RULES ADOPTED

§ 160.500 RULES ADOPTED.

   (A)   Stormwater management plans. The city hereby adopts by reference, and as may be amended, the Rice Creek Watershed District Rule C related to stormwater management plans. Applications related to stormwater management plans will be reviewed by the local governing unit (“LGU”) in accordance with the Rice Creek Watershed District Rule C.
   (B)   Erosion and sediment control. The city hereby adopts by reference, and as may be amended, the Rice Creek Watershed District Rule D related to erosion and sediment control. Applications related to the modification or alteration of erosion sediment control will be reviewed by the LGU in accordance with Rice Creek Watershed District Rule D.
   (C)   Floodplain alteration. The city hereby adopts by reference, and as may be amended, the Rice Creek Watershed District Rule E related to floodplain alteration. Applications related to the modification or alteration of floodplains will be reviewed by the LGU in accordance with Rice Creek Watershed District Rule E.

§ 160.501 INCORPORATION; CONFLICTS.

   The Rice Creek Watershed District Rules C, D, E, and F, as may be amended from time to time, and which are expressly adopted in § 160.500 above, shall be made a part of this chapter as if fully set forth herein. In the event of a conflict between a provision of this chapter, including any provision contained in the Rice Creek Watershed District Rules expressly adopted herein, and any other preview in the city code, the more restrictive standard or provision shall prevail.

§ 160.999 PENALTY.

   (A)   Any person who violates any provision of this chapter is guilty of a misdemeanor and shall, upon conviction thereof, be punished and fined as provided in § 10.999 of this code of ordinances. Each day a violation is permitted to exist shall constitute a separate offense.

   (B)   Except as provided herein, no significant or specimen tree shall be removed from any property in the city. Any violation of any provision of §§ 160.415 through 160.421 of this chapter shall constitute a misdemeanor offense. Property owners or permit holders having been cited for illegal tree removal may be fined for each significant or specimen tree illegally removed. In addition to the punishment specified in this division (B), the city may enforce this code by any other appropriate form of action which could include withholding a certificate of occupancy, forfeiture of all or part of a bond, escrow or financial guarantee and stoppage of the project.
