14.- NUISANCE MITIGATION
A.
Required Performance Level. No operation or activity shall cause or create noise in excess of the sound levels uses listed in Table 17-14-01 of this chapter.
B.
Method of Measurement. Measurement of noise will be made in conformance with American National Standards Institute publication "Recommended Methods for Measuring Acoustic Noise Emissions," (T.1.TR.54-1997 or updated publication).
C.
Exemptions. The following activities shall be exempt from the noise level standards of this chapter:
1.
Noises emanating from construction and maintenance activities; and
2.
Noises of safety signals, warning devices, and emergency pressure relief valves; and
3.
Transient noises of moving sources such as automobiles, trucks, airplanes, and railroads.

A.
Plan Required. A photometric plan will be required as part of a non-residential development plan or redevelopment plan and for all projects or plans that utilize parking lots. The plan must show the location, size (wattage), mounting height, orientation, type, design, and shielding for all outdoor lighting and signs including wall mounted lighting. The plan must show the levels of illumination in footcandles (fc) at ground level (minimum 10' x 10' grid). A catalog sheet showing the proposed lighting fixtures should be included.
B.
Light Spillage. Illumination of parking lots or other areas shall limit light spillage onto adjacent property to a maximum horizontal footcandle value at the perimeter of the property in accordance with Table 17-14-03 of this chapter. Lighting for special events, sporting events and sports fields is exempt from this requirement for governmental entities.
C.
Glare. All open off-street parking lots shall be illuminated. Table 17-14-02 of this chapter specifies minimum footcandle requirements. To reduce glare, only "fully shielded" or "full cutoff" light fixtures are allowed. Fully shielded means that no light is emitted above the horizontal plane passing through the lowest point of the light-emitting element, so that direct light emitted above the horizontal plane is eliminated to prevent a nuisance on an adjacent property.
D.
Except as otherwise allowed in this ordinance, luminaires shall not be mounted in excess of thirty (30) feet above grade, or the height of the primary structure, whichever is less; provided however, luminaires located within two hundred (200) feet of a single-family residential zoning district shall not be mounted in excess of twenty (20) feet above grade or the height of the primary structure, whichever is less. Luminaires for public event space and athletic fields are exempt from height restrictions for governmental entities.
E.
Service-station canopy lighting shall be accomplished using flat-lens full-cutoff downlighting fixtures, shielded in such a manner that the edge of the fixture shielded be level with or below the light source envelope.
F.
All other under-canopy lights must be fully recessed into the canopy.
G.
All non-residential lighting is required to be turned off no later than 60 minutes after business hours, only leaving lighting necessary for site security.
