CHAPTER 9

PLANNED UNIT DEVELOPMENTS

10-9-1: PUD REQUIREMENTS:

The provisions of this chapter pertaining to planned unit development are to be applied in instances where tracts of land of considerable size are developed, redeveloped or renewed as integrated and harmonious units and where the overall design of such units is so outstanding as to warrant modification of the standards contained elsewhere in this title. Regulations pertaining to each planned unit development (PUD) are contained in the ordinance creating the PUD. To be eligible under this chapter, a planned unit development must be:
   A.   Composed of such stated uses and in such proportions as are most appropriate and necessary for the integrated functioning of the planned development within the city's zoning jurisdiction and its environs; and
   B.   So designed in its space allocation, orientation, texture, materials, landscaping and other features as to produce an environment of stable and desirable character, complementing the design and values of the surrounding neighborhood and showing such unusual merit as to reflect credit upon the developer and upon the community; and
   C.   The tract must have a minimum of one acre in the case of residential and five (5) acres in all other cases. (Ord. 2408, 10-1-2012)
Adopted planned unit development districts may be identified by legal descriptions that may have been platted or replatted subsequent to the original adoption of the districts. The uses listed in the respective districts may not be specifically defined in section 10-2-2 of this title. Therefore, similar terms listed in section 10-2-2 of this title or commonly used definitions from a standard English dictionary or other recognized sources may be used to determine the definitions of uses listed in the district. 10-9A-1: LEGAL DESCRIPTION:

That part of the Southwest Quarter (SW 1/4) of Section Twenty-Six (26), Township One Hundred Three (103) North, Range Sixty (60), West of the 5th P.M., City of Mitchell, Davison County, South Dakota, lying east of the Chicago and Milwaukee Railroad Right-of-Way and south of Interstate 90.

10-9A-2: PURPOSE:

This area is intended to provide for educational, office and limited commercial uses, to accommodate postsecondary education and its related growth and the associated management, marketing, and production of the needs of enterprises in the planned development district. (Ord. 2408, 10-1-2012)

10-9A-3: SCOPE OF REGULATIONS:

The regulations set forth in this article or set forth elsewhere in the zoning code when referred to in this article are the district regulations that shall govern the Mitchell Technical Institute planned development (PD), planned development district. (Ord. 2408, 10-1-2012)

10-9A-4: PERMITTED USES:

The permitted uses within this planned development district shall be as follows:
All permitted and conditional uses of public lands and institutions district.
A multiuse, general purpose facility for use for exhibitions, trade fairs, and expositions.
A retail store(s), eating establishment(s) and healthcare facilities.
Daycare centers and nursery schools.
Educational and training facilities.
General storage and warehousing including outside storage, which is accessory to permitted use, protected by a tight screening fence of ten feet (10').
Light industrial and assembly plants.
Multi-family dwellings.
Parking lot and ramp.
Private lakes.
Professional or office buildings.
Utility power stations or substations including satellite antennas and towers not over one hundred feet (100') high. (Ord. 2408, 10-1-2012)

10-9A-5: CONDITIONAL USES:

Uses not specifically listed above and which are within the scope of the heretofore stated purpose of this planned development as are necessary for said purpose shall be conditional uses. (Ord. 2408, 10-1-2012)

10-9A-6: ACCESSORY USES:

Accessory uses and buildings permitted are those accessory uses and buildings customarily incidental to permitted uses and conditional uses in this district and including elevated and enclosed walkways. (Ord. 2408, 10-1-2012)

10-9A-7: PARKING REGULATIONS:

Parking shall be regulated in conformance with this title. (Ord. 2408, 10-1-2012)

10-9A-8: SIGN REGULATIONS:

Signs shall be regulated in conformance with title 9, chapter 4 of this code. (Ord. 2512, 4-6-2015)

10-9A-9: MAXIMUM COVERAGE:

Structures shall be in conformance with percentage of lot coverage of the public lands and institutions district. (Ord. 2408, 10-1-2012)

10-9A-10: MINIMUM YARD REQUIREMENTS:

Front yard, back yard, side yard, and side yard on corner lot setback requirements shall be in conformance with standards set forth and provided for in the PL public lands and institutions district. (Ord. 2408, 10-1-2012)

10-9B-1: LEGAL DESCRIPTION:

This area is intended to provide residential opportunities and provide for densities, which reflect both the cost and best utilization of land. (Ord. 2408, 10-1-2012)

10-9B-3: SCOPE OF REGULATIONS:

The regulations in this article or set forth elsewhere in the zoning code when referred to in this article are the district regulations that shall be governed by the Woodland Heights planned development district.
   A.   Subarea A: Also known as lots 1-6, block 1, Woodland Heights First Addition, city of Mitchell, Davison County, South Dakota.
      1.   Permitted Uses:
   Accessory buildings.
   Two-family dwellings.
      2.   Conditional Uses:
   Home occupations.
      3.   Parking Regulations: Parking shall be regulated in conformance with this title. (Ord. 2408, 10-1-2012)
      4.   Sign Regulations: Sign regulations shall be in conformance with title 9, chapter 4 of this code. (Ord. 2512, 4-6-2015)
      5.   Maximum Building Height: No principal building shall exceed two and one-half (21/2) stories or thirty five feet (35') in height and no accessory building shall exceed one story or seventeen feet (17') in height.
      6.   Maximum Coverage: No more than forty five percent (45%) of the lot area shall be covered by structures.
      7.   Accessory Buildings: Accessory buildings shall not exceed one thousand fifty (1,050) square feet.
      8.   Minimum Lot Area And Width: The minimum lot area shall be at least ten thousand (10,000) square feet and minimum lot width of seventy feet (70').
      9.   Minimum Yard Requirements (Setbacks):
         a.   Front yard: Thirty feet (30').
         b.   Back yard: Thirty feet (30').
         c.   Side yard: Six feet (6').
         d.   Side yard of corner lot: Fifteen feet (15').

   Home occupations.
   Multi-family dwelling twelve (12) units or more.

      4.   Sign Regulations: Sign regulations shall be in conformance with title 9, chapter 4 of this code. (Ord. 2512, 4-6-2015)
      5.   Maximum Building Height: No principal building shall exceed six (6) stories or sixty five feet (65') in height and no accessory buildings shall exceed one story or seventeen feet (17') in height.
      6.   Maximum Coverage: No more than seventy five percent (75%) of the lot area shall be covered by structures.
      7.   Minimum Lot Area And Width: The minimum lot area shall be at least ten thousand (10,000) square feet and minimum lot width of seventy feet (70').
      8.   Minimum Yard Requirements (Setbacks):
         a.   Front yard: Thirty feet (30').
         b.   Back yard: Thirty feet (30').
         c.   Side yard: Six feet (6').

10-9C-2: PURPOSE:

This area is intended to provide residential with accessory opportunities and provide for densities, which reflect both the cost and best utilization of the real property. (Ord. 2408, 10-1-2012)

10-9C-3: SCOPE OF REGULATIONS:

The regulations in this article or set forth elsewhere in the zoning code when referred to in this article are the district regulations that shall be governed by the CJM Second Addition planned development district.
   A.   Permitted Uses:
Accessory buildings.
Single-family dwellings.
Storage building.
   B.   Conditional Uses:
Home occupations.
   C.   Maximum Building Height: No principal building shall exceed two and one-half (21/2) stories or thirty five feet (35') in height and no accessory building shall exceed twenty three feet (23') in height.
   D.   Minimum Lot And Width: The minimum lot area shall be at least twenty five thousand (25,000) square feet and minimum lot width of one hundred feet (100').
   E.   Minimum Yard Requirements (Setbacks):
      1.   Front yard: Thirty feet (30').
      2.   Back yard: Thirty feet (30').
      3.   Side yard: Eight feet (8').
      4.   Side yard of corner lot: Twenty feet (20').
   F.   Other Regulations:
      1.   Municipal water will be available by developer.
      2.   Municipal sewer services will not be available by the developer.
      3.   Roads/streets will be installed to standards to comply with rural road classification. The roads/streets will be paved once fifty percent (50%) of the lots are developed and costs are to be assessed to the property owners.
      4.   Dwelling building permits will not be issued until water utilities, road/streets, drainage are installed and comply with standards set forth by the city of Mitchell. (Ord. 2408, 10-1-2012)

10-9D-1: LEGAL DESCRIPTION:

Lot S, Maui Farms Second Addition, A Subdivision of the Southeast Quarter (SE 1/4), Section 31, and Previously Platted Lot 4 in the East 1/2 of the West 1/2 of Section 31, Township 104 North, Range 60 W of the 5th P.M., Portions of which lie within the city limits of Mitchell, Davison County, South Dakota and Blocks 1 and 2 of Maui Farms Second Addition and a portion of Sam Street, a subdivision of previously platted lot 4 in the East 1/2 of the West 1/2 of Section 31, T 104 N, R 60 W of the 5th P.M., Davison County, South Dakota. 10-9D-2: PURPOSE:

This area is intended to provide storage facilities for noncommercial activities and services. (Ord. 2408, 10-1-2012)

10-9D-3: SCOPE OF REGULATIONS:

The regulations in this article or set forth elsewhere in the zoning code when referred to in this article are the district regulations that shall be governed by the Lot S, Maui Farms Second Addition planned development.
   A.   Permitted Uses: Structures constructed for the sole purpose of storage. The structures may not be used for retail, wholesale, services and other commercially related activities. All items to be stored shall be enclosed within the buildings.
   B.   Prohibited Uses:
Bulk chemical storage, which is determined by the city to be a potential threat to the drinking water supply (Lake Mitchell).
Bulk fertilizer storage.
Bulk herbicide and pesticide storage.
Facilities that store chemicals in excess of any of the limits established under section 302, section 304, CAA 112 (r), and section 313 listed in the latest published edition of the title III (SARA and clean air act amendments) list of lists (consolidated lists of chemicals) subject to the emergency planning and community right-to-know act (EPCRA) and section 112 (r) of the clean air act, as amended.
Fuel storage over one hundred (100) gallons.
Residential structures for human habitation.
Sheltering animals.
   C.   Sign Regulations: There shall be no signs placed on the property or structure, with the exception of addresses and/or emergency response identification.
   D.   Minimum Yard Requirements (Setbacks):
      1.   Front yard: Twenty five feet (25').
      2.   Back yard: Twenty five feet (25').
      3.   Side yard: Five feet (5').
   E.   Maximum Height Requirement: Twenty six feet (26').
   F.   Appearance Standards: The exterior walls and roof shall not have the appearance of galvanized steel. (Ord. 2408, 10-1-2012)

This area is to provide single- and multi-family residential opportunities and provide for a variety of densities and uses compatible with residential development. (Ord. 2411, 10-15-2012)

10-9E-3: SCOPE OF REGULATIONS:

The regulations in this article or set forth elsewhere in this title, when referred to in this article, are the district regulations of the South Point Village planned development district. (Ord. 2411, 10-15-2012)

10-9E-4: PERMITTED USES:

Assisted living facility up to twenty four (24) units.
Community center, privately owned or operated.
Educational institution.
Lodging house.
Multi-family dwellings
Open space.
Parks and playgrounds.
Recreation indoor facility.
Recreation outdoor facility.
Religious institution.
Single-family dwellings.

10-9E-5: CONDITIONAL USES:

Bed and breakfast.
Childcare center (preschool, nursery).

10-9E-6: PARKING REQUIREMENTS:

Parking shall be regulated in conformance with the provision of this title, unless otherwise indicated in this article. The total parking required in each parcel may be provided off site; however, parking dedicated to serve the residents and visitors to the South Point Village development district must be within the boundaries of the district.
Parking in the front yard and side yard setbacks along public streets, private streets and private drives will be permitted.
Parking will be provided for each lot's uses by a combination of garage spaces for the residential component and on site and off site parking. (Ord. 2411, 10-15-2012)

Notes:
    1.    For each additional unit over 4 units add 800 square feet to the minimum zoning lot area and 75 feet shall be the minimum lot width.
    2.    In the R-4 district, no building shall exceed 6 stories or 65 feet in building height; except, that 1 foot of height may be added to the building for each foot that the building is set back from the required front yard.
    3.    A zero lot line in the event the townhomes are ever subdivided and sold as condominiums.
   A.   Accessory Buildings:

      3.   An accessory building shall not be permitted in any required front yard and no separate accessory building shall be erected within three feet (3') of any principal building's line.
      4.   Accessory buildings shall be at least three feet (3') from zoning lot lines of adjoining lots with the footage to be measured from the overhang building line. On a corner lot they shall conform to the setback requirements on the side street, except in the case of an accessory structure door parallel to the alley, the minimum yard requirement setback shall not be less than sixteen feet (16'). 10-9E-9: OTHER REGULATIONS:

   A.   Residential accessory buildings and uses are permitted.
   B.   Accessory buildings and uses for approved conditional uses are permitted.
   C.   Development shall coincide with completion of proper municipal street and utility improvements.
   D.   Private walking trails are permitted.
   E.   Standards that are set forth in the city of Mitchell subdivision regulations with regards to installation of public improvements within the public rights of way may be waived upon a written agreement between the developer and the city council. (Ord. 2411, 10-15-2012)

10-9F-1: LEGAL DESCRIPTION:

   A.   The following real property's district classification legally described by Block 3, except the West 108 feet of the North 150 feet thereof; Lot 4B except the North 150 feet thereof, Block Four, Morningview Addition, City of Mitchell, Davison County, South Dakota be changed from single-family residential (R2) district to a planned unit development (PD) known as Mueller Lumber Morningview Subdivision.
   B.   The following real property's district classification legally described by Block 5, except Lot H1 thereof, Morningview Addition, City of Mitchell, Davison County, South Dakota be changed from transportation, warehousing, and commercial (TWC) district to a planned unit development (PD) known as Mueller Lumber Morningview Subdivision. 10-9F-2: PURPOSE:

This planned development district is intended to provide residential opportunities and provide for a variety of densities which provide the efficient and diverse utilization of land. (Ord. 2430, 4-1-2013)

10-9F-3: SCOPE OF REGULATIONS:

The regulations in this article or set forth elsewhere in this title when referred to in this article are the district regulations that shall be governed by the Mueller Lumber Morningview Subdivision.
   A.   Subarea A:
      1.   Permitted Uses:
Open spaces.
Parks and playgrounds.
Single-family dwellings.
Two-family dwellings.
      2.   Conditional Uses:
Family residential care.
Family residential daycare.
Residential care.
      3.   Accessory Uses:
Accessory buildings for permitted and conditional uses.
Home occupations, unless the criteria set forth in section 10-5G-2 of this title is not met. Note also subsection 10-5G-3A of this title.
      4.   Parking Regulations: Parking within the planned development shall comply with this title.
      5.   Sign Regulations: The placement and installation of signs shall comply with title 9 of this code.
      6.   Maximum Building Height:
         a.   No principal building shall exceed two and one-half (21/2) stories or thirty five feet (35') in height.
         b.   No accessory building shall exceed twenty feet (20') in height.
      7.   Maximum Coverage:
         a.   No more than forty five percent (45%) of the zoning lot area shall be covered with structures.
         b.   No accessory building shall exceed one thousand two hundred fifty (1,250) square feet in area.
      8.   Minimum Lot Area And Width: The minimum zoning lot area shall be no less than ten thousand (10,000) square feet and a minimum zoning lot width of eighty five feet (85').

         a.   No more than sixty percent (60%) of the zoning lot area shall be covered with structures.
         b.   No accessory building for single-family residential shall exceed one thousand two hundred fifty (1,250) square feet in area.
         c.   Accessory buildings for two (2) or more family dwelling units shall not exceed more than four hundred (400) square feet per dwelling unit.
      8.   Minimum Lot Area And Width: The minimum zoning lot area shall be no less than nine thousand (9,000) square feet and a minimum zoning lot width of eighty feet (80').
      9.   Minimum Yard Requirements:
         a.   Front yard: Twenty five feet (25').
         b.   Back yard: Twenty five feet (25').
         c.   Side yard: Eight feet (8').
         d.   Side yard on a corner: Fifteen feet (15').
   D.   Subarea D:
      1.   Permitted Uses:
Open spaces.
Parks and playgrounds.
Single-family dwellings.
Two-, three- or four-family dwellings.
      2.   Conditional Uses:
Automotive detailing.
Childcare, preschool, nursery.
Coffeehouse.
Convenience store.
Family residential care.
Family residential daycare.
Five- to twelve-family dwellings.
Personal service facility.
Residential care.
Retail services and trade (footprint of principal structures 5,000 square feet or less).
Structures constructed for the sole purpose of personal or household storage.
         a.   Retail, wholesale or commercial related activities are prohibited.
         b.   Exterior walls and roofs shall be constructed with materials typically installed on single- family residential properties.
Student housing (off campus).

      3.   Accessory Uses:
Accessory buildings for permitted and conditional uses.
Home occupations, unless the criteria set forth in section 10-5G-2 of this title is not met. Note also subsection 10-5G-3A of this title.
      4.   Parking Regulations: Parking within the planned development shall comply with this title.
      5.   Sign Regulations: The placement and installation of signs shall comply with title 9 of this code.
      6.   Maximum Building Height:
         a.   No principal building shall exceed three (3) stories or forty five feet (45') in height.
         b.   No accessory building shall exceed twenty feet (20') in height.
      7.   Maximum Coverage:
         a.   No more than sixty percent (60%) of the zoning lot area shall be covered with structures.
         b.   No accessory building for a single-family residential dwelling shall exceed one thousand two hundred fifty (1,250) square feet in area.
         c.   Accessory buildings for two (2) or more family dwelling units shall not exceed more than four hundred (400) square feet per dwelling unit.
      8.   Minimum Lot Area And Width: The minimum zoning lot area shall be no less than nine thousand (9,000) square feet and a minimum zoning lot width of eighty feet (80').
      9.   Minimum Yard Requirements:
         a.   Front yard: Twenty five feet (25').
         b.   Back yard: Twenty five feet (25').
         c.   Side yard: Eight feet (8').
         d.   Side yard on a corner: Fifteen feet (15'). (Ord. 2430, 4-1-2013)

10-9F-4: SUPPLEMENTAL REGULATIONS:

   A.   No structure shall be permitted to be constructed with a post from method of square or round poles in the ground (commonly known as "pole barns").
   B.   No structure shall be permitted to be finished on the exterior roof or walls with light gauge metal panels, vertical or horizontal, galvanized or colored metal.
   C.   All accessory buildings shall have the same exterior finish as the principal residence. If the principal residence is masonry brick, stone or stucco, the accessory building may use wood or vinyl siding on the walls in lieu of masonry brick, stone or stucco. (Ord. 2553, 10-17-2016)

10-9G-3: SCOPE OF REGULATIONS:

The regulations in this article or set forth elsewhere in this title, when referred to in this title, are the district regulations of the CJM Second Addition Planned Development District Number Two.
   A.   Permitted Uses:
Accessory buildings.
Single family dwellings.
Storage buildings.
   B.   Conditional Uses:
Home occupations.
   C.   Maximum Building Height: No principal building shall exceed two and one-half (21/2) stories or thirty five feet (35') in height and no accessory building shall exceed twenty three feet (23') in height.
   D.   Minimum Lot And Width: The minimum lot area shall be at least twenty five thousand (25,000) square feet and minimum lot width of one hundred feet (100').
   E.   Minimum Yard Requirements (Setbacks):
      1.   Front yard: Thirty feet (30').
      2.   Back yard: Thirty feet (30').
      3.   Side yard: Eight feet (8').
      4.   Side yard on a corner lot: Twenty feet (20').
      5.   Lot coverage shall be no less than forty five percent (45%).
   F.   Other Regulations:
      1.   Municipal water service will be available by the developer.
      2.   Municipal sewer service will not be available by the developer.
      3.   Roads/streets will be installed to standards to comply with rural road classification. The roads/streets will be paved once fifty percent (50%) of the lots are developed and costs are to be assessed to the property owners.
      4.   Building permits will not be issued until water utilities, roads/streets, drainage are installed to the lot and comply with the standards set forth by the City of Mitchell.
      5.   No person shall keep any horse, cow, goat or sheep or erect or maintain any building or enclosure. No person shall allow any ducks, geese, chickens or other domestic fowl to run at large, nor shall any person keep enclosed or housed any domestic fowl. (Ord. O2017-07, 6-5-2017)

The regulations in this article or set forth elsewhere in Title 10 of the City of Mitchell Municipal when referred to in this article are the district regulations that shall be governed by the Lakeridge Planned Development District.
   A.   Permitted Uses:
      1.   Single Family Dwellings.
      2.   Designated Open Space.
      3.   Parks and Playground.
   B.   Conditional Uses:
      1.   Home Occupations that do not comply with section 10-5G-2.
      2.   Childcare, Family residential.
   C.   Accessory Uses:
      1.   Home Occupations that do comply with section 10-5G-2.
      2.   Detached accessory buildings and structures commonly referred to garages.
   D.   Parking Regulations shall be regulated according to existing code within Title 10.
   E.   Sign Regulations shall be regulated according to Title 9.
   F.   Maximum Building Height: No principal building shall exceed two and one half (2 ½) stories or thirty-five feet (35') in height and no detached accessory building shall exceed twenty-two feet (22') in height.
   G.   Maximum Coverage: No more than forty-five percent (45%) of the zoning lot shall be covered with structures that have a roof.
   H.   Accessory Buildings: Detached accessory buildings shall not exceed two thousand (2,000) square feet.
   I.   Minimum Zoning Lot Area and Width: The minimum zoning lot area shall be at least ten thousand (10,000) square feet and the minimum zoning lot width of not less than seventy feet (70').
   J.   Minimum Yard Requirements (Setbacks):
      1.   Front Yard: Thirty feet (30').
      2.   Back Yard: Thirty feet (30').
      3.   Side Yard: Six feet (6').

   C.   Minimum Yard Requirements (Setbacks):
      1.   Front yard: Fifteen feet (15').
      2.   Rear yard: Twenty-five feet (25').
      3.   Side yard: Three feet (3').
      4.   Side yard on a corner lot: Fifteen feet (15').

10-9I-6: ACCESSORY BUILDINGS:

   A.   No accessory building will be erected in the front yard.
   B.    No accessory building shall exceed twenty-two feet (22') in height.
   C.    No separate accessory building shall be erected within three feet (3') of any principal building's line.
   D.    Accessory buildings shall be at least three feet (3') from zoning lot lines of adjoining lots, with the footage to be measured from the overhang building line.
