ARTICLE XII

SIGN AND BILLBOARD REGULATIONS

All signs within the City of McRae-Helena shall be erected, constructed and maintained in accordance with the provisions below, and shall require a sign permit to be issued unless specifically exempted. All signs must be constructed of durable materials, in a structurally safe manner, be maintained in good condition and appearance, be compatible in appearance and aesthetics to other signs in the general area and must not be allowed to become deteriorated or dilapidated.


Section 1201: - Prohibited Signs.

A.

Off-site or off-premises business signs.

B.

Portable Signs.

C.

Signs with beacons, animated and running lights or other flashing lights.

D.

Signs placed on trees, rocks, or utility poles.

E.

Air and gas filled devices, except as an authorized temporary or special event sign.

F.

Strings of lights not permanently mounted to a rigid background, except holiday decoration with no commercial message.

G.

Fluttering ribbons, banners, pennants or streamers.

H.

No sign shall be constructed, erected or maintained that uses the words, "Stop," "Emergency," or "Danger," or uses emergency colors of red, blue, or amber, in such a manner as to imply danger or emergency, or which is a copy or imitation of an official traffic control sign.

I.

Roof signs, except on the facings of roofs when no other space is available for the mounting of signs. Supports for roof signs shall be attached to the structural supports of the roof, and shall not project above the ridge line of the roof.

J.

Illuminated signs from which direct rays of light are projected onto a lot other than on the lot where the illumination occurs.

K.

Signs which move or have any moving or animated parts, or which emit or utilize in any manner any sound capable of being heard with normal hearing.

L.

Signs which advertise an activity that is illegal under Georgia or federal law or regulations in effect at the location of such signs or activity.

Section 1202: - No Signs Shall Hamper Traffic Safety.

No sign shall be erected or continued that:

A.

Obstructs the sight distance along a public right-of-way.

B.

Would tend by its location, color or nature, to be confused with or obstruct the view of traffic signs or signals, or to be confused with a flashing light of an emergency vehicle.

C.

Would by its nature tend to confuse motorists, or otherwise create any potential hazard to motorist.

D.

Uses admonitions such as "stop," "go," "slow," "danger," etc., which might be confused with traffic direction signals.

Section 1203: - Signs in the Public right-of-way.

No signs, including any overhang, shall be allowed within the public right-of-way, except for the following:

A.

Public signs erect by or on behalf of a governmental body to post legal notices, identify public property, convey public information, or direct or regulate traffic.

B.

Information signs of a public utility regarding it poles, lines, pipes or facilities.

C.

Emergency warning sign erected by a governmental body, a public utility or a contractor doing authorized or permitted work within the public right-of-way.

Section 1204: - Signs Not Requiring a Permit.

The following signs shall be exempt from the permit requirements of this Article, provided that the signs erected or placed or located on property of the person who erects such signs or on property whose owner has given permission for such placement:

A.

Traffic directional, warning, or information signs authorized or required by any public agency in accordance with a valid law, regulation, ordinance.

B.

Official notices issued by a court, public agency, or officer.

C.

Signs prohibiting or otherwise controlling trespassing upon particular premises, or indicating the private nature of a road, driveway or premises may be erected and maintained, provided that the area of any such sign shall not exceed two (2) square feet.

D.

Season or holiday lights and decorations.

E.

Signs not exceeding ten (10) square feet giving information concerning the location or use of accessory off-street parking facilities or loading and unloading facilities.

F.

One non-illuminated temporary construction project sign, political sign, or real estate sign offering property for sale, rent, or lease not exceeding six (6) square feet in area in residual districts and sixteen (16) square [feet] in other than residential districts and located no less than twenty (20) feet back from the right-of-way.

G.

Signs advertising garage sales, provided they do not exceed four (4) square feet in area, and are limited to only one sign posted on the premises of the sale. Such signs shall be posted no earlier than one week prior to the sale and the posting is limited only to the duration of the sale.

H.

Reserved.

I.

Any flag representing a governmental entity or political subdivision of the United States or Georgia without limit.

J.

Ornamental flags attached to a building and limited to one per principal structure.

K.

Window signs displayed from inside a business, provided that no more than fifty (50) percent of the total window surface of each window with a sign visible from the outside is covered by the display, and the total area does not exceed one hundred (100) square feet.

Section 1205: - Temporary, Spectacular, or Special Event Signs.

A.

A sign which is not permanently erected, affixed, or maintained on premises for a long period of time and which includes:

1.

any piece or strip of cloth, paper, canvas, plastic or similar material affixed to the principal building or the curtilage thereof, on which a message, slogan, or emblem is painted, drawn, or otherwise projected, colored, or shaped for the purpose of advertising or drawing public attention;

2.

Balloons;

3.

vehicles, trailers, and other mobile devices which are parked or placed in a stationary position and which have a sign mounted on the vehicle or are painted to display a message or otherwise act as a sign or attention-getting device;

4.

Other attention-getting devices, but not including banners, fluttering ribbons, flags, or streamers, are considered temporary, special event or spectacular signs.

B.

Temporary, special event or spectacular signs may be issued a temporary sign permit which may allow the use of such a sign subject to the following requirements:

1.

A temporary sign permit shall allow the use of a temporary, special event, or spectacular sign for a specified thirty (30) day period.

2.

The temporary, special event, or spectacular signs authorized are on-premises signs.

3.

The maximum size for all temporary, special event or spectacular signs under one permit shall be one hundred (100) square feet.

4.

Except as modified by this Section, all signs authorized under a temporary sign permit must otherwise comply and not violate all other applicable regulations, conditions, and prohibitions set forth in this Article.

5.

No more than three permits for temporary signs shall be issued to any applicant in any calendar year.

Section 1206: - Signs Prohibited in Residential Areas.

No sign of any character shall be erected in any residential dwelling district, except such signs as are exempt from the provisions of this ordinance as hereinafter provided.

Section 1207: - Signs Attached to the Ground.

Ground signs shall not be permitted nearer than 25 feet from intersecting streets, nor forward of the established building line within the district. Ground signs shall not exceed 100 square feet in sign area.

Section 1208: - Signs Attached to the Roof.

Roof signs shall not exceed 100 square feet in area and shall relate to the business conducted on the premises or in the building on which such roof sign is located.

Section 1209: - Signs Attached to the Wall.

No wall signs shall exceed 100 square feet in area and shall relate to the business conducted on the premises or in the building on which such sign is located.

Section 1210: - Exceptions.

Real estate signs not exceeding 4 square feet in area which advertise the sale, rental, or lease of the premises upon which said signs are located.

Temporary signs denoting statements pertaining to a building under construction may be placed on the site of the building project.

Memorial signs on tablets when constructed of bronze or other non-combustible material may be located on public or semi-public lands.

Municipal or state-installed directional signs, historic markers, and other signs of a general public interest as deemed by the City Council may be erected in any zoning district.

Street name signs, name plates of ornamental design designating the name of the occupant of the property, and private directional signs are permitted in any zone providing the letters or figures are not more than four (4) inches in height. Church bulletin boards are also permitted.

Signs of schools, colleges, churches, religious, charitable, civic, fraternal, political, or similar organizations shall be allowed provided they relate exclusively to the institution erecting the same, do not exceed one sign per road frontage, and are limited to thirty-two (32) square feet in area in residential districts and to one hundred (100) square feet in area in all other districts.

All signs must be designed to withstand winds of 80 miles per hour.

No sign shall exceed twenty-five (25) feet in height.

All signs are set back at least ten (10) feet from any street right-of-way and at least fifteen (15) feet from any property line.
