CHAPTER 16

01 INTENT AND PURPOSE

16.01.010 Intent And Purpose

It is the intent and purpose of the City Council of Midway City, Utah, to promote the health, safety, morals, convenience, order, prosperity, and general welfare of the present and future inhabitants of the City by guiding development within the City in accordance with a comprehensive plan prepared and adopted by the City to accomplish the following:

  1. Encourage and facilitate orderly growth and development in the City.
  2. Facilitate adequate provision for transportation, trails, water, sewage, schools, parks, and other public services.
  3. Promote sanitation and health of the inhabitants.
  4. Promote safety from fires, floods, traffic hazards, and other dangers.
  5. Discourage the overcrowding of land and undue concentration of population.
  6. Discourage undue scattering of population and unnecessary expenditure of monies for excessive streets, water and sewer lines, and other public services.
  7. Stabilize and improve property values.
  8. Protect the residents from objectionable noise, odor, dust, fumes, and other deleterious substances or conditions.
  9. Promote a more attractive and wholesome environment.
  10. Promote the inclusion of a variety of household types, age groups, and income levels.
  11. Promote the historic downtown area with shops and workplace in close proximity to each other, the scale of which accommodates pedestrian travel for trips within the community.
  12. Promote the retention of Midway City’s rural atmosphere and preserve a variety of types of open spaces, scenic vistas, agricultural lands, and natural areas.

16.01.020 Application

The regulations and restrictions as set forth in this Title shall be so interpreted and applied as to further the purposes of this Title.

16.01.030 Declaration

In establishing the zones, the boundaries thereof, and regulations and restrictions applying within each of the zones, due and careful considerations was given, among other things, to the suitability of the land for particular uses, and to the character of the zone, with a view to conserving the value of buildings and encouraging the most appropriate use of land throughout the City.

16.01.040 Interpretation

In interpreting and applying this Title, the provisions thereof shall be held to be the minimum requirements adopted for the promotion of the public health, safety, comfort, convenience, and general welfare. In the case that this Title imposes a greater restriction than is imposed or required by other existing provisions of law or ordinance, then in such case the provisions of this Title shall control.
