CHAPTER 16

SPECIAL PURPOSE ZONES

10-16A-1: PURPOSE:

The P public facilities district is established to promote the development, maintenance, use, and identification of municipally owned, dedicated, or leased land, structures, open space, parks, and other property. (Ord. 2007-4, 4-16-2007)

10-16A-2: PERMITTED USES:

The following are permitted uses in any P district:
Essential services and essential service structures.
Municipally owned golf courses, tennis courts, skating rinks, playing fields, and other recreational facilities.
Municipally owned parks and open space.
Restaurants, concessions, and hospitality services.
Towers which meet the requirements of chapter 17, article D of this title.
Other uses not listed but similar to the permitted uses herein and consistent with the stated purpose of this district. (Ord. 2007-4, 4-16-2007)

10-16A-3: ACCESSORY USES:

   A.   Accessory uses and activities customarily incidental to and found with the permitted uses outlined in this article. (Ord. 2007-4, 4-16-2007)

10-16A-4: PROVISIONAL USES:

Limited licensed food operations; provided, that:
   A.   The food operation has received written permission from the parks and recreation division manager or his or her designee, and
   B.   If listed as a requirement from the parks and recreation division manager, the food operation is a distance of one hundred feet (100') or more from any special event, and
   C.   All applicable state and city laws governing such uses are strictly adhered to and all required operating permits and licenses are secured. (Ord. 2007-4, 4-16-2007)

10-16A-5: CONDITIONAL USES:

The following are conditional uses in a P district:

10-16A-6: LOT REQUIREMENTS AND SETBACKS:

The following minimum requirements should be observed in a P district subject to additional requirements, exceptions, and modifications set forth in this title:
   A.   Lot area: None.
   B.   Lot width: None.
   C.   Lot depth: None.

10-16A-7: MAXIMUM BUILDING HEIGHT:

10-16A-8: MAXIMUM LOT COVERAGE:

10-16B-1: PURPOSE:

The INS institutional district is intended to accommodate facilities capable of providing services to large groups in a campuslike setting as the district should encourage institutions to plan long range for geographical expansion, providing surrounding property owners with information as to those plans. (Ord. 2007-3, 3-5-2007)

10-16B-2: PERMITTED USES:

The following are permitted uses in an INS district:
Any permitted uses in the zoning district in effect immediately prior to the property being zoned institutional. Yard and setback requirements for these uses shall be the same as were in effect for that property immediately prior to the property being zoned institutional.
Colleges, universities and other postsecondary institutions of higher education, including all facilities customarily located on such campuses, but excluding campus organizations.
Elementary through secondary schools.
Essential services.
Hospitals, nursing homes, dependent care facilities and retirement homes.
Licensed preschool, childcare centers, and facilities that provide residential and nonresidential programs.
Publicly owned governmental or cultural buildings, including, but not limited to, libraries, city offices, county offices, public works facilities, auditoriums, public administration buildings and historical developments. Government and public regulated utility buildings and structures necessary for the health, safety and general welfare of the city.

10-16B-3: ACCESSORY USES:

The following are permitted accessory uses in an INS district:
Uses and activities customarily incidental to and found with the permitted and conditional uses outlined in this article. (Ord. 2007-3, 3-5-2007; amd. Ord. 2016-11, 6-27-2016)

10-16B-4: PROVISIONAL USES:

The following are provisional uses in an INS district:
Cemeteries or memorial gardens; provided that the site accesses a minor arterial or arterial street.
Recreational facilities as a principal use; provided that:
   A.   The principal use, function or activity is open and outdoor in character.
   B.   Not more than five percent (5%) of the land area of the site is covered by buildings or structures.
   C.   When abutting a residential use or a residential use district, the property is screened and landscaped in compliance with chapter 19 of this title.
Towers which meet the requirements of chapter 17, article D of this title. (Ord. 2007-3, 3-5-2007)

10-16B-5: OTHER USES:

Other uses not outlined above may be considered utilizing the planned unit development process outlined in article C of this chapter and chapter 17, article A of this title. (Ord. 2014-15, 8-25-2014)

10-16B-6: LOT REQUIREMENTS AND SETBACKS:

The following minimum requirements shall be observed in an INS district subject to the additional requirements, exceptions and modifications set forth in this title:
   A.   Lot area: Three (3) acres.
   B.   Lot width: One hundred feet (100').
   C.   Setbacks:
      1.   Front Yard: Not less than thirty five feet (35'). For this section, the front yard on a corner lot shall be determined by the zoning administrator after giving consideration to visual impact, orientation of neighboring buildings, the height and architectural style of the building, and predominance of traffic flows on adjacent streets.
      2.   Side Or Rear Yard: Not less than fifteen feet (15') where abutting a residential use or a public street provided that for any portion of a building or structure within thirty five feet (35') of a side or rear lot line, one additional foot of yard shall be provided for each foot of height in excess of twenty five feet (25') up to a maximum of thirty five feet (35'). 10-16C-1: PURPOSE:

The purpose of the PUD planned unit development district is to provide a district for master planning unique areas in a manner that allows for creativity and innovation in site design, architecture, integration of land uses, enhanced pedestrian environments, integration of storm water features and connected open spaces. The PUD district is intended to allow development patterns that are consistent with the comprehensive plan, but may otherwise be prohibited under the traditional zoning standards. 10-16C-2: APPLICATION:

All permitted, permitted accessory, or conditional uses contained in chapter 18 of this title shall be treated as potentially allowed uses within a PUD district. (Ord. 2004-40, 1-3-2005)

10-16C-3: SPECIAL PROCEDURES:

Whether requested as a rezoning or initially established by city action alone, a PUD planned unit development district shall be established and governed subject to the amendment and procedure requirements as outlined in chapter 3 of this title, plus the procedures and conditions imposed by chapter 17, article A of this title.
