CHAPTER 1139

General Industrial Zoning District

1139.01 ZONING DISTRICT PURPOSE.

   The General Industrial (GI) Zoning District is designed to accommodate those light industrial, heavy industrial, office, flex space and other permitted activities which, by their character, should be relatively remote from residential development and which are not obnoxious, unhealthful or offensive by reason of the potential emission or transmission of noise, vibration, smoke, dust, odors, toxic matter, noxious matter, glare or heat.

1139.02 PERMITTED USES.

   (a)   Land uses permitted by right in the GI zoning district are provided for in the Land Use Matrix Chart found in Section 1129.07.
   (b)   Any land use not designated as a permitted use for the GI zoning district as set forth in the Land Use Matrix Chart found in Section 1129.07 shall not be permitted in those respective districts.

1139.03 CONDITIONAL USES.

   (a)   Conditionally permitted land uses in the GI zoning district are provided for in the Land Use Matrix Chart found in Section 1129.07.
   (b)   All conditional uses provided for in the Land Use Matrix Chart found in Section 1129.07 shall comply with the regulations and procedures set forth in the Conditional Use Chapter 1143.

1139.04 ACCESSORY USES.

   Accessory uses, buildings or other structures customarily incidental to any permitted or conditionally permitted use in the GI zoning district may be established, erected or constructed. Accessory uses shall comply with the building setback, height, lot coverage and any other applicable standards as provided set forth in Chapter 1141.

1139.05 DEVELOPMENT PLAN REVIEW.

   Development Plan Review Procedure. Development proposals brought under the GI zoning district shall follow the preliminary and final development plan procedure set forth in Chapter 1147 .

1139.07 SUPPLEMENTAL DEVELOPMENT STANDARDS.

   (a)   Every permitted use of land and structures in the GI zoning district shall be located on a lot of record in such a manner as to create and preserve a front yard adjacent to each street on which such lot abuts, a side yard or yards and (except in the case of corner or through lots) a rear yard, conforming to the requirements of this chapter.
   (b)   Front Yard Setback Measurement. Building setbacks are measured from the public street right-of-way or measured from the nearest edge of pavement for private drives.
   (c)   Side and Rear Yard Standards for Accessory Uses. Permitted accessory uses, driveways, parking areas serving the principal structure and other permitted ancillary uses may be located within the side or rear yard subject to all applicable regulations set forth in Chapter 1141 .
      (1)   Permitted accessory uses shall be located no closer than 100 feet from an adjacent property boundary line of any residential zoning district or residential land use.
   (d)   Corner Lot Parking Areas. Off-street parking areas located on a comer lot shall be setback 20 feet from the street right-of-way.
   (e)   Projections Into Yards. As used in this chapter, “projection” means that part or feature of a building which extends or projects outside of the enclosing walls. It is intended that certain features may project into the yards required in the GI zoning district, but such features shall be regulated so as not to substantially interfere with the reception of sun, light, air and the use of adjacent lots. Building features may project into a front, side, or rear yard measured from the established yard line, as follows:
      (1)   Architectural features extending not more than one foot into a required yard.
      (2)   Awnings and canopies.
      (3)   Eaves, gutters and downspouts projecting no more than sixteen inches into a required yard.
      (4)   Walls and fences - as regulated in this Code for type and height.
      (5)   Steps - excluding fire escapes.
      (6)   Pedestrian sidewalks.
      (7)   Vehicular access, circulation and service driveways, and off-street parking areas (but not including any above- ground structure except a pavement, curbing and illumination).
      (8)   Signs, subject to the applicable regulations set forth in Chapter 1153.
   (f)   Height Standards.
      (1)   Roof mounted building elements. A chimney, spire, tower, flagpole, water tank, antenna, monument or similar ancillary appurtenance, constructed upon a roof of a principal structure, shall not exceed fifteen feet in height.
      (2)   Ground mounted elements. A chimney, tower, flag pole, water tank, radio or television antenna, monument or similar ancillary appurtenance, constructed upon the upon a finished grade, whether it constitutes an integral part of the building or not, shall not exceed fifty feet above the average finished grade of the site.
      (3)   Roof mounted mechanical equipment. Mechanical equipment placed on the building roof may be allowed above the maximum building height specified, provided such mechanical equipment is:
         A.   Set back a minimum of fifteen feet from any exterior wall.
         B.   Not more than eight feet in height.
         C.   All applicable mechanical equipment standards set forth in Section 1139.09 shall apply.

1139.08 SITE DESIGN GUIDELINES.

   (a)   Purpose and Application. These site design guidelines address the relationships of elements on the property, such as building location and orientation, access and circulation, pedestrian connections, parking, open space, and lighting. The goal in designing the site should be to create a functional and visually interesting environment, which fits with the unique conditions and activities of the site and maintains the design standards set forth in this chapter.
   (b)   Site Layout. Industrial buildings and other uses permitted in this district should be designed and sited to create an attractive impression from public corridors, and provide generously planted landscape setbacks to soften the visual impact of buildings and frame the streets.
      (1)   Orient building fronts and entries towards streets, parking lots and public spaces. Front office areas should be in the most visible locations, as they add human scale to an industrial building.
      (2)   On corner lots, consideration should be given to locating offices near the intersection to enliven the streetscape and add visual interest.
      (3)   Parking areas should be minimized adjacent to intersections.
      (4)   Rectangular shaped buildings should be oriented with the shorter building side parallel to the street to reduce the view of a long, narrow building.
      (5)   Signage and landscape elements should distinguish the entries that serve the main building from service entries.
      (6)   Service vehicle traffic should be separated from employee and visitor circulation.
   (c)   Site Utilities.
      (1)   All utilities including drainage systems, sewer, gas and water lines, electrical, telephone, and communications should be installed and maintained underground.
      (2)   Electric transformers, utility pads, cable TV and telephone boxes should be located underground or screened with walls, fences or landscape vegetation in a manner harmonious with the overall character of the development and adjacent parcels.
   (d)   Fence Standards.
      (1)   Fences shall not be constructed of electrically charged wire, razor wire, chain link with slats, chicken wire, rope, cable, railroad ties, landscape timbers, utility poles or any other similar materials or materials not specifically manufactured for permanent fencing.
      (2)   The cut or selvage end of wire or metal fencing materials may not be exposed at the top of a fence if the height of the fence is less than six and one-half feet.
      (3)   Barbed wire may be permitted at the top of a fence if the height of the barbed wire is not less than six and one-half feet and the fence is located in an industrial district not less than 100 feet from a residence or office residence district.
      (4)   Any other applicable wall or fence regulation as set forth in Section 1157.05.
   (e)   Parking. Adequate and convenient parking areas should be configured to provide convenient vehicular access, and arranged to support safe and efficient pedestrian movement from the parking areas to the user’s destination.
      (1)   On-site parking shall be provided in accordance with off-street parking standards as set forth in Chapter 1149 of this Zoning Code.
      (2)   Separate employee and visitor parking from service and loading parking.
      (3)   Provide landscaping to provide shade and to create visual breaks as required in Chapter 1151.
      (4)   Handicapped parking shall be provided in accordance with applicable codes. All sidewalks shall include handicapped ramps at curbs designed in conformance with barrier free design code requirements (“ADA”).
   (f)   On-Site Paving and Hardscape Standards. All on-site exterior paving areas including, but not limited to, pedestrian walkways, hardscaped gathering areas, and other paved or hardscaped areas on a site shall be broom finished concrete; or other dust free surface as approved.
   (g)   Ancillary Structures. Ancillary structures, service areas, and trash enclosures should be carefully planned as part of the project, and placed in locations on the site featuring low visibility from the public view. All applicable standards for accessory structures and landscaping and screening shall be satisfied.
   (h)   Lighting.
      (1)   Lighting goals. Lighting and lighting system components and hardware should be compatible and harmonious throughout the entire development or site. Site lighting should relate to the specific function or task and building type served.
      (2)   Pedestrian walkway lighting. Along pedestrian walkways, the use of low-mounted bollardheight or similar lighting features which reinforce pedestrian scale, and clearly identifies the direction of travel are encouraged.
      (3)   Parking lot and driveway lighting. Parking areas, drive and building service areas should be illuminated to ensure the public safety. Lighting fixtures should be designed and located so as to not cast direct rays of excessive brightness upon an adjoining property or cause glare hazardous to pedestrians or to drivers of motor vehicles on adjacent streets.
      (4)   Landscape accent lighting. Landscape accent lighting should reinforce the overall organization of the site and reflect an appropriate hierarchy of features.
      (5)   Site lighting. Site lighting visible from streets and adjacent property should be indirect or incorporate full cut-off shielded type fixtures. All site lighting should be designed and located to confine all direct light distribution to the premises. Any glare, hot spots and inconsistencies should be avoided.
      (6)   Building lighting.
         A.   Flood lighting of any parts of the site or any building is prohibited.
         B.   Light fixtures attached to exterior walls of buildings should be compatible with building design.
         C.   Fixtures visible from the street should be decorative and integrated with the building architecture.
         D.   Wall packs are not allowed where visible from the street.
      (7)   The lighting standards set forth in Section 1147.07 shall be satisfied.
   (i)   Trash and Refuse Collection.
      (1)   Garbage, trash and refuse should be stored in garbage containers located within a minimum six foot high enclosure.
      (2)   External enclosure surfaces should be designed to blend with the building architecture. Trash and refuse collection enclosures are regulated by Section 1151.08.
   (j)   Signs. Signs in the GI zoning district shall be designed, erected, altered, moved or maintained, in whole or in part, in accordance with Chapter 1153 .

1139.09 ARCHITECTURAL DESIGN GUIDELINES.

   (a)   Building Massing and Grouping. Create complimentary grouping of buildings which are appropriately scaled to their surroundings, and which present a pleasing visual experience.
      (1)   Each building or grouping of buildings should be stylistically consistent. Architectural style, materials, colors, form and scale should all work together to express a unified theme.
      (2)   Large structures should be visually broken up into smaller components through changes in massing, form and texture.
      (3)   Buildings on corners and major streets should be of high visual quality.
      (4)   Where development within this zoning district is located adjacent to a residential zoning district or residential land use, it should appropriately transition to the residential scale. Smaller buildings create a better transition to the surrounding neighborhood.
      (5)   Large buildings should have facades that include variations in massing, form and texture where visible to the public. Recessed window treatment and other articulation of the elevation will help to improve an otherwise planar surface and aid the buildings’ appeal. Provide shadow line or articulation of building facades at the second story level, breaking the vertical expanse of the building as well as the horizontal. Overhangs, projections, reveals and covered pedestrian walkways are encouraged as they contribute to the overall character of the building and provide shade.
   (b)   Exterior Building Materials Standards.
      (1)   Unfinished or unpainted non-decorative concrete block shall not be used on any exterior wall.
      (2)   Metal siding shall not be used on any wall facing a public right-of-way or a residential land use or zoning district. If metal siding is utilized on any remaining wall, it shall be subject to the approval of Planning Commission.
      (3)   A combination of brick, masonry, glass, or other suitable building materials shall be used on the front of the building, subject to the approval of Planning Commission.
   (c)   Mechanical Equipment Screening Standards.
      (1)   Mechanical equipment, such as compressors, air conditioners, antennas, pumps, heating and ventilating equipment, emergency generators, chillers, elevator penthouses, water tanks, standpipes, solar collectors, satellite antenna dishes and communications equipment, should not be visible from public streets or adjacent parcels.
      (2)   Roof mounted equipment should be fully screened by the roof parapet.

1139.10 OUTDOOR STORAGE, SALES AND LOADING STANDARDS.

   (a)   Outdoor Storage. The storage of raw materials and/or manufactured products shall be located within the rear yard area only and shall be sufficiently screened from view from any public or private roadway and the adjoining properties by a substantially solid wall or fence erected to a height of not less than eight feet, or by an earthen mound and evergreen plantings following the minimum design and planting standards set forth in Chapter 1151 , or as otherwise determined by the Planning Commission to be necessary to conceal the storage from view.
   (b)   Loading and Unloading. Loading and unloading operations shall be conducted in the rear or side of the building and shall be sufficiently screened from view from any public or private roadway and the adjoining properties as determined by Planning Commission to be necessary to conceal the loading and unloading operations from view.
   (c)   Outside Sales. The outside sale or display of finished goods or products shall be prohibited unless otherwise permitted by this Zoning Code.
   (d)   Temporary Sales Events. Limited retail sales in the GI zoning district are permitted only upon the issuance of a temporary sales event permit.
      (1)   Temporary sales event permit. The Building Commissioner may, upon submission of a completed application, issue a temporary sales event permit to allow a property owner or tenant the ability to conduct limited and temporary retail sales of merchandise on site.
      (2)   The temporary sales events permit may be issued by the Building Commissioner if the conditions set forth in this section are met. The applicant shall submit an application containing the following information:
         A.   A description of the land proposed to be used.
         B.   A site plan showing setbacks, property lines and adjoining structures and the proposed location of the temporary sales and events.
         C.   A description of the proposed use.
         D.   Hours of operation.
         E.   Estimates of accumulated automobiles and persons per hour.
         F.   Proposed restroom facilities.
         G.   Proposed parking facilities.
      (3)   The proposed temporary sales event will not operate after 8:00 p.m. and not before 8:00 a.m.
      (4)   The location of any proposed driveway entrance will not create a traffic hazard or excessive congestion.
      (5)   The proposed site shall contain adequate parking. Adequate parking shall be determined on the basis of one parking space per four estimated people attending per hour.
      (6)   The proposed site contains adequate restroom facilities.
      (7)   An applicant may only receive one temporary sales event permit in any ninety-day period. All temporary sales events shall be limited to a Saturday and Sunday occurring in the same week.
      (8)   All retail sales activities shall be conducted wholly indoors.
      (9)   The temporary sale of merchandise from a vehicle or temporary structure is prohibited.

1139.11 NIGHT BUSINESS OPERATION STANDARDS.

   No building customarily used for night operation shall have any openings, other than stationary windows or required fire exits, within 200 feet of any residential land use or residential zoning district, and any space used for loading or unloading of commercial vehicles in connection with such operation shall not be located within 100 feet of any residential land use or residential zoning district.

1139.12 FIRST AVENUE SUB-DISTRICT STANDARDS.

   (a)   Purpose. The First Avenue sub-district is hereby created to address the unique and inconsistent development setbacks occurring on those properties fronting along First Avenue between the Corporation Line and the intersection of First Avenue and Eastland Road.
   (b)   Existing Setbacks Maintained.
      (1)   In the event of full or partial building destruction or redevelopment of a property, the building and parking area setbacks existing at the time of destruction or redevelopment may be maintained.
      (2)   Reconstructed buildings and parking areas may not encroach into the setback areas existing at the time of destruction or redevelopment.
