R-3, MEDIUM

DENSITY RESIDENTIAL DISTRICT

§ 160.115 PURPOSE.

   The purpose of the R-3, Medium Density Residential District is to provide for medium density housing in multiple-family structures ranging up to and including six units and directly related complementary uses.

§ 160.116 PERMITTED USES.

   The following are permitted uses in an R-3 District:
   (A)   All permitted uses allowed in an R-2 District;
   (B)   Townhouses up to six units as regulated herein;
   (C)   Boarding houses as defined in § 160.012 of this chapter and limited to not more than eight persons;
   (D)   Boarding (house) home; foster children: restricted to a family dwelling in which children out of their own homes, ages 16 years or under, or in the case of mental retardation, age 21 or under, are cared for 24 hours a day for a period of 30 days. The number to be cared for in one foster child boarding (house) home shall not exceed 12, including the foster family’s own children;
   (E)   Day care home:
      (1)   Restricted to a family dwelling in which foster care, supervision and training for children of school or preschool age out of their own home is provided during part of a day (less than 24 hours) with no overnight accommodations or facilities and children are delivered and removed daily.
      (2)   The number to be cared for in one day care home shall not exceed 12, including the family’s own children;
   (F)   Public parks and playgrounds; and
   (G)   Essential services.

§ 160.117 ACCESSORY USES.

   The following are permitted accessory uses in an R-3 District:
   (A)   All permitted accessory uses allowed in an R-2 District;
   (B)   Enclosed garage stalls, the number of which shall not exceed the number of dwelling units in the principal building. Individual stalls shall not exceed 250 square feet each and shall be attached to one another by common interior walls which meet the state’s Building Code requirements. All setback requirements as specified in § 160.055(D) of this chapter shall be met; and
   (C)   Off-street loading.

§ 160.118 CONDITIONAL USES.

   The following are conditional uses in an R-3 District (requiring a conditional use permit based upon procedures set forth in and regulated by §§ 160.450 through 160.452 of this chapter):
   (A)   All conditional uses allowed in an R-2 District;
   (B)   Multi-family dwelling structures containing six or less dwelling units; and
   (C)   Multi-family dwelling expansion.
      (1)   A conditional use permit (CUP) shall be required prior to any proposed multiple-family residential expansion. (For the purposes of this section, expansion shall mean an increase in the building foot print or an increase in the number of dwelling units in the building.) Developments having already obtained a CUP shall go through the amendment process as identified in §§ 160.450 through 160.452 of this chapter.
      (2)   In addition to the criteria outlined in §§ 160.450 through 160.452, 160.465 through 160.470 and 160.485 through 160.487 of this chapter, all proposed expansions shall satisfy all relevant zoning, building and parking code requirements.
