ARTICLE XIII

EXCEPTIONS TO PROVISIONS

Sec. 26-630.- Generally.

The regulations contained herein relating to the provisions of this Code shall be subject to the exceptions contained in this article.

Sec. 26-631. - Height limitations.

Church spires, cupolas, water, microwave, radio and television towers, flag poles, chimneys, and other appurtenant structures, may exceed the district limitations by 15 feet.

Sec. 26-632. - Buildings on through lots that front on both streets.

Buildings on through lots that extend from street to street may waive the rear yard requirements, provided an equivalent open space shall be furnished on the same lot in lieu of the required rear yard and provided the setback requirements on both streets shall be complied with.

Sec. 26-633. - Permitted encroachments.

For the purpose of this Code the following shall be considered as permitted encroachments within the yards indicated:

(1)

In any yard: overhanging roof eaves, open terraces, marquees, flues, sills, lintels, pilasters, cornices, gutters, open canopies, and awnings attached to the principal building, not to exceed 33 percent of the depth of the front or rear yards or 33 percent of the width of the side yard, or ten percent of the shore yard.

(2)

In front yards, balconies may extend a distance of four feet or less, provided they are seven feet or more above the grade of the building line. Steps, stoops, uncovered porches, decks and patios may extend a distance of eight feet or less into the front yard.

Encroachments in any yard that abuts a public or private street, shall be considered as permitted encroachments, as outlined above, except that no encroachment shall be permitted within present or proposed street rights-of-way lines.

On corner lots, in any district, encroachments are not permitted in excess of three feet above the curbline in the intersection vision clearance triangle.

(5)

On corner lots, in any district, side yard setback requirements will be applied along the two interior lot lines, and front yard setback requirements will be applied along both street frontages.
