CHAPTER 1135

Public - Institutional Zoning District

1135.01 ZONING DISTRICT PURPOSE.

   The Public - Institutional zoning district is established for the following purposes:
   (a)   To ensure that the public, quasi-public, and institutional use of property is related to the purposes and policies of the general plan and the public/quasi-public land use classification contained in the Middleburg Heights Master Plan.
   (b)   To recognize the public, quasi-public, and institutional nature of particular parcels of land and provide standards and guidelines for their continued use and future development.
   (c)   To ensure that the public, quasi-public, and institutional structures and developments in the district will be compatible with surrounding districts and uses.

1135.02 PERMITTED USES.

   (a)   Land uses permitted by right in the P-I zoning district are provided for in the Land Use Matrix Chart found in Section 1129.07.
   (b)   Any land use not designated as a permitted use for the zoning districts as P-I provided for in the Land Use Matrix Chart shall not be permitted in those respective districts.

1135.03 CONDITIONAL USES.

   (a)   Conditionally permitted land uses in the P-I zoning district are provided for in the Land Use Matrix Chart found in Section 1129.07.
   (b)   All conditional uses provided for in the Land Use Matrix Chart shall comply with the regulations and procedures set forth in the Conditional Use Chapter 1143.

1135.04 ACCESSORY USES.

   (a)   Accessory uses, buildings or other structures customarily incidental to any permitted or conditionally permitted use in the P-I zoning district may be established, erected or constructed; provided, that such accessory use shall not involve the conduct of any business, trade or industry, or any private activity that is otherwise not permitted within this zoning district.
   (b)   Accessory uses shall comply with the applicable procedure and standards as set forth in the Accessory Use Chapter 1141.
   (c)   Accessory use structure placement and setbacks shall also comply with the bufferyard requirements set forth in Section 1151.04.

1135.05 DEVELOPMENT PLAN REVIEW.

   Development plan review procedure. Development proposals brought under the P-I zoning district shall follow the preliminary and final development plan procedure set forth in Chapter 1147.

NOTES:
(a) Principal hospital structures shall not exceed a height of one hundred feet.
(b) Senior care facility shall not exceed a height of sixty feet.
(c) Accessory use structures are prohibited in a front yard.
(d) Building placement and setbacks shall also comply with the bufferyard requirements set forth in Section 1151.04.

1135.07 SUPPLEMENTAL DEVELOPMENT STANDARDS.

   (a)   Every permitted use of land and structures in the P-I zoning district shall be located on a lot in such a manner as to create and preserve a front yard adjacent to each street on which such lot abuts, a side yard or yards and (except in the case of corner or through lots) a rear yard, conforming to the requirements of this chapter (the “required yards”).
   (b)   Front Yard Setback Measurement. Building setbacks are measured from the public street right-of-way or measured from the nearest edge of pavement for private drives.
   (c)   Side and Rear Yard Standards for Accessory Uses. Permitted accessory uses, driveways, parking areas serving the principal structure and other permitted ancillary uses may be located within the side or rear yard subject to all applicable regulations set forth in Chapter 1141 .
      (1)   Driveways and parking areas shall be located not less than ten feet from an adjacent property boundary line of any residential zoning district or residential land use.
      (2)   Permitted accessory uses shall be located no closer than thirty feet from an adjacent property boundary line of any residential zoning district or residential land use. Planning Commission may require additional screening and buffering features for accessory uses determined to have the potential to adversely impact adjacent residential zoning districts and land uses.
      (3)   Recreation use areas shall be located not less than fifty feet from an adjacent property boundary line of any residential zoning district or residential land use. City Council may require additional screening and buffering features for recreation uses or areas determined to have the potential to adversely impact adjacent residential zoning districts and land uses.
   (d)   Projections Into Yards. As used in this chapter, “projection” means that part or feature of a building which extends or projects outside of the enclosing walls. It is intended that certain features may project into the yards required in the P- I zoning district, but such features shall be regulated so as not to substantially interfere with the reception of sun, light, air and the use of adjacent lots. Building features may project into a front, side, or rear yard measured from the established yard line, as follows:
      (1)   Architectural features extending not more than one foot into a required yard.
      (2)   Awnings and canopies.
      (3)   Window air conditioners.
      (4)   Chimneys projecting no more than three feet into a required yard.
      (5)   Eaves, gutters and downspouts projecting no more than sixteen inches into a required yard.
      (6)   Walls and fences subject to the regulations set forth in Section 1157.05.
      (7)   Steps - excluding fire escapes.
      (8)   Pedestrian sidewalks.
      (9)   Vehicular access, circulation and service driveways, and off-street parking areas (but not including any above-ground structure except a pavement, curbing and illumination).
      (10)   Signs, subject to the applicable regulations set forth in Chapter 1153.
   (e)   Height Standards.
      (1)   Roof Mounted Building Elements. A chimney, spire, cupola, tower, flagpole, water tank, antenna, monument or similar ancillary appurtenance, constructed upon a roof of a principal structure, shall not exceed fifteen feet in height.
      (2)   Ground Mounted Elements. A chimney, tower, flag pole, water tank, radio or television antenna, monument or similar ancillary appurtenance, constructed upon the upon a finished grade, whether it constitutes an integral part of the building or not, shall not exceed fifty feet above the average finished grade of the site.
      (3)   Roof Mounted Mechanical Equipment. Mechanical equipment placed on the building roof may be allowed above the maximum building height specified, provided such mechanical equipment is:
         A.   Set back a minimum of fifteen feet from any exterior wall.
         B.   Not more than eight feet in height.
         C.   All applicable mechanical equipment standards set forth in Section 1137.10 shall apply.

1135.08 SITE DESIGN GUIDELINES.

   (a)   Site Design Guidelines. All applicable site design standards as provided for in Section 1137.09 shall apply to projects in the P-I zoning district. In the event of conflicting standards between this Section 1135.08 and Section 1137.09 , the standards set forth in this Section 1135.08 shall control.
   (b)   Parking. All applicable off-street parking requirements for the P-I zoning district shall be in accordance with Chapter 1149 .
   (c)   Landscaping. The entire development site shall be landscaped with a combination of trees, shrubs and grass following the procedures and guidelines set forth in Chapter 1151 .
   (d)   Lighting.
      (1)   In the P-I zoning district, floodlighting or any other outdoor lighting of a sports field, building, bulletin board, parking area or other outdoor lighting shall be located and designed so as to shield the light source from any adjoining residential land uses or residential zoning district. All lighting, with the exception of general building, parking lot and walkway lighting, shall be extinguished between 11:00 p.m. and 7:00 a.m. of the following day, unless otherwise approved by the Planning Commission.
      (2)   The lighting standards set forth in Section 1137.09(j) and Section 1147.07 shall be satisfied.
   (e)   Loading and Unloading. All loading and unloading operations shall be conducted in the rear or side of the building and shall be sufficiently screened from view from any public or private roadway and the adjoining properties as determined by Planning Commission to be necessary to conceal the loading and unloading operations from public or private view.

1135.09 ARCHITECTURAL DESIGN GUIDELINES.

   The architectural design guidelines set forth in Section 1137.10 of this Zoning Code shall apply to all applicable new building and expansion projects in this Public - Institutional zoning district. The review of these architectural design standards shall take place in conjunction with the Development Plan review procedure.
