less than 500 square feet or which is required to have a license plate.

Travel home park means a park or campground for the temporary use of travel homes, including, but not limited to, campers, motorhomes, pick-up truck campers, trailers and trailer coaches, and for the use of camping equipment as defined in 6 C.C.R. § 1010-9:2.4.

Use means the activity or purpose for which property, a building or other structure is designed, arranged, intended, occupied or maintained.

Use by right means a use which is permitted or allowed in the district involved, without specific review by the planning commission, and complies with the provisions of this chapter and other applicable town ordinances and regulations.
