For the construction of sheds or similar structures totaling 200 square feet or less in size and 10 feet or less in height, a zoning permit shall be required in a form approved by the Zoning Official.
Zoning Permits. No land shall be occupied or used in whole or in part for any purpose whatsoever unless and until a zoning permit therefor shall have been issued by the Administrative Officer. A zoning permit shall be required for the use of any premises which do not have upon them a building. Whenever there shall be a change contemplated in the use of any premises which do not have a building upon them, a new zoning permit therefor shall be required.
Certificate Of Occupancy.
Industrial/Commercial/Professional/Retail: No person, company, firm or corporation shall occupy, commence operations, expand operations within a building, enlarge the premises of any business or industry in the Borough, or change the location of its business or industry from one location to another within the Borough until an application is first made to the Administrative Official for a Certificate of Occupancy and said Certificate is issued after an inspection is performed by the Fire Official and the Administrative Official.
Similarly, no building, newly erected or newly altered, and no building in which the tenancy of the building shall change, shall be occupied or used in whole or in part for any purpose whatsoever until a Certificate of Occupancy shall have been issued therefore by the Administrative Official.
The Administrative Official may grant a Certificate of Occupancy for offices in an existing building or structure for business, professional, executive or administrative use, or for a warehouse for such specific use, without the necessity of site plan approval by the Planning Board if the Administrative Official is satisfied that the proposed new office or new warehouse use is the same as the use which previously occupied the premises, that the floor plan submitted therefore complies with all of the requirements of the Borough including the applicable building and zoning codes, that the proposed use does not alter the traffic and parking patterns of the prior tenancy, and does not endanger the health, safety and welfare of the citizens. The Administrative Official may grant a Certificate of Occupancy to a retail sales or service operation in the B Zone without the necessity of a site plan approval if the Administrative Official is satisfied that the operation will be similar to the previous use, does not alter traffic or parking patterns, does not endanger the health, safety and welfare of the citizens, and meets other required approvals, including, but not limited to, those pertaining to Board of Health and Fire Safety Codes.
Residential: No change in occupancy of a residential dwelling which results from a change in ownership or, if the residential dwelling is occupied pursuant to a lease, from a change of tenant, shall occur until a Continued Certificate of Occupancy has been obtained. In connection with the issuance of such Continued Certificate of Occupancy, the Administrative Official or Building Official shall determine that the residence conforms to all applicable regulations and ordinances of the Borough.
Time Limitation. All improvements shown on any site plan shall have been installed on the premises in question before any zoning permit or certificate of occupancy, as the case may be, shall be issued, except that such may be issued if the person making such improvements shall post good and sufficient bond with an acceptable surety company.

Any change in use shall be treated as a new use and a new zoning permit or certificate of occupancy, as the case may be, shall be required therefor. Before any zoning permit or certificate of occupancy, as the case may be, shall be issued for any such change in use, all provisions of this Ordinance shall be complied with in the same manner as if the new use were an initial use of land or a new structure or building.
Records. It shall be the duty of the Administrative Officer and the Construction Official, respectively, to keep records of all applications for building permits, zoning permits or certificates of occupancy and of all such permits and certificates issued, together with a notation of all special terms or conditions imposed thereunder. Each shall be responsible for the filings and safekeeping of all plans and specifications submitted to him with any application, and the same shall form a part of the records of his office and shall be available to all officials of the Borough. Copies of any permits or certificates shall be furnished upon request to any person who shall have a right thereto by law.
Violations. The use or occupancy of land or buildings prior to securement of a building permit, zoning permit or a certificate of occupancy, as the case may be, when one is required, shall be a direct violation of this Ordinance and shall subject the violator or violators to the penalties hereinafter prescribed.
