This title shall be administered and enforced by the city. The city may institute in the name of the city of Moorhead any appropriate actions or proceedings against a violator as provided by statute, charter, ordinance or code.
If the provisions of this title are being violated, the city shall notify, in writing, the person responsible for such violations, indicating the nature of the violation and ordering the action necessary to correct it. The city shall order discontinuance of illegal use of land, buildings or structures; removal of illegal buildings or structures or of additions, alterations or structural changes thereto; discontinuance of any illegal work being done; or shall take any other action authorized by this title to ensure compliance with or to prevent violation of its provisions. 10-8-2: PENALTIES, VIOLATIONS AND ENFORCEMENT:
A. Penalty: Any person violating any provision of this title shall, upon conviction, be penalized in accordance with the provisions of section 1-4-2 of this code. Each day such violation continues or occurs constitutes a separate offense and may be prosecuted as such.
B. Violations: Violations of the provisions of this title shall include by way of example and not limitation:
1. The owner or tenant of any building, structure, premises or part thereof and any architect, builder, contractor, agent or other person who commits, participates in, assists in or maintains a violation may each be found guilty of a separate offense and suffer the penalties herein provided of the provisions of this title.
2. Failure to comply with a condition in a conditional use permit1 shall be a violation of this title. Each day such violation continues or occurs constitutes a separate offense and may be prosecuted as such.
C. Enforcement: Nothing herein contained shall prevent the city from taking any other appropriate actions or proceedings against a violator as provided by law or city ordinance to prevent or remedy the violation or penalize the violator. (Ord. 2004-40, 1-3-2005)
