§ 6

CONDITIONAL USES.

A. 
PURPOSE. After public hearing and proper notice and after recommendation by the Planning and Zoning Commission, the City Council may authorize the issuance of conditional use permits when the council finds all of the following conditions present:
(1) 
That the establishment, maintenance, or operation of the conditional use will not be materially detrimental to or endanger the public health, safety, morals, or general welfare;
(2) 
That the uses, values and enjoyment of other property in the neighborhood for the purpose already permitted shall be in no foreseeable manner substantially impaired or diminished by the establishment maintenance, or operation of the condition use;
(3) 
That the establishment of the conditional use will not significantly impede the normal and orderly development and improvement of the surrounding property for use permitted in the district;
(4) 
That adequate utilities, access roads, drainage and other necessary site improvements have been or are being provided;
(5) 
That adequate measures have been or will be taken to provide ingress or egress so designed as to minimize traffic congestion in the public streets; and
(6) 
That the conditional use shall conform to all applicable yard area regulations of the district in which it is located.
Prior to the granting of any conditional use, the City Council may stipulate such conditions and restrictions upon the establishment, location, construction, maintenance, and operation of the conditional use as deemed necessary to protect the public health, safety and general welfare of the community and to secure compliance with the standards and requirements specified in subsections (1) through (6) [(A)(1) through (6)] of Section 6. In all cases in which conditional uses are granted, the council shall require such evidence and guarantees as it may deem necessary as proof that the conditions stipulated in connection therewith are being and will be complied with.
No application for a conditional use which has been denied wholly or in part by the City Council shall be resubmitted for a period of six (6) months from the date of said denial.
B. 
FOOD TRUCKS/MOBILE FOOD UNITS. Food Trucks/Mobile Food Units may be permitted as a Conditional Use in any Zoning District in accordance with the following regulations:
(1) 
Must be issued a permit by the City of Lone Oak. Permit fee is $75 and shall be renewed every quarter.
(2) 
Shall only be allowed on Sundays and Mondays between the hours of 7:00 a.m. to 11:00 p.m.
(3) 
Must present proof of a Texas Department of State Health Services permit, a State Mobile Unit Food Establishment Permit, and a Sales Tax Permit.
(4) 
May park on public property provided:
a. 
Two Mobile Food Units may not operate closer than ten feet from each other; and
b. 
May not require the use of more than 25 percent of the parking spaces located on the property it is operating from.
(5) 
May park on private property with written property owner permission.
(6) 
Must comply with the City of Lone Oak's noise ordinance, sign ordinance, and any other applicable ordinances.
(7) 
Must comply with all applicable federal, state, and county regulations.
(8) 
Shall not be parked, situated, or operated in a manner that restricts or blocks emergency vehicle apparatus access or interferes with any fire lane, fire break, fire hydrant, or exit access of any structure.
(9) 
Must have a fire extinguisher approved by the fire marshal.
(10) 
Must provide appropriate waste receptacles at the site of the unit and remove all litter, debris and other waste attributable to the vendor on a daily basis.
(11) 
Shall not represent the granting of a permit under this section as an endorsement by the City of Lone Oak.
(12) 
Will be subject to inspections by City officials at any time.
(13) 
The City reserves the right to revoke a permit at any time if the Mobile Food Unit is found to be in violation of this section or any other applicable City ordinances.
