PREFACE
This Code constitutes a republication of the Land Development Regulations of the City of Lauderdale Lakes, Florida.
Source materials used in the preparation of the Land Development Regulations, as supplemented. The source of each section is included in the history note appearing in parentheses at the end thereof. The absence of such a note indicates that the section is new and was adopted for the first time with the adoption of the Land Development Regulations. By use of the comparative tables appearing in the back of these Land Development Regulations, the reader can locate any section of the Land Development Regulations, as supplemented, and any ordinance included herein.
The chapters of the Land Development Regulations have been conveniently arranged, and the various sections within each chapter have been catchlined to facilitate usage. Notes which tie related sections of the Land Development Regulations together and which refer to relevant state law have been included. A table listing the state law citations and setting forth their location within the Developmental Code is included at the back of this Code.
Index
The index has been prepared with the greatest of care. Each particular item has been placed under several headings, some of which are couched in lay phraseology, others in legal terminology, and still others in language generally used by local government officials and employees. There are numerous cross references within the index itself which stand as guideposts to direct the user to the particular item in which the user is interested.
Looseleaf Supplements
A special feature of this publication is the looseleaf system of binding and supplemental servicing of the publication. With this system, the publication will be kept up-to-date. Subsequent amendatory legislation will be properly edited, and the affected page or pages will be reprinted. These new pages will be distributed to holders of copies of the publication, with instructions for the manner of inserting the new pages and deleting the obsolete pages.
Keeping this publication up-to-date at all times will depend largely upon the holder of the publication. WHEREAS, the prevailing Developmental Code was adopted in 1981 and has since undergone scores of revisions which have, in some respects, led to internal inconsistencies and contradictions, and
WHEREAS, a number of the planning and zoning principles inherent in the regulations set forth in the Developmental Code are not consistent with prevailing planning and zoning principles, and
WHEREAS, the staff of the Community Development Department undertook a review of the Developmental Code and, over the last two years, concluded that it would be in the best interest of the City and the public to adopt a complete revision of the City's land development regulations, and
WHEREAS, the proposed land development regulations have been reviewed by the Planning and Zoning Board and the Planning Agency, and such Board and Agency have recommended the adoption thereof, and
WHEREAS, this ordinance has been duly advertised in accordance with Section 166.041(3)(c)(1), Florida Statutes,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LAUDERDALE LAKES as follows:
SECTION 1. ADOPTION OF REPRESENTATIONS: The foregoing Whereas Clauses are hereby ratified and confirmed as being true, and the same are hereby made a specific part of this Ordinance.
SECTION 2. ADOPTION: The land development regulations hereinafter set forth on Exhibit A, attached hereto, are hereby adopted and the land development regulations applicable to the development of all lands within the City.
SECTION 3. REPEAL: The Developmental Code adopted in 1981, through Ordinance No. 06-20 duly adopted on the 9 th day of May, 2006, is hereby repealed, in its entirety.
SECTION 4. CONFLICT: All ordinances or Code provisions in conflict herewith are hereby repealed.
SECTION 5. SEVERABILITY: If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions of this Ordinance.
SECTION 6. CODIFICATION: It is the intention of the City Commission of the City of Lauderdale Lakes that the provisions of this Ordinance shall be codified and that the sections of this Ordinance may be renumbered or relettered and the word "Ordinance" may be changed to "Chapter," "Section," "Article" or such other appropriate word or phrase, the use of which shall accomplish the intentions herein expressed; provided, however, that Section 1 hereof or the provisions contemplated thereby shall not be codified.
SECTION 7. EFFECTIVE DATE: This Ordinance shall become effective on September 1, 2006.
