10.20 Home

Occupations

10.20.010 MINOR HOME OCCUPATIONS.

A. Defined: Home occupations which meet the standards of subsection B of this section shall be defined as "minor home occupation" businesses.

B. Standards: No home occupation, major or minor, shall be permitted unless it meets the following standards:

1. No home occupation shall be permitted that alters the exterior appearance of the dwelling. No exterior architectural modifications shall be made expressly to accommodate the commercial use of the home.

2. The home occupation may include the sale of merchandise; however, direct sales from display shelves is not permitted at the dwelling and products should be delivered to customers. Retail sales of products and services are allowed at the home with a maximum of two (2) customers per hour.

3. The area of the home devoted to the home occupation and/or storage of stock in trade shall not occupy more than twenty five percent (25%) of the area of any one floor.

4. The home occupation shall not involve the use of any yard space or activity outside of the residence, except where the use or activity is of the type that is customarily found in the residential neighborhood and where the use or activity does not adversely impact the residential nature of the neighborhood. Open storage in and storage or use of a garage is not allowed, except for appropriate vehicle storage.

5. Advertising signs shall conform to the sign ordinance and shall be attached to the dwelling, except for minimum mailbox identification. No window displays or exterior evidence, except a two (2) square foot sign advertising the home occupation, is permitted, except that which is customarily found in a residential area.

6. Only one motor vehicle may be used in association with the home occupation and shall be garaged or stored entirely on private property and not within the front yard of the dwelling. Off street parking for the residents must be preserved in addition to the commercial vehicle. The vehicle used for the home occupation shall be limited to a maximum size of one ton gross vehicle weight. A maximum of four (4) square feet of signage will be allowed on the vehicle.

7. The home occupation shall not employ anyone other than the immediate family residing in the dwelling and shall not generate vehicular traffic not commonly associated with the residential zone in which it is located.

8. Explosive and/or combustible materials shall not be stored, used and/or sold in a home occupation business. The home occupation shall not unreasonably disturb the peace and quiet of the neighborhood, including, but not limited to, interference with radio, television or other electronic reception, nor otherwise by reason of design, materials, construction, lighting, odor, dust, sounds, noise, vibrations, vehicles, parking and general operation of the business and/or otherwise.

9. Promotional meetings for the purpose of selling merchandise or taking orders shall not be held more than once each month.

10. Garage, basement, yard or other similar sales shall not be permitted more than four (4) times each year, and each sale shall not continue more than seventy two (72) hours.

11. All home occupation business shall be conducted between the hours of six o’clock (6:00) A.M. and ten o’clock (10:00) P.M.

12. All home occupation businesses shall fully comply with all city ordinances and state laws, including, but not limited to, business licensing regulations. Periodic inspections, as required by this code, will be made as required by the type of home occupation business.

13. Home occupation licenses shall be reviewed and may be revoked upon valid unresolved complaints. Inspections by the city may occur as necessary to assure conformance with this chapter, other city ordinances and state laws.

14. Handicapped persons may obtain a waiver of the restrictions imposed by this chapter through application to the planning commission to permit such persons to become self-sufficient.

C. Permitted Businesses: Permitted minor home occupation businesses include, but are not limited to, the following:

Artist, author, architectural services.

Barbershops and beauty shops.

Consulting services.

Dance studio, aerobic exercise, music lessons, tutoring and general education instruction, provided the number of students is limited to two (2) at a time.

Data processing and computer programming.

Direct sales distribution such as Amway, Avon, Jafra, Tupperware, Herbalife, etc.

Garden produce.

Home crafts and sales.

Insurance and real estate sales.

Interior design.

Janitorial services.

Mail order (not to include retail sales from site).

Sales representatives.

10.20.020 MAJOR HOME OCCUPATIONS.

A. Defined: "Major home occupations" are defined as home occupations which meet the standards listed in MPMC 10.20.010, except as specifically modified by the planning commission as provided herein.

B. Increase In Intensity; Conditional Use: The planning commission may allow, as a conditional use, increases in the intensity of a home occupation, as follows:

1. The number of customers or patrons coming to the home may range from three (3) to six (6) per hour, if sufficient off street parking is provided and the use does not adversely affect the neighborhood;

2. A larger commercial vehicle may be used, provided it is parked on private property and adequately hidden; and

3. Storage within the garage or accessory building may be permitted as long as two (2) parking spaces for residential use are provided and the garage functions for parking.
