ARTICLE IV

SITE PLANS REQUIRED

Sec. 26-76.- Intent.

New developments or alterations to existing developments because of their size, scale or nature, may negatively impact existing private developments, public improvements or the general welfare of the public, and therefore are in need of special review and consideration.

Sec. 26-77. - Review.

To safeguard against potential problems or impacts that may arise, site plan approval shall be required for the following:

(1)

Any proposed use that is listed in a particular district as requiring "site plan approval";

(2)

Any new construction, or additions to existing buildings, located on a parcel within a commercial or industrial zoned district;

(3)

Any new construction, or addition to existing buildings, which will result in the establishment of four or more residential dwelling units on a single parcel.

(4)

Any new construction or reconstruction of a parking lot, or addition of ten or more parking spaces to an existing parking lot.

Sec. 26-78. - Procedure.

Following are the regulations for proceeding with a development or project and filing a site plan:

(1)

Any person, firm, corporation, or group who wishes to proceed with a development or project described above shall consult with the Department of Community Development;

(2)

A site plan shall be filed with the Department of Community Development along with the submittal of a site plan review application and fee as established by the Council. A digital copy of all site plans, in PDF or compatible format by electronic mail or compact disc shall also be submitted. The Department of Community Development will determine if all the required information is provided and adequate for review;

(3)

Once the required information is received, the Department of Community Development, along with other City staff will review the site plan and make recommendations. The site plan will be placed upon the agenda of the next regularly scheduled Plan Commission meeting;

(4)

The Plan Commission shall review, add conditions as appropriate and approve the site plan; and

(5)

A building permit may only be issued after the Plan Commission approves the site plan.

Sec. 26-79. - Site plan requirements.

Plans submitted for review shall be drawn to an appropriate scale and shall include at a minimum the following items of information:

(1)

Name and address of owner and/or developer;

(2)

Date, north marker and name of proposed development or project;

(3)

Existing buildings, rights-of-way, easements, and location and name of roadways;

(4)

Any other information necessary to describe the proposal.
