Containerized Property Storage Facilities "PCPSFs"

  1. PCPSF is defined as a portable containerized property storage facility or unit intended to be utilized upon the exterior of residential premises for the purpose of storing all types of items of personal and household property either for pure storage (most often during, but not limited to, periods of time while construction or improvements are occurring on a property) or to facilitate the moving of persons from a household unit to household unit, often with the intention that such unit, after a reasonable period of time for loading, will be moved to commercial storage facilities. A PCPSF is also often referred to as a “PODS.”
  2. Applicability. This Ordinance shall apply to the R-1, R-2, and R-3 zones within the Borough. However, no provision of this ordinance shall apply to any governmental unit.
  3. Outdoor Storage Containers, Cargo Containers, and Shipping Containers are prohibited in R-1, R-2, and R-3 zones. “Outdoor Storage Containers,” “Cargo Containers,” or “Shipping Containers” shall mean an industrial, standardized reusable outdoor storage/ shipping container that is originally, specifically or formally designated for or used in the packing, shipping, movement or transportation of freight, articles, goods or commodities and presently utilized for those purposes or for storage of household items; and/or designed for or capable of being mounted or moved on a rail car; and/or designed for or capable of being mounted on a chassis or bogie for movement by truck, trailer or loaded on a ship; and/or intended to or necessary, for purposes of safety, to be placed upon a foundation and, therefore, constituting an accessory structures; and/or having a length greater than 12 feet; and/or being of heavy gauge steel construction, aluminum or a composite material.
  4. Permits.
    1. No PCPSF shall be situated on any premises within the R-1, R-2 or R-3 zones unless and until an application has been made to the Borough Zoning Official for a permit allowing for the delivery and use of such PCPSF, and such permit has been granted.
    2. A permit application shall be made no less than fourteen (14) days prior to the proposed placement of the PCPSF. The permit application shall depict a sketch of the house, driveway, street, house number, utilities, approximate distance, and any fire hydrants on the property. The application shall contain the mailing address and the contact numbers of the applicant, and the non-refundable application fee as set forth in Chapter XXIII, Fees of this code. Within ten (10) days of receipt of the application, the Borough Zoning Official shall visit the proposed site and either approve or disapprove the requested permit.
    3. Permits shall be effective for thirty (30) days and shall expire thereafter unless renewed in accordance with this section.
    4. No more than one PCPSF may be located on any residential property at any time.
    5. No PCPSF shall exceed 12’ in length; 7’ in height; or 8’ in width.
    6. If a renewal permit is desired, a new application must be made, and a new application fee must be submitted. Requests for renewal permits must be receive not less than five (50 days prior to the expiration of the existing permit. Renewal permits may be granted at the sole discretion of the Borough zoning Official in extreme hardship situations, on a case-by-case basis. No residential property shall contain a PCPSF for a total of more than 90 days.
    7. Notwithstanding the above, in the event a PCPSF is situated on a property within the R-1, R-2, or R-3 zone without a permit, the property owner/ occupant shall submit an application as described above within twenty-four hours of an abatement notice; however, in such instances, the non-refundable application fee shall be set forth in Chapter XXIII, Fees of this code. Submission of an application shall not guarantee issuance of a permit.
  5. Other requirements. The following requirements shall be met by the owner/occupant of the residential premises with respect to a PCPSF:
    1. The PCPSF situated on residential property shall only be used for the storage of personal property, furniture and other household items normally located on or in a residential dwelling or premises. No chemicals or dangerous substances may be stored in a PCPSF at any time. No PCPSF may be utilized in a manner that is deleterious to the public health, safety or welfare. A PCPSF shall be subject to inspection by an appropriate Borough Official at any time to ensure that such PCPSF is not being utilized in a manner that is or may be deleterious to the public health, safety or welfare.
    2. All access doors shall be secured with locks.
    3. The PCPSF must be located in the driveway of the premises as close to the house as possible. All vehicles associated with the house must be parked in the driveway in compliance with Borough overnight parking regulations. If for any reason all cars associated with the house cannot be parked in the driveway, the PCPSF may only be situated on the premises for seven (7) days, with police permission for overnight street parking obtained, and noted in the permit.
    4. The PCPSF may be located in an area other than the driveway of the premises only in extreme hardship cases, decided at the sole discretion of the Borough Zoning Official, on a case-by-case basis. If such permission is granted, it may be for a period not longer than seven (7) days, and shall be expressly noted in the permit.
  6. Violations. The enforcement of Article 12 of the Borough Land Use Ordinance shall apply to this Section.
