CHAPTER 1153

M-1 Industrial District

1153.01 PERMITTED, ACCESSORY AND CONDITIONAL USES.

   The following regulations and the regulations contained in Chapter 1137 shall apply in M-1 Industrial Districts.
   (a)   Principal Permitted Uses.
      (1)   Only the industrial uses listed immediately below shall be permitted in any M-1 District. All business functions shall be restricted unless approved by the Board of Zoning Appeals.
      (2)   Creamery, bottling, ice manufacturing and cold storage plants.
      (3)   The manufacturing, compounding, assembling or treatment of articles or merchandise from previously prepared materials such as cloth, cork, fiber, leather, paper, plastics, metals or stones, tobacco, wax, yarns and wood.
      (4)   Manufacture of musical instruments and novelties.
      (5)   The manufacture or assembly of electrical appliances, instruments and devices.
      (6)   Laboratories - experimental, film or testing.
      (7)   Circus, carnival or similar transient enterprise, provided that such structures or buildings shall be at least 200 feet away from any R District.
      (8)   Any other use that is determined by the Board of Zoning Appeals, as provided in Section 1161.09(b) to be of the same general character as the above permitted uses.
   (b)   Accessory Uses. Any accessory uses customarily accessory and incidental to a permitted use.
   (c)   Conditional Uses Requiring Approval of Board of Zoning Appeals.
      (1)   Outdoor advertising.
      (2)   Food processing.
      (3)   Restaurants.

1153.02 PERFORMANCE STANDARDS.

   (a)   All uses specified in Section 1153.01 shall be conducted wholly within a completely enclosed building, except for parking, loading and unloading facilities, unless otherwise regulated by the Board of Zoning Appeals.
 
   (b)   No use shall be permitted or established or maintained which by reason of its nature or manner of operation is or may become hazardous, noxious or offensive owing to the emission of odor, dust, smoke, cinders, gas fumes, noise, vibration, refuse matter or water-carried waste.

1153.03 HEIGHT RESTRICTIONS.

   No structure shall exceed three stories or fifty feet in height except as provided in Section 1157.03(a).

1153.04 YARD REQUIREMENTS.

   The following requirements shall be observed subject to the modified requirements contained in Section 1157.03:
