CHAPTER 11

OFF STREET PARKING AND LOADING

11-11-1: GENERAL PROVISIONS:

   A.   Application Of Provisions: The provisions of this chapter shall apply in all zoning districts.
   B.   Responsibility To Provide Off Street Parking: The duty to provide and maintain off street parking space shall be the joint and shared responsibility of the operator and owner of the use or uses for which off street parking is required.
   C.   Effective Provisions: For all uses that are lawfully occupied, operated or possessing a valid business license or building permit on the effective date hereof, the provisions of the ordinance effective at the date of their establishment shall apply.
   D.   Changing Or Enlarging Use: If such uses are enlarged, expanded or changed, the owner of such use shall provide the amount of parking required by the provisions of this chapter, and such parking shall meet all requirements in this chapter. If the zoning administrator determines that such compliance is clearly not possible, the owner shall only be responsible for providing the amount of parking such increment of expansion would require if it were a separate use.
   E.   Newly Established Uses: For all uses established or placed into operation after the effective date hereof, there shall be provided and maintained the amount of off street parking hereinafter set forth.
   F.   Garages Or Outdoor Areas: Parking and loading spaces for all uses may be provided either in garages or outdoor parking areas conforming with the provisions of this chapter.
   G.   Charging Optional: Parking may be with or without charge.
   H.   Front Yard Parking: With the following exceptions, no vehicle shall be parked in a required front yard:
      1.   The parking is accessory to residential uses within a residential district.
      2.   The board of trustees has approved a front yard parking lot, provided such lot is not located in an area of the front yard that is required to be landscaped or devoted to another specifically required use. (Ord. 961, 2-12-1997, eff. 2-22-1997)

11-11-2: DEVELOPMENT AND MAINTENANCE:

With the exception of parking accessory to single- and two-family residences, every parcel of land hereafter used as a public or private parking area, including commercial parking lots and outdoor motor vehicle or recreational vehicle (trailers, mobile home, boats) sales lots shall be designed, developed and maintained in accordance with the following requirements:
   A.   Site Plan Required: A plan detailing the number configuration of parking spaces, points of ingress and egress, areas to be landscaped, and construction specifications shall be submitted to the zoning administrator who will forward such plans to the director of public works for approval. When a site plan has been submitted and approved by the zoning board of appeals and the board of trustees in accordance with other provisions of this chapter, a parking plan will not be required.
   B.   Construction Standards: All off street parking areas and entrances to such areas shall be constructed to the following standards:
      1.   Industrial And Heavy Commercial Uses:
      10 inch compacted aggregate base
      11/2 inch bituminous binder course
      11/2 inch bituminous surface course
Heavy commercial uses shall be those uses that have a regular traffic of vehicles in excess of four thousand (4,000) pounds.
      2.   All Other Uses:
      8 inch compacted aggregate base
      11/2 inch bituminous binder course
      1 inch bituminous surface course
   C.   Grading For Drainage: All parking areas shall be graded for proper drainage.
   D.   Ingress And Egress: All points of ingress and egress to public rights of way shall be between twenty feet (20') and thirty five feet (35') wide, except in the C-3 district. Any curb cuts for the purpose of providing ingress and egress are subject to all relevant state, county and village requirements and shall be reviewed and approved by the village zoning board of appeals.
   E.   Fencing: Off street parking areas for more than four (4) vehicles that are adjacent to residential districts shall provide an opaque fence, wall, hedge, or earth berm of between five feet (5') and eight feet (8') in height between the parking area and the boundary adjacent to residential districts.
   F.   Aisle Width: Each off street parking space shall open directly upon an aisle or driveway at least twelve feet (12') wide to provide safe and efficient means of vehicular access to such parking space.
   G.   Space Dimensions: Each required parking space shall be at least nine feet (9') in width and at least twenty feet (20') in length, exclusive of access driveways, aisles, ramps or any use other than parking. Each space shall have a vertical clearance of seven feet (7'). For parallel parking, the length of the parking space shall be increased to twenty four feet (24').
   H.   Defining Of Spaces: Each parking space shall be defined by the use of painted lines, curbing, wheel or bumper guards, suspended ropes or chains, landscaping or some similar device.
   I.   Lighting At Nighttime: Parking areas regularly used during nighttime hours shall be provided with lighting to enable safe access to parked vehicles. Such lighting shall be so arranged so as not to exceed three (3) foot-candles measured at the lot line.
   J.   Attendant Shelter Building: No parking area shall have more than one attendant shelter building, which must conform to all the yard requirements of the district in which it is located.
   K.   Determination Of Number Of Spaces:
      1.   When determination of the number of off street parking spaces required by this title results in the requirement of a fractional space, a fraction of less than one-half (1/2) may be disregarded, while a fraction of one-half (1/2) or more shall be counted as one parking space.
      2.   Employee parking space requirements shall be based on the average number of employees at work during normal business hours.
   L.   Surface Maintenance: Each parking surface shall be continuously maintained to be free from potholes or other deterioration of the surface, trash, debris or other waste materials.
   M.   Location: Except as allowed under the provisions of section 11-11-5 of this chapter, all off street parking shall be located on the same zoning lot or an adjacent zoning lot under common ownership as the lot on which the permitted or special use is located.
   N.   Sharing Spaces: Off street parking areas may share spaces; provided, that there is no conflict in the schedules of those uses sharing any space or spaces. (Ord. 961, 2-12-1997, eff. 2-22-1997)

11-11-5: OFF SITE PARKING; SPECIAL LOCATION AND REQUIREMENTS:

Whenever all or part of the required off street parking is to be located on a lot other than the lot containing a permitted or special use or an adjacent lot under the same ownership, the owner or operator shall submit a special location plan subject to the following conditions:
   A.   Plan Items: The special location plan shall include the following items:
      1.   Number and configuration of parking spaces.
      2.   Points of ingress and egress to the parking area.
      3.   Any uses being conducted on the zoning lot on which the parking is to be located. (Ord. 961, 2-12-1997, eff. 2-22-1997)
      4.   The distance from the lot to the location where the permitted or special use will be conducted. (Ord. 961, 2-12-1997, eff. 2-22-1997; amd. 1999 Code)
      5.   Construction standards, if the lot is not in existence.
   B.   Location Specifications: Off street parking shall be located as hereinafter specified. Where a distance is specified, such distance shall be the walking distance measured from the nearest point of the parking facility to the nearest point of the building that such parking facilities are required to serve.
      1.   Residential Districts: All single- and two-family parking areas shall be on the same lot as the dwelling unit to which such parking areas are accessory. All multi-family parking areas shall be on the same lot or a commonly owned lot of the multi-family buildings to which such parking areas are accessory. The parking areas for all other uses shall be located within one hundred feet (100') of the building they are required to serve.
      2.   Commercial Districts And Industrial Districts: All parking facilities shall be located within three hundred feet (300') of the building they are required to serve.
   C.   Pedestrian Access: There shall be a clear, safe route of pedestrian access between any special location parking and the building to be served.
   D.   Requirements For Issuance: The following steps shall be followed prior to the issuance of a zoning certificate for the permitted or special use requiring the off site parking:
      1.   A plan in accordance with all applicable provisions of this title shall be submitted to the zoning administrator.
      2.   The plan commission shall be responsible for review and approval of all special location plans. Any approval may establish necessary conditions and limitations.
      3.   Upon approval of a special location plan, a copy of such plan shall be registered and recorded among the records of the county recorder of deeds by the village clerk.
      4.   All special plans registered and recorded hereunder shall limit and control the issuance of zoning certificates, building permits and business licenses and shall restrict and limit the use and operation of all land included within such special plans to all conditions and limitations specified in such plans and the approvals thereof.
      5.   All special plans registered and recorded hereunder may be amended pursuant to the same procedure and subject to the same limitations and requirements by which such plans were approved, registered and recorded.
      6.   Upon application to the board of trustees by the owner or owners of the entire area included within any special location plan registered and recorded hereunder, the board of trustees may permit any such plan to be withdrawn either partially or completely from registration and released from recording if arrangements have been to bring all uses into full compliance with the terms of this title without the use of such facilities provided by the special location plan.
      7.   If other provisions of this title require that a site plan be approved by the board of trustees for the permitted or special use requiring a special location plan, the special location plan can be included as a part of the plan. In such case, the board of trustees would review and approve the site plan instead of the plan commission. All other requirements of a special location plan shall be adhered to. 11-11-6: OFF STREET LOADING:

   A.   Loading Berths Required: In connection with any building or structure which is to be erected or substantially altered and which requires the receipt or distribution of materials or merchandise by trucks or similar vehicles, there shall be provided off street loading berths, not less than the minimum requirements specified in this section.
   B.   Location: All loading berths shall be located on the same lots as the use to be served and no portion of the vehicles shall project into a street or alley. In an industrial district, no loading berth for vehicles of more than two (2) ton capacity shall be located less than fifty feet (50') from any residence district. No permitted or required loading berth shall be located within thirty feet (30') of the nearest point of intersection of any two (2) streets, nor shall it be located in a required front yard or side yard. All loading berths shall be screened from abutting residential districts, except when exempted from this provision by the board of trustees upon recommendation by the zoning administrator.
   C.   Size Of Berth: A required off street loading berth shall be at least twelve feet (12') in width by at least seventy feet (70') in length, exclusive of aisle and maneuvering space, and shall have a vertical clearance of at least fourteen feet (14').
   D.   Access To Street Or Alley: Each required off street loading berth shall be designed with appropriate means of vehicular access to a street or alley in a manner which will least interfere with traffic movements, and shall be subject to approval of the zoning administrator.
   E.   Improvement Standards: All open off street loading berths shall be improved in accordance with the standards contained in section 11-11-5 of this chapter.
   F.   Prohibited Acts: No storage of any kind nor motor vehicle repair work or service of any kind shall be permitted within any required loading berth except emergency repair service.
   G.   Parking Not Allowed In Loading Space: Space allocated to any off street loading shall not, while so allocated, be used to satisfy the space requirements for any off street parking facilities or portions thereof.
   H.   Central Loading Facilities: Central loading facilities may be substituted for loading berths on the individual zoning lots, provided the following conditions are fulfilled:
      1.   Each zoning lot served shall have direct access to the central loading area without crossing streets or alleys at grade.
      2.   Total berths provided shall meet the requirements based on the sum of the several types of uses served. (Area of types of uses may be totaled before computing number of loading berths.)
      3.   No zoning lot served shall be more than five hundred feet (500') removed from the central loading area.
      4.   The tunnel or ramp connecting the central loading area with the zoning lot served shall be not less than seven feet (7') in width and have a clearance of not less than seven feet (7').
   I.   Receiving Facilities: Uses for which off street loading facilities are required herein but which are located in buildings of less floor area than the minimum prescribed for each required facilities shall be provided with adequate receiving facilities, accessible by motor vehicle off any adjacent alley, service drive, or open space on the same zoning lot.
   J.   Basis For Providing Berths: Loading berths shall be provided on the basis of the required berths for individual use.
   K.   Uses Enumerated; Berths Required: For uses herein listed and other similar uses, loading berths shall be provided as specified below:
      1.   For the uses listed hereunder, one loading berth shall be provided for buildings containing ten thousand (10,000) to one hundred thousand (100,000) square feet of gross floor area, plus one additional loading berth for each additional one hundred thousand (100,000) square feet of gross floor area or fraction thereof:
Airports.
Amusement and recreational facilities.
Banks and other financial institutions.
Business and other professional offices.
Convention and exhibition halls.
Health and medical institutions.
Hotels and motels containing retail shops, business or professional offices, convention or exhibition halls or auditoriums.
Public and administration buildings.
Radio and television studios.
Recording studios.
Theaters (indoor).
Undertaking establishments.
      2.   For the uses listed hereunder, one loading berth shall be provided for buildings containing ten thousand (10,000) to twenty thousand (20,000) square feet of gross floor area plus one additional loading berth for each additional two hundred thousand (200,000) square feet of gross floor area or fraction thereof:
Apartment hotels.
Auditoriums.
Charitable institutions.
Clubs and lodges.
Hotels and motels containing no retail shops, business or professional offices, convention or exhibition halls or auditoriums.
Meeting halls.
Multiple-family dwellings.
Religious institutions.
Research or testing institutions.
Schools and educational facilities.
      3.   For the uses listed hereunder, one loading berth shall be provided for buildings containing five thousand (5,000) to forty thousand (40,000) square feet of gross floor area. For buildings containing forty thousand (40,000) to one hundred thousand (100,000) square feet of gross floor area, two (2) loading berths shall be provided plus one additional loading berth for each additional one hundred thousand (100,000) square feet of gross floor area or fraction thereof:
Assembly, manufacturing and fabricating establishments.
Cartage, express and motor freight facilities.
Cleaning, repair, servicing and testing establishments.
Laundries and dry cleaning facilities.
Mail order houses.
Printing and publishing.
Warehousing, storage, and wholesale establishments.
      4.   For all other uses, including but not limited to furniture and appliance stores, retail stores and restaurants and other establishments handling the sale or consumption of food or beverages on the premises, loading berths shall be provided in accordance with the following schedule:
