B-L Local Business District

§ 250-64 Purpose.

The purpose of this district is to provide for logical locations where the retail services needed by the Town population can be made available. The areas are centrally located near the locations of existing and expected population concentrations, including portions of the downtown business area.

§ 250-65 Applicability of regulations.

The regulations contained in this article and applicable regulations contained in other articles shall apply in the B-L Local Business District.

§ 250-66 Principal permitted uses.

In the B-L Local Business District, the following principal uses shall be permitted:
A. 
Local retail business or service shops, including:
(1) 
Alcoholic beverage package stores.
(2) 
Antique shops.
(3) 
Appliance stores.
(4) 
Arts and crafts shops.
(5) 
Automobile accessory.
(6) 
Bakery shops.
(7) 
Bank, savings and loan institutions.
(8) 
Beauty and barber shops.
(9) 
Candy stores.
(10) 
Clothing stores.
(11) 
Dairy products stores.
(12) 
Dress or millinery shops.
(13) 
Drugstores.
(14) 
Dry goods or variety stores.
(15) 
Florist or garden shops.
(16) 
Food and grocery stores.
(17) 
Fruit or vegetable stores.
(18) 
Furniture and upholstering stores.
(19) 
Gift or jewelry shops.
(20) 
Hardware stores.[1]

Offices and clinics, professional and business, including animal hospitals or veterinary clinics without runways.

Planned business centers, subject to the provisions of § 250-86.[5]

Schools: art, trade, business, nursery or day-care centers.

Dwellings, single-family.

Churches, schools and colleges.
J. 
Agriculture, as defined in § 250-125, provided any building or feeding pens in which farm animals are kept shall comply with distance requirements specified in § 250-19.

§ 250-67 Conditional uses requiring Board authorization.

In the B-L Local Business District, the following conditional uses require Board authorization:
A. 
Family day care as defined in § 250-125.

Medical and dental clinics, subject to approval of the site development plan and exterior design of the structure by the Commission.

D. 
Any other retail business or service establishment not enumerated in this section which is determined by the Board to be of the same general character as the principal permitted retail business or service uses, but not including any use which is first permitted in the B-G District or which, in the judgment of the Board, would be incompatible with or deleterious to the B-L District.
E. 
Bed-and-breakfasts, subject to the provisions of § 250-13 hereof.

§ 250-68 Accessory uses.

In the B-L Local Business District, the following accessory uses shall be allowed:
A. 
Uses and structures customarily accessory and incidental to any permitted principal use or authorized conditional use.

§ 250-69 Required conditions.

A. 
All business, services or processing shall be conducted wholly within a completely enclosed building, except for sale of automotive fuel, lubricants and fluids and service stations, off-street automobile parking and loading areas, public utility uses, taxi stands and garden shops.
B. 
Processes and equipment employed and goods processed or sold shall be limited to those which are not objectionable by reason of odor, dust, smoke, cinders, gas, fumes, noise, vibration, refuse matter or water-carried waste.

§ 250-70 Height regulations.

No structures shall exceed 2 1/2 stories or 35 feet in height, except as provided in § 250-94.
