Zones
A. The industrial/manufacturing park zone (M-P) is established to provide an environment conducive to the establishment of quality laboratory, processing and light manufacturing uses in a parklike atmosphere. The zone is, therefore, more restrictive than a conventional manufacturing zone to provide for architectural excellence and an abundance of attractive green landscaping. This zone is intended to be located in the fringe areas of the city in open, readily developable land.
B. This zone is to be characterized by attractively designed buildings and off street parking lots situated among spacious lawns, trees, shrubs and other landscape features. The most distinguishing characteristic of this zone is a parklike appearance of grounds surrounding the buildings and the parking areas.
C. In order to accomplish the purposes and objectives of this zone, the regulations set forth in this section shall apply in the M-P manufacturing park zone.
Those uses or categories of uses as listed in MPMC 10.12.010.3, MPMC 10.12.010.4, MPMC 10.12.010.5 are permitted in the M-P zone.
In order to maintain adequate controls in the M-P zone, no principal uses will be permitted without a conditional use permit.
Accessory uses in the M-P zone shall have the same requirement as in MPMC 10.12.010.3.
The following uses and structures are permitted in the M-P zone only after a conditional use permit has been issued as outlined in MPMC 10.30:
Airport related services.
Appliance sales, parts and service.
Bookbinding.
Carpenter shop, cabinet shop.
Commercial testing laboratories and services.
Computer related businesses, i.e., assembly, sales, service, software, computer programming.
Data processing services.
Dental laboratory services.
Display, sales and manufacturing of manufactured homes.
Educational services (public only).
Electric motor sales, service, repair and rebuilding.
Electrical appliances and/or electronic instruments assembling and sales, parts and service.
Electrical contracting materials and supplies, electrical service and maintenance, electrical materials, equipment, and lighting fixtures sales.
Food storage products and sales.
Furniture and fixture manufacturing.
Governmental services.
Grazing of animals (providing grazing takes place within a well fenced area at least 300 feet distant from the airport runway or taxiways).
Heating, ventilating and air conditioning sales and services; light sheet metal products, including heating and ventilating ducts and equipment.
Home improvement and handyman services.
Knitting mill.
Manufacturing and maintenance of the following (provided the entire operation and storage takes place indoors):
Business machines.
Cameras and photographic equipment.
Electric and neon signs, billboards and/or commercial advertising structures.
Musical instruments.
Novelties.
Optical goods and instruments.
Rubber and metal stamps.
Toys.
Watches and clocks.
Manufacturing, assembling and treatment of articles of merchandise from the following previously prepared materials (provided the entire operation and storage takes place indoors):
Canvas.
Cellophane.
Cloth.
Cork.
Felt.
Shell.
Straw.
Textiles.
Wood.
Yarn.
Manufacturing, processing, packing and treatment of the following products (provided the entire operation and storage takes place indoors):
Bakery goods.
Candy.
Cosmetics.
Dairy products.
Meat and fish products.
Pharmaceuticals.
Toiletries.
Medical laboratory services.
Microfilming.
Motor vehicles, trailers, bicycles and similar machinery assembling, painting, upholstery, rebuilding, repair, rental, sales and reconditioning, providing the entire operation and storage takes place indoors.
Natural gas fuel outlet.
Plumbing contracting and supplies; plumbing services and maintenance; plumbing materials, equipment, fixture sales.
Power tool sales, service and repair.
Printing, including engraving and photoengraving, blueprinting, photostating and duplication.
Professional, scientific and controlling instruments.
Refrigeration services and repair.
Research services.
Sexually oriented businesses.
Sign painting and fabrication (provided the entire operation and storage takes place indoors).
Stucco and plastering business.
Transfer company.
Upholstering, including mattress manufacturing, rebuilding and renovating.
Warehouse.
Water softener manufacturing, sales, service and repair.
Weaving.
Welding and steel fabrication, manufacturing and assembly (provided the entire operation takes place indoors).
Wholesale business.
Window and glass business.
Accessory uses and buildings customarily incidental to the above uses.
Any other use that is similar to those listed above and is approved by the city council, after recommendation from the planning commission.
Every lot or parcel of land created in the M-P zone shall be of sufficient size to provide for required setbacks, landscaping and off street parking for any permitted uses, building or structures on the site. No single M-P zone, however, shall contain less than twenty (20) acres.
Each lot or parcel of land in the M-P zone shall have a lot width adequate to provide for the width of any proposed building, driveway access to the rear of the building, and peripheral landscaping adjacent to the driveway access at the width of at least five feet (5').
Each lot or parcel of land in the M-P zone shall abut a public street for a minimum distance of eighty feet (80').
Lots or parcels of land which were created prior to the application of the M-P zone shall not be denied a building permit solely for reason of nonconformance with the parcel requirements of this section.
All buildings constructed within the M-P zoning district shall have a minimum gross floor area of one thousand (1,000) square feet.
The following minimum yard requirements shall apply in the M-P zone:
A. Front Yard: Each lot or parcel in the M-P zone shall have a front yard of not less than fifteen feet (15').
B. Side Yard: There shall be no required side yards within the M-P zone, except that adequate space shall be maintained between any building and the side property line to provide ingress and egress to parking areas in the rear of the building in conformance with subsection D of this section.
C. Side Yard; Corner Lots: On corner lots, the side yard contiguous to the street shall not be less than ten feet (10'). The side yard shall not be used for vehicular parking, but shall be appropriately landscaped and beautified.
D. Side Yard; Driveway: When used for access to loading docks, parking lots, garages or carports behind any building in the M-P zone, a side yard shall be wide enough to provide an unobstructed twelve foot (12') surfaced driveway for one-way traffic, and a sixteen foot (16') unobstructed surfaced driveway for two-way traffic. Where such a driveway is provided, a landscaped area at least five feet (5') in width shall be maintained between the driveway and the adjacent side property line.
E. Side Yard; Accessory Building: The side yard of any accessory building in the M-P zone shall be the same as that required for the principal building.
F. Rear Yard: Each lot or parcel of land in the M-P zone shall have a rear yard of not less than ten feet (10'). The rear yard may be used for vehicular parking, provided a masonry screen wall at least four feet (4') in height is provided along the entire length of the rear property line.
G. Rear Yard; Accessory Building: An accessory building may be located on the rear property line as long as:
1. It has no opening on the side contiguous with the rear property line;
2. It has one hour fire resistant construction in the wall adjacent to the property line;
3. It provides for all roof drainage to be retained on the subject lot or parcel;
4. The materials used on the side of the building adjacent to the rear property line shall present an attractive architectural appearance to the adjacent property; and
5. The accessory building does not encroach onto any easement.
In the M-P zone:
A. The following structures may be constructed on or may be projected into any yard:
1. Fences and walls in conformance with city codes and ordinances;
2. Landscaping elements, including trees, shrubs, turf and decorative lighting; and
3. Necessary appurtenances for utility service.
B. The structures listed below may project into a minimum front or rear yard not more than eight feet (8'), and into a minimum side yard not more than four feet (4'):
1. Cornices, eaves, belt courses, sills, buttresses or other similar architectural features;
2. Fireplace structures and bays, loading docks (except in front yard), and signs when attached to the wall of the building; and
3. Stairways, balconies, door stoops, fire escapes, awnings and planting boxes or masonry planters not exceeding twenty four inches (24") in height.
No lot or parcel in the M-P zone shall have a building or structure which exceeds a height of two (2) stories or thirty five feet (35'), whichever is greater.
In the M-P zone:
A. The distance between principal buildings, or between principal buildings and accessory buildings, shall not be less than twenty feet (20').
B. For buildings which exceed twenty feet (20') in height, an additional foot of distance between buildings shall be provided for each foot that either building exceeds twenty feet (20') in height.
In the M-P zone, all buildings, including accessory buildings and structures, shall cover not more than fifty percent (50%) of the total area of the lot or parcel of land.
Each lot or parcel in the M-P zone shall have, on the same lot or parcel, a parking lot improved with asphaltic cement or concrete to the standards of MPMC 10.22. The parking lot shall be provided with internal and peripheral landscaping in conformance with a landscaping plan approved by the planning commission.
Prior to construction of any building or structure within the M-P zone, a site plan and preliminary building elevations must be approved by the planning commission. The site plan must be fully dimensioned and shall contain the following information:
A. The location of all proposed buildings and structures on the site, including accessory buildings, walls and fences;
B. Parking layout, driveways, points of ingress and egress, loading zones and pedestrianways; and
C. A detailed landscaping plan showing all landscaping features, including sizes and types of plant materials, lighting and layouts of irrigation and sprinkler systems.
Unless otherwise prohibited by law, signs of a type and description listed below, may be placed and maintained on a parcel of property in the M-P zone:
A. Two (2) signs for each building, not exceeding two hundred (200) square feet each, which shall be mounted flat on the wall of the building to identify the occupant of the building or product, trade name or trade symbol associated with the occupant. These signs may be illuminated only by an indirect light source;
B. Two (2) temporary signs with a maximum of six (6) square feet each, pertaining to the sale, lease or rent of a particular building, property or premises upon which displayed;
C. One temporary sign not exceeding seventy five (75) square feet which announces the construction of a new building. The sign may contain the name of the owners, tenants, architects, engineers, builders, tradesman and others associated with the construction and planning of the building. The sign shall be located on the same premises as the new building which it announces; and
D. Signs and monuments identifying points of interest or sites of historic significance. The size and location of the signs or monuments shall be specifically approved by the planning commission.
In the M-P zone:
A. Required: All areas of a lot or parcel not occupied by a building or required parking shall be appropriately landscaped with lawn, trees, shrubs and other landscaping materials in accordance with a landscaping plan approved by the planning commission. The entire front yard area of lots in the M-P zone, except necessary driveways, sidewalks, etc., shall be landscaped.
B. Parking Lots: Parking lots will be provided with landscaping around the periphery, and in islands and bays within the internal areas of the parking lots.
All uses located in the M-P zone shall be conducted entirely within a fully enclosed building. There shall be no outside storage of materials, trash or equipment, other than motor vehicles licensed for street use.
A masonry wall at least five feet (5') in height shall be erected along all property lines in the M-P zone which are adjacent to a residential zone existing at the time the building is constructed on a lot or parcel in the M-P zone. A masonry wall at least four feet (4') in height shall also be constructed along any property line immediately adjacent to a parking lot or parking area. The "clear vision area", as defined in MPMC 10.18.100 shall remain clear to the extent set forth in that section.
