RESIDENCE DISTRICTS

11-5A-1: NARRATIVE:

In the R-1 and R-2 single-family residence districts, land is principally used for, or is best suited for, detached single- family dwellings and related educational, religious, and recreational facilities. The regulations applicable to each single-family residence district are intended to stabilize and preserve sound existing neighborhoods developed at varying densities. The differing regulations are also intended to promote the development of a range of new single-family housing that is appropriate for persons with different social needs and income levels. The village citizens are proud of their rural heritage and believe that good sized lots will preserve that image. (Ord. 92-09, 4-14-1992)

11-5A-2: SITE AND STRUCTURE REQUIREMENTS:

   A.   One Principal Building Per Lot: In the R-1 and R-2 districts, only one principal building shall be erected on any lot.
   B.   Table Of Regulations: Every principal building erected in any R-1 or R-2 district shall conform to the applicable requirements indicated in the table below:

Minimum gross floor area: Each single-family dwelling hereafter erected shall contain at least 1,200 square feet of living area for a one-, two-, or three-bedroom dwelling, plus at least an additional 200 square feet of living area in the unit as a whole for each additional bedroom. Dwellings of more than one story in height shall contain at least 800 square feet of living area on the ground floor. Split level and bi-level dwellings shall be computed with the entire living area requirements contained on the uppermost levels.

11-5A-3: PERMITTED USES:

Churches and other places of formal worship.
Government uses of the village.
Libraries.
Parks, playgrounds.
Single-family dwellings, detached.
Accessory uses in accordance with section 11-4-4 of this title. (Ord. 92-09, 4-14-1992)

11-5A-4: CONDITIONAL USES:

Cemeteries.
Clubs or lodges, private; but not those which have as their chief activity a service customarily carried on as a business.
Daycare centers, nursery schools.
Golf courses, regulation size.
Government uses other than those of the village.
Home occupations (section 11-10-2 of this title).
Hospitals, nursing homes, sanitariums.
Medical and dental offices and clinics.
Multiple-family housing.
Schools, public or private, elementary or secondary.
Two-family dwellings. (Ord. 92-09, 4-14-1992)

11-5A-5: LIMITATION ON R-2 DEVELOPMENT:

Except for those areas zoned R-2 upon the adoption of this title as set forth in the zoning map, it is the policy of the village that the R-2 classification is not appropriate for future residential development. Accordingly, petitions requesting expansion of the present R-2 district or creation of an additional R-2 district will be denied. (Ord. 92-09, 4-14-1992)

11-5A-6: PARKING:

Other than temporary parking of a motor vehicle, a motor vehicle shall be parked:
   A.   In an enclosed garage;
   B.   In an off street parking space in the rear yard at least ten feet (10') wide, twenty feet (20') long with at least seven feet (7') of vertical clearance. No more than two such parking spaces shall be allowed per lot without a conditional use permit.
   C.   In a front or side yard, only on a driveway.
   D.   Temporary parking of a motor vehicle, other than as specifically allowed herein, shall be allowed no more than seventy-two (72) consecutive hours.
   E.   Parking between the front line of any portion of the building and street should be limited to private passenger vehicles, and only one of the following: pickup trucks, vans or similar type vehicles, or a commercial vehicle when owned by or issued to the occupant, except semi tractors, semi tractor trailers, construction equipment and any vehicle with a gross weight in excess of twelve thousand (12,000) pounds.
   F.   On corner lots, parking between the street and building shall be limited as set forth immediately above.
   G.   In side and rear yards, only one of the following shall be allowed: recreational vehicles including motorized home, boat trailer with or without a boat mounted on it, but no stand alone boat or unmounted boat; commercial vehicles when owned by or issued to the occupant, except semi-tractors, semi-tractor trailers, construction equipment, and any vehicle with a gross vehicle weight in excess of twelve thousand (12,000) pounds.
   H.   A motor vehicle that is in an inoperative condition, or not licensed, or not insured, shall not be allowed on any residential property for more than thirty (30) days unless it is in a totally enclosed garage. All major repairs shall be performed within an enclosed garage in residential area.
   I.   Any hard surface parking space on the village right-of-way, if necessary to be removed due to street or utility work, material will only be replaced by the village to the extent of gravel surface.
   J.   As to the commercial vehicle described and permitted in divisions E. and G. above, only one such vehicle shall be allowed per lot, whether parked in the front, side yard or rear yard. (Ord. 06-21, 9-7-2021)

11-5B-1: PURPOSE AND INTENT:

The R-3 multiple-family residence districts are established to stabilize and conserve existing neighborhoods that consist of multiple-family dwellings as well as single-family dwellings. This district classification is also intended to promote the development of comparable new areas in order to accommodate all persons desiring this type of residential development. 11-5B-2: SITE AND STRUCTURE REQUIREMENTS:

   A.   Single- And Two-Family Dwellings: Detached single-family and two-family dwellings erected in the R-3 districts shall comply with section 11-5A-2 of this title. (Ord. 92-09, 4-14-1992; amd. 2003 Code)
   B.   All Other Buildings: All other principal buildings shall conform to the following requirements:
      1.   Minimum lot area: 7,500 square feet per dwelling unit.
      2.   Minimum lot width: 100 feet.
      3.   Minimum lot depth: 150 feet.
      4.   Minimum setbacks:
         a.   From front lot line: 30 feet.
         b.   Side yards:
            (1)   Minimum total setback from both side lot lines: 20 feet.
            (2)   Minimum setback from either side lot line: 8 feet.
            (3)   From rear lot line: 35 feet.
      5.   Maximum building height: 45 feet.
      6.   Minimum gross floor area: Multiple-family dwellings shall contain at least 675 square feet of living area per dwelling unit.

Medical and dental offices and clinics.
