(a)
Occupation tax on manufacturers and sellers of alcoholic beverages. The annual occupation tax referred to in section 6-31, upon manufacturers and sellers of alcoholic beverages, shall be as follows:

Notwithstanding the provisions of subsection (a) of this section, the occupational tax for those service organizations or fraternal beneficiary societies which are exempt under section 501(c)(19), (8) or (10) of the Internal Revenue Code shall be $500.00 per year.

The building permit fee for a manufactured home shall be $140.00. The fee will include the following permits:

The amount charged for a moving permit to transport the unit to the building site inside the city limits;

Permit for the construction of a garage or carport for one or two cars;
4.
Brick or other veneer;
5.
Roofing; and
6.
Other construction related directly to the building unit, except permits for the electrical work, mechanical work, plumbing work, driveway, water meter, water line, sewer connection, septic tank, and temporary electrical pole.

Other fees for electrical work, mechanical work, plumbing work, driveways, water meters and lines, sewer connections and septic tanks shall be the same as for a conventionally built structure.

The charge referred to in section 98-69, for replacement of the solid waste cart after termination of service for nonpayment of the utility bill, shall be $15.00.

(a)
Application for closing street or easement under section 102-1.
(1)
The application fee shall be $150.00.
(2)
The notice fee shall be an amount equal to the actual cost of mailing notice in the U.S. Mail using the notice method required in the Code (first class, registered letter, or otherwise) for each property owner who is entitled to receive notice of the proceeding. In the event the application is withdrawn prior to mailing of notices, the notice fee shall be refunded to the applicant.
(b)
License and permit fees for street cuts, borings and excavations.
(1)
The license fee to perform street cuts, borings or excavations shall be $100.00.
(2)
The permit fee to make a street cut, boring or excavation shall be $100.00.
(c)
Sidewalk construction permit. The sidewalk construction permit fee referred to in section 102-153 shall be $50.00.

(a)
Vacation of unrecorded plat. The fee for application for vacation of an unrecorded plat referred to in section 106-72 shall be $25.00.
(b)
Vacation of recorded plat. The fee for application for vacation of a recorded plat referred to in section 106-73 shall be $25.00.
(c)
Application for approval of preliminary plat. The filing fee for preliminary plat applications referred to in section 106-148 shall be as follows:
(1)
For developments with lots two acres or greater: $250.00, plus $4.00 per lot for developments up to 50 lots, and $2.00 per lot for each lot over 50 lots.
(2)
For developments with lots less than two acres: $250.00, plus $2.00 per lot for developments up to 50 lots, and $1.00 per lot for each lot over 50 lots.
(d)
Application for approval of final plat. The filing fee for final plat applications referred to in section 106-177 shall be as follows:
(1)
For developments with lots two acres or greater: $350.00, plus $4.00 per lot for developments up to 50 lots, and $2.00 per lot for each lot over 50 lots.
(2)
For developments with lots less than two acres: $350.00, plus $3.00 per lot for developments up to 50 lots, and $2.00 per lot for each lot over 50 lots.
(e)
Application for deed approval. The filing fee for an application for deed approval referred to in section 106-233 shall be $25.00.
(f)
Application for short form subdivision approval. The filing fee for an application for short form subdivision approval referred to in section 106-263 shall be $75.00.
(g)
Subdivision inspection fees. The subdivision inspection fees for streets, water and sewer referred to in section 106-364, based upon the estimated cost of construction, shall be according to the following scale:
(1)
Two and one-half percent of the first $100,000.00 of engineering estimate or actual contracts.
(2)
Two percent of all over $100,000.00, not to exceed $200,000.00.
(3)
One and one-half percent of all over $200,000.00. (See Ordinance No. 419, 3- -89)
(h)
Applications for revocable permit. The fee for application for a revocable permit shall be $150.00.

Sewer infrastructure impact fee. There is hereby established a sewer infrastructure impact fee, referred to as the "SII Fee," which fee shall be paid at the time an application is filed seeking a building permit.
1.
For residential building permits, the amount of the SII fee shall be $1,000.00, which shall include attached or detached garages.
2.
For commercial or industrial building permits, the amount of the SII fee shall be $1,000.00.
3.
Where the building for which a permit is sought does not have access to a municipal sewer connection and will not have such access within 12 months after issuance of a certificate of occupancy, then no SII fee shall be due for such building until such time as a request is made for connection to municipal sewer facilities. The amount of the SII Fee shall be calculated in the same manner provided under subsections 1. and 2., above.
4.
The following shall be exempted from payment of the SII Fee:
(i)
Alterations or expansion of an existing building that has existing sewer service and where the use is not changed.
(ii)
The replacement of a building that has existing sewer service and where the use is not changed.
(iii)
Buildings in existence on the effective date of this ordinance [April 3, 2018] that seek connection to municipal sewer facilities after the effective date of this ordinance.
Any claim of exemption must be made no later than the time of application for building permit. Any claim not so made shall be deemed waived.
5.
There is hereby established a separate sewer infrastructure impact fee trust account, referred to herein as the "SII account." Funds collected from the SII fee shall be deposited into the SII account. Funds from the SII account may be withdrawn and used only for the following purposes, upon approval of the city council:
(i)
To acquire, equip, and/or make capital improvements to sewer infrastructure or facilities in the City of Mustang, but not for maintenance or operations. Capital improvements are equipment, infrastructure or facilities with an expected useful life of three years or more.
(ii)
In the event that bonds or similar debt instruments are issued for advanced provision of capital improvements for which funds from the SII account may be expended, SII Account funds may be used to pay debt service, including interest, costs of issuance and related expenses, on such bonds or similar debt instruments to the extent that the improvements provided are of the type described in subsection 1. above.
At least once each fiscal year the city manager shall present to the city council a proposed capital improvement program for sewer infrastructure and facilities, and assigning SII account funds, including any accrued interest, to specific projects. Monies, including any accrued interest, not assigned in any fiscal period shall be retained in the SII account until the next fiscal period.
6.
The effective date of this subsection (a)(2) is October 18, 2006.
(c)
Sewer user charge. The sewer user charge referred to in section 118-134 shall be $4.74 per 1,000 gallons of water.
(d)
Minimum charge for residential sewer service. The minimum charge for residential sewer users referred to in section 118-136 shall be $9.51, based upon a minimum water consumption of 2,000 gallons.

(a)
Application fees.
(1)
Rezoning petitions and petitions for amendment. The application fee referred to in section 122-52, for filing a petition for a zoning amendment or an amendment to the comprehensive plan, shall be as follows:
a.
For filing a petition to change a zoning classification, $175.00.
b.
For filing a petition to change a zoning classification to include a use allowed only in the C6 commercial special use district, $500.00.
c.
For filing a petition to change a zoning classification to a planned unit development, $175.00, plus an acreage charge of $15.00 per acre or any part of an acre thereof. Provided, if the planned unit development includes a use allowed only in the C6 commercial special use district, the filing fee shall be $500.00, plus the acreage charge.
d.
For filing a petition for a comprehensive plan land use amendment, $150.00.
(2)
Application for special use permit. The filing fee for an application for a special use permit referred to section 122-73 shall be $75.00.
(3)
Appeal to board of adjustment. The filing fee for an appeal to the board of adjustment referred to in section 122-130 shall be $100.00.
(4)
Application for approval of group home. The filing fee referred to in section 122-852 for an application for approval of a group home shall be $75.00. If the application requires a public hearing, an additional fee of $75.00 shall be required.
(5)
Application for temporary occupancy permit. The permit fee referred to in section 122-242 for an application for temporary occupancy of a travel trailer shall be $75.00.
(b)
Notice fee. In addition to the application fees, a notice fee shall be required for each application or filing for which the City is required to mail notice to third parties. The notice fee shall be an amount equal to the actual cost of mailing notice in the U.S. Mail using the notice method required in the Code (first class, registered letter, or otherwise) for each person who is entitled to receive notice of the proceeding. Other fees for electrical work, mechanical work, plumbing work, driveways, water meters and lines, sewer connections and septic tanks shall be the same as for a conventionally built structure.

(a)
Application for closing street or easement under section 102-1.
(1)
The application fee shall be $150.00.
(2)
The notice fee shall be an amount equal to the actual cost of mailing notice in the U.S. Mail using the notice method required in the Code (first class, registered letter, or otherwise) for each property owner who is entitled to receive notice of the proceeding. In the event the application is withdrawn prior to mailing of notices, the notice fee shall be refunded to the applicant.
(b)
License and permit fees for street cuts, borings and excavations.
(1)
The license fee to perform street cuts, borings or excavations shall be $100.00.
(2)
The permit fee to make a street cut, boring or excavation shall be $100.00.
(c)
Sidewalk construction permit. The sidewalk construction permit fee referred to in section 102-153 shall be $50.00.

(a)
Vacation of unrecorded plat. The fee for application for vacation of an unrecorded plat referred to in section 106-72 shall be $25.00.
(b)
Vacation of recorded plat. The fee for application for vacation of a recorded plat referred to in section 106-73 shall be $25.00.
(c)
Application for approval of preliminary plat. The filing fee for preliminary plat applications referred to in section 106-148 shall be as follows:
(1)
For developments with lots two acres or greater: $250.00, plus $4.00 per lot for developments up to 50 lots, and $2.00 per lot for each lot over 50 lots.
(2)
For developments with lots less than two acres: $250.00, plus $2.00 per lot for developments up to 50 lots, and $1.00 per lot for each lot over 50 lots.
(d)
Application for approval of final plat. The filing fee for final plat applications referred to in section 106-177 shall be as follows:
(1)
For developments with lots two acres or greater: $350.00, plus $4.00 per lot for developments up to 50 lots, and $2.00 per lot for each lot over 50 lots.
(2)
For developments with lots less than two acres: $350.00, plus $3.00 per lot for developments up to 50 lots, and $2.00 per lot for each lot over 50 lots.
(e)
Application for deed approval. The filing fee for an application for deed approval referred to in section 106-233 shall be $25.00.
(f)
Application for short form subdivision approval. The filing fee for an application for short form subdivision approval referred to in section 106-263 shall be $75.00.
(g)
Subdivision inspection fees. The subdivision inspection fees for streets, water and sewer referred to in section 106-364, based upon the estimated cost of construction, shall be according to the following scale:
(1)
Two and one-half percent of the first $100,000.00 of engineering estimate or actual contracts.
(2)
Two percent of all over $100,000.00, not to exceed $200,000.00.
(3)
One and one-half percent of all over $200,000.00. (See Ordinance No. 419, 3- -89)
(h)
Applications for revocable permit. The fee for application for a revocable permit shall be $150.00.

b.
Sewer infrastructure impact fee. There is hereby established a sewer infrastructure impact fee, referred to as the "SII Fee," which fee shall be paid at the time an application is filed seeking a building permit.
1.
For residential building permits, the amount of the SII fee shall be $1,000.00, which shall include attached or detached garages.
2.
For commercial or industrial building permits, the amount of the SII fee shall be $1,000.00.
3.
Where the building for which a permit is sought does not have access to a municipal sewer connection and will not have such access within 12 months after issuance of a certificate of occupancy, then no SII fee shall be due for such building until such time as a request is made for connection to municipal sewer facilities. The amount of the SII Fee shall be calculated in the same manner provided under subsections 1. and 2., above.
4.
The following shall be exempted from payment of the SII Fee:
(i)
Alterations or expansion of an existing building that has existing sewer service and where the use is not changed.
(ii)
The replacement of a building that has existing sewer service and where the use is not changed.
(iii)
Buildings in existence on the effective date of this ordinance [April 3, 2018] that seek connection to municipal sewer facilities after the effective date of this ordinance.
Any claim of exemption must be made no later than the time of application for building permit. Any claim not so made shall be deemed waived.
5.
There is hereby established a separate sewer infrastructure impact fee trust account, referred to herein as the "SII account." Funds collected from the SII fee shall be deposited into the SII account. Funds from the SII account may be withdrawn and used only for the following purposes, upon approval of the city council:
(i)
To acquire, equip, and/or make capital improvements to sewer infrastructure or facilities in the City of Mustang, but not for maintenance or operations. Capital improvements are equipment, infrastructure or facilities with an expected useful life of three years or more.
(ii)
In the event that bonds or similar debt instruments are issued for advanced provision of capital improvements for which funds from the SII account may be expended, SII Account funds may be used to pay debt service, including interest, costs of issuance and related expenses, on such bonds or similar debt instruments to the extent that the improvements provided are of the type described in subsection 1. above.
At least once each fiscal year the city manager shall present to the city council a proposed capital improvement program for sewer infrastructure and facilities, and assigning SII account funds, including any accrued interest, to specific projects. Monies, including any accrued interest, not assigned in any fiscal period shall be retained in the SII account until the next fiscal period.
6.
The effective date of this subsection (a)(2) is October 18, 2006.
(c)
Sewer user charge. The sewer user charge referred to in section 118-134 shall be $4.74 per 1,000 gallons of water.
(d)
Minimum charge for residential sewer service. The minimum charge for residential sewer users referred to in section 118-136 shall be $9.51, based upon a minimum water consumption of 2,000 gallons.

(a)
Application fees.
(1)
Rezoning petitions and petitions for amendment. The application fee referred to in section 122-52, for filing a petition for a zoning amendment or an amendment to the comprehensive plan, shall be as follows:
a.
For filing a petition to change a zoning classification, $175.00.
b.
For filing a petition to change a zoning classification to include a use allowed only in the C6 commercial special use district, $500.00.
c.
For filing a petition to change a zoning classification to a planned unit development, $175.00, plus an acreage charge of $15.00 per acre or any part of an acre thereof. Provided, if the planned unit development includes a use allowed only in the C6 commercial special use district, the filing fee shall be $500.00, plus the acreage charge.
d.
For filing a petition for a comprehensive plan land use amendment, $150.00.
(2)
Application for special use permit. The filing fee for an application for a special use permit referred to section 122-73 shall be $75.00.
(3)
Appeal to board of adjustment. The filing fee for an appeal to the board of adjustment referred to in section 122-130 shall be $100.00.
(4)
Application for approval of group home. The filing fee referred to in section 122-852 for an application for approval of a group home shall be $75.00. If the application requires a public hearing, an additional fee of $75.00 shall be required.
(5)
Application for temporary occupancy permit. The permit fee referred to in section 122-242 for an application for temporary occupancy of a travel trailer shall be $75.00.
(b)
Notice fee. In addition to the application fees, a notice fee shall be required for each application or filing for which the City is required to mail notice to third parties. The notice fee shall be an amount equal to the actual cost of mailing notice in the U.S. Mail using the notice method required in the Code (first class, registered letter, or otherwise) for each person who is entitled to receive notice of the proceeding. In the event the application or other filing is withdrawn prior to mailing of notices, the notice fee shall be refunded to the applicant.
